This study examines legal protections for consumers in expressing reviews, focusing on the right to freedom of expression as guaranteed by Articles 28E paragraphs (2) and (3) and Article 28F of the 1945 Constitution, Law No. 39 of 1999, Law No. 12 of 2005, Article 19 of the UDHR, and the ICCPR. Bridging The Gap: Stress And Support Systems For Underrepresented Students Pursuing Graduate Education, Carlos A. Tavira-Villegas

Honors Program: Senior Projects (Public)

Embedded within the United States educational system lies a history that is marked by centuries of exclusion, where students of color were denied the right to an equal education. This literature review examines the historical exclusion of Mexican American, Asian, and Black students in the United States. Important legal cases will be explored to trace the progression of educational equity in America. Several theories will be reviewed, including social identity theory, ecological …

The phenomenon of single candidates in regional elections in Indonesia has created a dilemma in applying democratic principles, especially regarding ballot design that often confuses voters. The Constitutional Court’s Decision Number 100/PUU-XIII/2015 mandated a plebiscite design with “agree” or “disagree” options for single candidates. However, in practice, this design has been distorted with the presence of a blank box without adequate explanation. This study aims to evaluate the extent to which the discrepancy between the Constitutional Court's decision and actual ballot design practices affects voter understanding and the quality of democracy. This study employs a normative juridical method with a …

The Age Of Neoliberal Capitalism And The Eclipse Of Intergenerational Care: A Philosophical Reading At The Aftermath Of The Pandemic, Ferdinando G. Menga Mar 2025

The Age Of Neoliberal Capitalism And The Eclipse Of Intergenerational Care: A Philosophical Reading At The Aftermath Of The Pandemic, Ferdinando G. Menga

Emancipations: A Journal of Critical Social Analysis

Taking its cue from the experience of pandemic, which has had an enormous impact on society at a global level, this paper makes a two-faceted plea by way of a philosophical analysis. In the first place, it claims that care should entail not only a present-based reach, but also an intergenerational character. In the second place, the paper analyzes the deep genealogy of the current structural blindness towards a future-oriented understanding of care, a genealogy which is to be traced back to the very modern liberal-capitalist design of society, and, furthermore, is to be detected nowadays in its extreme form …

Christian Ethics And Business Leadership, Jon Armajani Mar 2025

Christian Ethics And Business Leadership, Jon Armajani

The Journal of Social Encounters

This essay discusses the ethical principles of listening, community, stewardship, and interreligious and intercultural understanding with respect to business leadership. It opens by discussing definitions of ethics and their relevance to businesses and business leaders. It continues by providing a description of the consulting company Accenture’s ethical principles and practices, as positive examples. The essay provides Arthur Andersen and its work with Enron and WorldCom, both of which went bankrupt in the early 2000s, as examples of the failures that occur when ethical principles are not practiced. Then, the essay states that Christianity and the Benedictine tradition constitute a basis …

Community-Based Research And Catholic Higher Education In Solidarity: Embracing The Risks And Gifts Of Interdependence, Linda Land-Closson

The Journal of Social Encounters

With common ground in the work of solidarity and the common good, Community-Based Research (CBR) and Catholic Higher Education (CHE) can be brought into a mutually beneficial dialogue. Accordingly, this article serves first as a reminder of the radicality of solidarity, second as a callout to CHE for often falling short of solidarity-in-action, third as an invitation for CHE to offer understandings of solidarity as discernment tools to mitigate harm in the changing field of CBR, and finally as an invitation to CBR to be aware of and continue promoting solidarity through good judgment.

