Read But Not Understood? An Empirical Analysis Of Consumer Comprehension In Homeowners Insurance, Daniel Schwarcz, Brenda J. Cude, Kyle D. Logue, German Marquez Alcala

Law & Economics Working Papers

Modern contract law assumes that consumers meaningfully assent to the standard forms that govern their daily lives. However, this assumption is widely regarded as a legal fiction for two key reasons: first, most consumers do not read standard forms, and second, even those who do often struggle to fully comprehend their terms and implications. While the lack of consumer reading has been well-documented through empirical research, consumers’ ability to comprehend standard form contracts has received surprisingly little attention.

This Article addresses the latter issue by empirically examining whether providing excerpts from the dominant standard form homeowners insurance policy improves consumer …

Time And Retribution, Meghan J. Ryan Jan 2025

Time And Retribution, Meghan J. Ryan

Missouri Law Review

Time is missing from discussions on the theory of retribution. A colossal body of scholarship has been devoted to exploring the theory of retribution, or “just deserts,” but much less has attempted to translate this theory into practice, explaining how to determine an actual offender’s desert in real life. The limited scholarship on this topic touches on who might best assess an offender’s desert. For example, should a judge, a juror, or the public itself be making these desert decisions? But there is also a temporal aspect to this decision-making that has thus far largely eluded exploration: When should the …

This Article draws on lessons from an empirical, interview-based study of law students, professional development legal personnel, and senior lawyers to examine interpersonal connection as a modern lawyering skill. Against a backdrop of swirling influences …

The Right To Truth In Transitional Justice, Nouran Hassan Jan 2025

The Right To Truth In Transitional Justice, Nouran Hassan

Theses and Dissertations

Transitional justice is sought by nations suffering from legacies of human rights violations. The field of transitional justice stands on four main pillars: truth seeking, criminal justice, reparations and guarantees of non-recurrence. It promotes utilizing legal and non-legal mechanisms to achieve a transition to democracy and the mechanisms employed must relate to, at least, one of its pillars. Truth is considered substantial for transitions to happen. Revealing the truth is believed to be essential for reconciliation and promoting peace. However, in various experiences the truth did not lead to reconciliation and was widely distorted. The approach of the transitional justice …

Cultural Discount: Breakthrough Point Of China's Tv Drama Exports To Southeast Asia, Lingxing Li

International Review of Humanities Studies

Driven by China's "Going Global" strategy, the international influence of Chinese TV series continues to grow. As a key vehicle of China's cultural soft power, these TV series have significantly bolstered China's global cultural presence, particularly in Southeast Asia, by showcasing China's rich history and contemporary societal changes. Despite certain geographical and cultural similarities between China and Southeast Asia, cultural differences still present challenges to the dissemination of Chinese TV dramas, particularly in areas such as language, values, and religious beliefs. This paper not only analyzes effective strategies for mitigating "cultural discounts" but also challenges the traditional one-dimensional view of …

This study suggests that Rarampa's social media content, which mainly focuses on event photography and the restaurant's ambiance, …

Dall-E. ChatGPT GPT-4. Words that did not exist in the English lexicon just a few years ago are now commonplace. With the widespread availability of Artificial Intelligence (AI) tools, specifically Generative AI, whether in the context of text, audio, video, imagery, or even combinations of these, it is inevitable that trials related to national security will involve evidentiary issues raised by Generative AI. We must confront two possibilities: first, that evidence presented is AI-generated and not real and, second, that other evidence is genuine but alleged to be fabricated. Technologies designed to detect AI-generated content have proven to be unreliable, …

Optimising The National Strategy For Progressive Employment Absorption To Ensure The Rights And Responsibilities Of Citizens In Indonesia, Rizda Ardyati, Afridah Ikrimah

Jurnal Civics: Media Kajian Kewarganegaraan

Indonesia is experiencing a demographic transition phenomenon. This can be seen from the results of the 2010 population census, which showed a positive trend in the productive age population, namely 15-64 years. In that year, the proportion reached 66% of the total population. The potential growth of Indonesia's productive population can be an engine of sustainable economic growth or a source of social conflict between classes in the future, if the government cannot handle this potential, it will become a problem related to fulfilling the rights of citizens to get decent work, because instead of being absorbed into the workforce, …

The Fathers Have Eaten Sour Grapes: History Is The Wrong Test For Establishment Clause Questions In Public Schools, Abigail Riddle Jan 2025

The Fathers Have Eaten Sour Grapes: History Is The Wrong Test For Establishment Clause Questions In Public Schools, Abigail Riddle

Arkansas Law Review

The old quip goes, “As long as there are math tests, students will pray in the schools.” There is, however, a distinction between private and public prayers; the former allows religious students to find peace and comfort in a moment of anxiety, and the latter openly divides the religious majority from the religious and nonreligious minority, ostracizing the minority and exacerbating their nerves. This Note examines the constitutionality of religious exercises initiated by public school faculty and staff at public education’s founding, arguing that the special considerations present when considering prayer in these contexts are too important to be limited …

The Article makes three novel contributions. First, it applies a health justice framework to the critique of infectious disease criminalization. Second, the Article …

Partisan Judges, Steve Leben Jan 2025

Partisan Judges, Steve Leben

Arkansas Law Review

This article argues that both Republicans and Democrats should look for judges who have intellectual humility and an ability to work with others—even as both parties also look for judges who are generally likely to advance positions favored by them. Part I explores the divergence between the public’s perception that the political views of judges matter and the insistence by most judges that they do not. Ample evidence supports the public’s view, and for judges to be trusted authorities, they should admit this truth. Part II suggests that even after recognizing that political views matter, both political parties (and others …

Read The Sign: The Equal Protection Clause Does Not Require Gender-Affirming Bathroom Access In Schools, Stephen J. Nast

Liberty University Law Review

For thousands of years, bathrooms have been separated by sex—male and female. In fact, for most of human history, there has been a universal understanding that only male and female sexes existed. It was not until the twentieth century that the notion that there could be more than two sexes was popularized and the term “transgender” was introduced to society. By the mid-2010s, the idea that bathrooms should be separated by male and female began to receive opposition. As explored throughout this Comment, children identifying as transgender have filed lawsuits against school boards that did not permit children to use …

The Virginia General Assembly Needs To Spe(Llc) It Out: What Are The Vllca’S Fiduciary Duties And The Standards That Parties Must Abide By?, Carter B. Leverette

Liberty University Law Review

The limited liability company (LLC) has quickly become the most popular business entity in the United States thanks to its favorable pass-through tax treatment, limited liability, and customizability. A catalyst to this success is the parties’ ability to customize their business’s leadership structure and members’ relations through an operating agreement. In the world of business law, the fiduciary relationship and the duties that accompany it—loyalty, care, and good faith—are essential due to the need in a complex society for parties to bargain for and share or acquire different knowledge, skills, or expertise to accomplish particular goals. The flexibility of the …
