Recovery For Injury Without Impact: The Washington Cases, John W. Richards Jan 1938

Recovery For Injury Without Impact: The Washington Cases, John W. Richards

Washington Law Review

It is fifty years, almost to a day, since the problem of liability for physical injuries to the plaintiff, caused not by impact but by fright or shock induced by defendant's negligent conduct, made its nearly simultaneous appearance in England and the United States. Both the House of Lords and the Supreme Court of New York disposed of it by denying liability; both stressed the lack of precedent as the basis for decision. Since then, precedents have come in plenty, and while many of the states still deny an action, the majority in which the question has arisen, supported by …

The Soviet Concept Of Law, Vladimir Gsovski Jan 1938

The Soviet Concept Of Law, Vladimir Gsovski

Fordham Law Review

Glancing into our social, political and economic future, former Dean Pound recently warned "One question, as men argue today, is whether that future will call for a constitution or law or laws at all." The possibility of an approaching agitation for the ouster of law is fairly deducible from current proposals of legal reformers. In these uncertain times, it is of vital interest to the American Bench and Bar to study the purposeful offensive in Soviet Russia directed to the "withering away of all law." How fares this experiment to end all law? Vladimir Gsovski, relying exclusively upon soviet authorities, …

University Of Richmond Bulletin: The University Of Richmond School Of Law Catalogue For 1936-1937, University Of Richmond

Law School Catalogues

General Statement:

A Law School was first established in Richmond College in 1870. From the beginning there were able professors, but financial support was uncertain. In 1890 the family of the late Mr. T. C. Williams, who had been a devoted and useful trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to the T. C. WILLIAMS SCHOOL OF LAW. At various times the School has received further generous gifts from members of the family of Mr. Williams. The largest of these gifts came …

Some Practical Aspects Of Section 77-B Of The Bankruptcy Act, Roger L. Shidler Apr 1937

Some Practical Aspects Of Section 77-B Of The Bankruptcy Act, Roger L. Shidler

Washington Law Review

Generally speaking, 77-B provides that a corporation which is insolvent or unable to meet its debts as they mature, may file a petition for reorganization under the provisions of the Amendment, and may propose a Plan of Reorganization. The Plan must include provisions modifying or altering the rights of creditors generally, or of any class of them, and may include provisions modifying or altering the rights of stockholders generally. To make the Plan effective, 66 2/3% of each class of creditors affected by the Plan must file acceptances of the Plan, and if the corporation is not insolvent, 51% of …

Basic Monetary Conceptions In Law, Arthur Nussbaum Apr 1937

Basic Monetary Conceptions In Law, Arthur Nussbaum

Michigan Law Review

While in various periods of American legal history American courts have been confronted with problems of a monetary character, the importance and multiplicity of these questions have never been more strongly felt than within the last few years, and there is certainly no indication that this situation will change in the near future. The jural difficulties arising from monetary troubles are unusual, not only because of their financial and social implications, but also because of their theoretical intricacies. No wonder, therefore, that arguments advanced by courts in cases of a monetary nature are very often highly unsatisfactory. Again and again, …

The Proposed United States Administrative Court, Part Ii, Robert M. Cooper Feb 1937

The Proposed United States Administrative Court, Part Ii, Robert M. Cooper

Michigan Law Review

The recent movement for the passage of the Logan bill and the establishment of supervisory tribunals for the control of administrative determinations is the result of several preconceived theories concerning the shortcomings of the present system of administrative justice. These underlying theories, cautiously surrounded by a halo of judicial philosophy, have seldom been analyzed in their relation to the development of a sound policy for the administration of governmental functions. The present installment of this article will be devoted first to an examination of these fundamental theories and a consideration of the question how far the present administrative machinery is …