Intergenerational Dialogue And Inquiry For Collective Healing, Social Justice And Communal Well-Being: A Reflection On Conceptions, Processes And Practices, Scherto Gill Mar 2025

Intergenerational Dialogue And Inquiry For Collective Healing, Social Justice And Communal Well-Being: A Reflection On Conceptions, Processes And Practices, Scherto Gill

The Journal of Social Encounters

This paper explores how intergenerational dialogue and inquiry (IDI) may help break the silence about past brutality and contribute to collective healing, social justice and communal well-being. The specific historical contexts that it is concerned with are transatlantic slavery and colonisation, and the continued legacies of contemporary racism. Global communities impacted by these tragedies often experience silence between the generations about the trauma resulting from the atrocity, often exacerbated by present day discrimination. In considering the case study of IDI in communities on four continents, this paper further analyses the processes involved in breaking the cycles of silence, and remembering …

The Curious Case Of Japanese Denim, Aaron Francis Ward Mar 2025

The Curious Case Of Japanese Denim, Aaron Francis Ward

Japanese Society and Culture

From its humble beginnings as wholly utilitarian workwear in the 19th century, to its modern rise to high-fashion, the ubiquity of denim, particularly in the form of jeans, has had a fascinating journey in its little-over-150-year history (Beazley, 2015). Of note has been the recent rise in popularity of Japanese denim. Since the end of the Second World War, Japan seems to have had an insatiable demand for Americana (Marx, 2023). Yet, if considered in the sociohistorical context of Japanese-American relations, this ought to be highly improbable. The current paper examines the sociological nature of Japanese denim from semiotic …

Tourism Resource Development Of Railway Heritage - A Case Study Of Blue Train Taragi, Muneharu Yasumoto

Japanese Society and Culture

The purpose of this thesis is to examine the utilization of railway heritage for tourism, using the example of Blue Train Taragi in Taragi Town, Kumamoto Prefecture. Railway fans are individuals who hold an interest and curiosity in the components necessary for railway operations, including vehicles, tracks, structures, and stations. The experiences of railway fans, who often venture beyond their daily surroundings, can be considered as part of tourist activities. To utilize railway heritage that no longer serves as a transportation service as a tourism resource, it is crucial to create content that allows visitors to experience how it was …

Self-Evolvability—The Ability To Utilize Artificial Intelligence—Definition, Validity, And Policy Implications, Koichi Kume, Hiroyuki Chuma

Japanese Society and Culture

To make full use of the potential of new technologies, including artificial intelligence, it is necessary to switch to a way of thinking and working that is friendly to technology. In this regard, this study examines the concept of “self-evolvability,” which is defined as a mixture of meta-cognition, "informating" everything, and pursuing a shared benefit and desire for self-change. Using survey results in Japan and the United States., we construct a self-evolvability variable and confirm unique features that differ from existing measure, and quantitatively analyzed the relationship between self-evolvability, acceptance of new technologies, provision of personal data, and approval or …

Separation Of Drug Scheduling Powers, Mason Marks Mar 2025

Separation Of Drug Scheduling Powers, Mason Marks

Scholarly Publications

Drug scheduling places substances believed to be harmful and addictive under strict federal control. In 1970, Congress enacted the Controlled Substances Act (CSA), which split drug scheduling authority between executive departments to leverage their specialized expertise. Today, the CSA grants the Department of Health and Human Services (HHS) authority over scientific aspects of drug scheduling and the Drug Enforcement Administration (DEA) jurisdiction over nonscientific, law-enforcement-related matters. However, since 1970, the separation of scheduling powers has collapsed, and law enforcement officials have assumed powers reserved for public health experts. Bureaucratic drift, where policies diverge from what lawmakers attempted to achieve, has …

Defining An "Appropriate Education" Under The Education For All Handicapped Children Act Of 1975, Stephen A. Mansfield Mar 2025

Defining An "Appropriate Education" Under The Education For All Handicapped Children Act Of 1975, Stephen A. Mansfield

