Data Subjects' Privacy Rights: Regulation Of Personal Data Retention And Erasure, Alexander Tsesis
Data Subjects' Privacy Rights: Regulation Of Personal Data Retention And Erasure, Alexander Tsesis
Faculty Publications & Other Works
The European Union's right to erasure came into effect May 25, 2018, as Article 17 of the General Data Protection Regulation ("GDPR"). Unlike the U.S. "marketplace of ideas" model of free speech, the GDPR gives greater weight to data subjects' privacy interests than to audiences' curiosity about others' intimate lives. The U.S. and EU models advance human thirst for knowledge through open and uninhibited debates, whereas the internet marketplace tends to favor social media companies' commercial interests: put more specifically, free speech is not entirely harmonious with the interests of social media intermediaries whose algorithms tend to favor companies' bottom …
Police Disciplinary Appeals, Stephen Rushin
Police Disciplinary Appeals, Stephen Rushin
Faculty Publications & Other Works
This Article argues that police disciplinary appeals serve as an underappreciated barrier to officer accountability and organizational reform. Scholars and experts generally agree that rigorous enforcement of internal regulations within a police department promotes constitutional policing by deterring future misconduct and removing unfit officers from the streets. In recent years, though, a troubling pattern has emerged. Because of internal appeals procedures, police departments must often rehire or significantly reduce disciplinary sanctions against officers who have engaged in serious misconduct. Little legal research has comprehensively examined the appeals process available to officers facing disciplinary sanctions. By drawing on a national dataset …

Retrospective Policy Analysis Of Kentucky House Bill 1, Sarah E. B. Covey
Retrospective Policy Analysis Of Kentucky House Bill 1, Sarah E. B. Covey
Theses and Dissertations--Public Health (M.P.H. & Dr.P.H.)
Background: In 2011, the Centers for Disease Control (CDC) coined the phrase, “opioid epidemic” in response to the staggering increase in opioid use and opioid- related deaths. Kentucky House Bill 1 (HB1) passed in 2012, attempted to stifle the impact of the opioid epidemic on the citizens of the Commonwealth by imposing supply-side restrictions on the prescription and dispensing of opioid pills. Objective: The primary objective of this analysis is to evaluate the effectiveness of HB1 on the reduction of opioid-related deaths, opioid prescription rates, and intravenous opioid drug use rates. Methods: This analysis employed Eugene Bardach’s framework for policy …
Defining Boundaries: How A City And County Addressed Legalized Recreational Marijuana, Tera Kathleen Hinkley-Bressi
Defining Boundaries: How A City And County Addressed Legalized Recreational Marijuana, Tera Kathleen Hinkley-Bressi
Geography Masters Research Papers
In 2012 Washington state voters legalized recreational marijuana; local jurisdictions retained the option to ban recreational marijuana production, processing, and/or retail sales. Licenses for marijuana business could be distributed by the state to licensees in areas where local laws prohibited the business. This disconnect prompted legal battles between local governments and would-be business owners, as exemplified in the central Washington county of Yakima and the county seat, the city of Yakima. After a series of state policy changes and local community outcry, the city of Yakima reversed its initial ban, while the county continued prohibition. This paper explores issues underlying …
Barring Access To The Truth: North Carolina's Limiting Approach To Police Body-Camera Footage, Taylor Emory
Barring Access To The Truth: North Carolina's Limiting Approach To Police Body-Camera Footage, Taylor Emory
Campbell Law Review
Police body-cameras are innovative, truth-detecting tools. When it comes to controversial citizen-law enforcement interactions, they can depict an accurate portrayal of the events. No speculation, no controversy-just the truth. And with the truth, the existing tension between law enforcement officials and the general populace can begin to ease. Although these body-cameras are widely used, states such as North Carolina have enacted legislation that severely restricts access to such footage.
North Carolina General Statutes section 132-1.4A does two things. First, it requires individuals captured in footage to seek judicial approval for the disclosure or release of footage. Second, it completely bars …

