Governmental Regulation Of The Press: A Study Of Israel's Press Ordinance - Part I, Pnina Lahav
Governmental Regulation Of The Press: A Study Of Israel's Press Ordinance - Part I, Pnina Lahav
Faculty Scholarship
This article is part of a broader effort to analyse the relationship between the press and the legal system in Israel. Being only a segment of a larger project, it is devoted in its entirely to one component of Israel's press law: the Press Ordinance of 1933 (hereafter Pr. Ord.). Although antiquated and considered by certain circles as merely a "dead letter", the Pr. Ord. still forms the backbone of Israel's press law, since it regulates so many aspects of the press. Beyond its relevance as positive law, the Pr. Ord. is of interest for a number of reasons. Having …

Balancing Private Loss Against Public Gain To Test For A Violation Of Due Process Or A Taking Without Just Compensation, Jeffrey T. Haley
Balancing Private Loss Against Public Gain To Test For A Violation Of Due Process Or A Taking Without Just Compensation, Jeffrey T. Haley
Washington Law Review
The first part of this comment examines the test of balancing private loss against public gain to establish the conceptual basis for analyzing its proper uses. The test is shown to require that land use regulations serve the general welfare and that the public benefits alone, without consideration of incidental private benefits, be sufficient to justify the burdens placed on private property. Part II presents the essential characteristics of the due process and taking without compensation limitations as they have been construed by the United States Supreme Court and developed by other courts and commentators. It is shown that the …

Information And Antitrust: Reflections On The Gypsum And Engineers Decisions, Richard A. Posner
Information And Antitrust: Reflections On The Gypsum And Engineers Decisions, Richard A. Posner
Articles
A persistent and troublesome question of antitrust policy concerns the proper treatment of practices and behavior related to the provision of information to buyers and sellers. The dissemination of pricing information may be evidence offixing, or it may simply be an efficient market-equilibrating mechanism. In this article, Professor Posner discusses two recent Supreme Court decisions that have addressed this problem and then engages in a general analysis of the problem of information and antitrust. Professor Posner concludes that an exchange of information should be considered lawful without regard to market structure or other factors. When appropriate, however, the trier offact …
United States Trust Co. V. New Jersey-State Promises And The Contract Clause: An Untimely Resurrection, Clifford D. Foster Jr.
United States Trust Co. V. New Jersey-State Promises And The Contract Clause: An Untimely Resurrection, Clifford D. Foster Jr.
Seattle University Law Review
This comment examines the impact of United States Trust on traditional contract clause doctrines and policies. After an initial discussion of the factual and legal background, a historical survey will show the decision employs a new approach to contract clause analysis. Next, this comment will analyze the Court's new approach, especially the Court's treatment of impairments when a state is a contractual party, its willingness to make policy judgments formerly left to legislative discretion, and the decision's probable effect on any future municipal debt crises. Finally, in accord with Justice Brennan's dissent in United States Trust, this comment will …
Washington's Juvenile Status Offense Laws, Thomas Neville
Washington's Juvenile Status Offense Laws, Thomas Neville
Seattle University Law Review
This comment discusses the history and characteristics of traditional status offense laws, demonstrates why the laws are a poor response to juvenile misbehavior, and examines proposals to improve them. In subsequently analyzing the new Washington laws that emphasize voluntary social services for rebellious children and their families, this comment concludes that the legislature, though implementing some of these proposals, failed to apply a consistently progressive approach to its new legislation. Inadequate protection for some children and inequitable application of provisions in the new laws may result. Finally, this comment suggests ways to improve the Washington legislation.

Nuclear Power And Preemption: Opportunities For State Regulation, Robert S. Peck
Nuclear Power And Preemption: Opportunities For State Regulation, Robert S. Peck
Cleveland State Law Review
This Note proposes that federal preemption should not be deemed to bar state regulations which further federal goals by imposing more stringent demands upon the regulated subject matter. Additionally, however, valid state regulations must further a demonstrable public health and safety interest of the state, and must not be explicitly barred by a valid congressional declaration of exclusive federal authority. This view of preemption would permit a state to implement a policy reflecting the federal balance between strict safety regulation of nuclear power and encouragement of the continued development of atomic energy. Thus, stricter regulations would be within the permissible …
