The Disposition Process Under The Juveniles Justice Standards Project, Stanley Z. Fisher
The Disposition Process Under The Juveniles Justice Standards Project, Stanley Z. Fisher
Faculty Scholarship
The Juvenile Justice Standards Project volumes were publicly discussed for months prior to their publication. Unavoidably, much of the discussion was based upon rumor regarding their contents. In that context, critics charged that the proposed Standards would "destroy the nation's juvenile court system and replace it with a 'junior criminal system' "1 and claimed that the Standards substitute the philosophy of "just deserts" for the traditional rehabilitative goals of juvenile justice.' The news media described the Standards on disposition of delinquents as designed to "fit the penalty to the crime, no matter what the age of the perpetrator. '3 I …

Radiation From Nuclear Power Plants: The Need For Congressional Directives, Michael S. Baram
Radiation From Nuclear Power Plants: The Need For Congressional Directives, Michael S. Baram
Faculty Scholarship
Congress often responds to a complex problem by empowering an independent regulatory agency to enforce its legislative will. Acknowledging its own lack of knowledge and time, Congress gives the agency a measure of freedom to modify the legal requirements to fit a variety of circumstances that the legislature could not foresee. Ordinarily Congress restrains this autonomy by prescribing general criteria that the agency must consider and objectives that must be met.' These provisions enable Congress to measure the agency's progress and make necessary changes in the law. In addition, competition from other bureaus forces the agency to act vigorously or …

The Platinum Platter Doctrine In Ohio: Are Private Police Really Private?, Brian C. Petroziello
University of Dayton Law Review
Perhaps one of the greatest aids to beleaguered municipal and county police forces in the fight against crime is the use of special policemen by department stores and factories. As is often the case with any good preventative, however, there is great potential for abuse. While special police beneficially free more regularly employed municipal and county police officers for other duties, their increasing use is beginning to raise a number of legal issues which are not easily resolved.
Many of the issues involve constitutional questions of great importance, particularly in the areas of the fourth and fifth amendments, and rights …
The National Emergencies Act Of 1976- End Of Emergency Government?, George G. Slater
The National Emergencies Act Of 1976- End Of Emergency Government?, George G. Slater
IUSTITIA
The purpose of this article is to examine whether the National Emergencies Act will accomplish its purpose of insuring that the exercise of national emergency authority by the Executive is responsible, appropriate, and timely. While the National Emergencies Act has drawn a certain amount of attention to the problem, it has, by no means, solved it. The Act exempts from its provisions eight statutes which the executive branch considers "vital" national emergency authority.' 9 The obvious paradox of these exceptions, which is one of the most important continuing problems in the area, is more easily understood after an examination of …

Legislative Notes: The Economic Impact Disclosure Act, William F. Flynn
Legislative Notes: The Economic Impact Disclosure Act, William F. Flynn
University of Michigan Journal of Law Reform
While the traditional concern with agency discretion is that agency decision-making will be biased in favor of the regulated industries, agencies are also criticized for failing to investigate the impact of their policies on the regulated client and the resulting cost to consumers. This failure prevents the agency from responding adequately to the legitimate interests of either the business community or consumers. This note examines a recently developed procedure designed to improve the agency decisionmaking process by requiring economic prediction of the effect which agency activities will have prior to agency action.
In particular, this note examines three issues. Part …