Improving Bicycle Infrastructure With The Use Of Bicycle Share Travel Data, Jennifer Mintao Weast
Improving Bicycle Infrastructure With The Use Of Bicycle Share Travel Data, Jennifer Mintao Weast
Theses and Dissertations--Civil Engineering
Bicycling as a mode of transportation has been increasing in recent years due to its environmental and health benefits. The availability of bicycles through bicycle share programs has made bicycling a more viable option. With this increase, there is a need for complementary improvements of bicycle infrastructure. Many local and regional transportation agencies are recognizing this need and developing a master plan or safety action plan to improve the city’s bicycle and walking facilities. This study examines bicycle travel demands and travel patterns in Lexington, Kentucky as generated by SPIN bicycle share users. It is hypothesized that the SPIN users …
Modern Charity: Morality, Politics, And Mid-Twentieth Century Us Writing, Matt Bryant Cheney
Modern Charity: Morality, Politics, And Mid-Twentieth Century Us Writing, Matt Bryant Cheney
Theses and Dissertations--English
Scholars over the past two decades (Denning, Szalay, Edmunds, Robbins) have theorized the different ways literature of the Mid-Twentieth Century reflects the dawn of the liberal US welfare state. While these studies elaborate on the effect rapidly expanding public aid had on literary production of the period, many have tended to undervalue the lingering influence on midcentury storytelling of private charity and philanthropy, those traditional aid institutions fundamentally challenged by the Great Depression and historically championed by conservatives. If the welfare state had an indelible impact on US literatures, so did the moral complexity of the systems of charity and …
Veterans' Treatment Courts In Kentucky: Examining How Personal Characteristics And During-Program Occurrences Influence Program Completion And Criminal Recidivism, Monica Lynn Himes
Veterans' Treatment Courts In Kentucky: Examining How Personal Characteristics And During-Program Occurrences Influence Program Completion And Criminal Recidivism, Monica Lynn Himes
Theses and Dissertations--Social Work
Military veterans are disproportionately represented in United States (U.S.) jails and prisons, with nearly 10% of current inmates being veterans. Veterans’ criminal justice involvement is often precipitated by underlying mental health and substance abuse that are connected to their military service. Veterans’ treatment courts are the judicial response to a need for more coordinated provision of mental health and substance abuse services to veterans involved in the criminal justice system. Modeled after drug courts and mental health courts, veterans treatment courts are a judicial innovation that aim to honor the service of veterans by providing them an alternative to incarceration. …
A Review Of The Use Of Positive Reinforcement In Drug Courts, Katherine Bascom
A Review Of The Use Of Positive Reinforcement In Drug Courts, Katherine Bascom
PCOM Psychology Dissertations
There is a need to provide effective treatment for drug-abusing offenders, as evidenced by the explicitly supported relationship between drug use and crime (Anglin & Perrochet, 1998; Tonry & Wilson, 1990; McBride & McCoy, 1993). Drug policy in the United States has viewed drug abuse as a public safety concern or a public health concern (Marlowe, 2002). In 1989, the Miami Drug Court in Dade County, Florida developed a drug court system that is currently used nationwide. The model embodies a very strong behavioral orientation with clear expectations, as well as graduated sanctions and rewards for successive infractions and accomplishments. …

Modeling Of Wrong Way Driving Entries And Developing Innovative Approaches For Evaluating The Effectiveness Of Advanced Wrong Way Driving Countermeasures, Md Imrul Kayes
Electronic Theses and Dissertations
Wrong-way driving (WWD) is a hazardous behavior on interstates, toll roads, and other high-speed limited access facilities. Since WWD crashes are rare, recent researchers have studied WWD events such as WWD 911 calls and WWD citations to understand the overall nature and trend of WWD. It is very difficult to build credible statistical models based solely on crashes due to the small sample size since these are only 3% of all crashes. Modeling of WWD non-crash events can result in more accurate models. A model was developed for Florida limited access facilities to identify roadway factors and traffic characteristics of …
Development Of Decision Support System For Active Traffic Management Systems Considering Travel Time Reliability, Whoibin Chung
Development Of Decision Support System For Active Traffic Management Systems Considering Travel Time Reliability, Whoibin Chung
Electronic Theses and Dissertations
As traffic problems on roadways have been increasing, active traffic management systems (ATM) using proactive traffic management concept have been deployed on freeways and arterials. The ATM aims to integrate and automate various traffic control strategies such as variable speed limits, queue warning, and ramp metering through a decision support system (DSS). Over the past decade, there have been many efforts to integrate freeways and arterials for the efficient operation of roadway networks. It has been required that these systems should prove their effectiveness in terms of travel time reliability. Therefore, this study aims to develop a new concept of …
A Gun To Whose Head? Federalism, Localism, And The Spending Clause, Daniel S. Cohen
A Gun To Whose Head? Federalism, Localism, And The Spending Clause, Daniel S. Cohen
Dickinson Law Review (2017-Present)
President Trump’s executive order rescinding federal funds from “sanctuary jurisdictions” has brought a critical, but overlooked, question of constitutional law to the forefront of the political debate: how does the Spending Clause apply to local governments? The purpose of the Spending Clause is to empower the federal government to bargain with the states to enact policies it cannot enact itself. This power, however, is constrained within the confines of federalism. The Supreme Court has sought to restrict the Spending Clause by crafting the Dole-NFIB framework, a test to determine whether a federal grant has compromised federalism. At its …
The Use Of Personality Testing In Personnel Selection, Riya Kumar
The Use Of Personality Testing In Personnel Selection, Riya Kumar
CMC Senior Theses
Research has shown that more than 45% of American companies are opting to integrate personality tests in their recruitment processes. Given this surge in personality testing, this thesis examines whether personality testing is a valid predictor of job-fit and performance in the context of personnel selection. A large proportion of this paper is focused upon the Big-Five factor model, its limitations, and derivative tests of the model. The impact of technology upon personality testing is also discussed as an emerging field. By tracing and examining the history of personality testing to current day, I have found that personality tests are …