Maine Law Review

The educational rights of handicapped children have long been neglected due to a combination of societal indifference and ignorance. Judicial recognition of the educational rights of handicapped persons only began in the early 1970's when constitutional challenges were brought against school systems that excluded handicapped children from attending school. Federal statutory reforms, however, have gone much further than the constitutionally-based decisions of the early 1970's. This Comment focuses on the Education for All Handicapped Children Act, the primary federal statute for securing educational rights of handicapped children. Because the Act is relatively new, case law providing guidance for judicial decision …

Informed Consent In Maine: Woolley V. Henderson And The Informed Consent Statute, John C. Milazzo Mar 2025

Informed Consent In Maine: Woolley V. Henderson And The Informed Consent Statute, John C. Milazzo

Maine Law Review

In recent years, American courts have used two different standards in informed consent actions to define the scope of a physician's duty to disclose to his patient the risks inherent in a proposed medical procedure—the professional disclosure standard and the material-risk standard. In Woolley v. Henderson, the Maine Law Court expressly adopted the professional disclosure standard. Prior to the Law Court's decision, however, but after the cause of action in Woolley arose, the Maine Legislature enacted the Maine informed consent statute. Justice Glassman's opinion in Woolley expressly declined to construe the statute. The continued relevance of Woolley to similar cases …

The Perils And Promises Of Artificial Intelligence In Criminal Sentencing, Tasnimul Hassan Md Mar 2025

The Perils And Promises Of Artificial Intelligence In Criminal Sentencing, Tasnimul Hassan Md

Indian Journal of Law and Technology

The proliferation of technology has resulted in an increased reliance of individuals on technological devices. The world is progressively being automated using Artificial Intelligence (AI) systems that are implemented to achieve specific objectives. Automation is now an important part of people’s lives, and it could heavily change the criminal justice system. This article looks at the use of AI in criminal sentencing in India, arguing that AI-based sentencing can reduce sentencing disparity, either if it is subject to a human element or it is fed with ample data that no case-fact is left out. The paper argues that since AI …

A Love Letter To The Leaders: Why Recognizing And Discussing Secondary Trauma In Legal Work Will Benefit Your Staff, Your Clients, And Most Importantly, The Work, Isabel Corngold, Elizabeth Cole

Nebraska Journal on Advancing Justice

When you work in a client-facing, client-centered section of the law like criminal law, and specifically wrongful convictions, you encounter trauma. Many organizations, including innocence organizations, do not do a sufficient job to recognize and address the impact of that trauma on their staff. This piece seeks to explain the potential impact of this trauma by, one, defining the terms burnout; secondary and vicarious trauma; empathetic distress; countertransference; and compassion fatigue, and, two, listing out signs and symptoms that can be caused by experiencing any of these emotions. Drawing from the authors’ experiences in innocence organizations, this piece addresses leaders …

The Respectful Work Environment (RWE) provisions in the recent University of California labor agreements with graduate students and postdocs have proven useful in addressing harassment and discrimination in new and perhaps more effective ways than either previous contract provisions or university policies and procedures. The authors describe how the new RWE provisions work and provide several illustrative case studies.

"No Pay, No Ras": Resident Assistant Unionization Amidst University Backlash, Justin Weller Mar 2025

"No Pay, No Ras": Resident Assistant Unionization Amidst University Backlash, Justin Weller

Journal of Collective Bargaining in the Academy

While resident assistant (RA) unions have existed in the United States for over 20 years, RA unionization has accelerated on college campuses in recent years. This article explores the institutional responses to RA unionization through a distributive justice framework. I argue unionization aligns with the distributive justice framework and union-busting strategies do not align. I provide practical recommendations for institutions to align their practices with the National Labor Relations Act and relevant jurisprudence. Implications include a need to study RAs’ experiences in unionization and a continued focus on the ongoing legal challenges that may impact future unionization.

What Happens In Vegas, Stays In Vegas. Or Does It?: A Dormant Commerce Clause Analysis Of Nevada’S Online Sports Gambling In-Person Registration Requirement, Lena E. Richardson

San Diego Law Review

Is the in-person registration requirement Nevada’s last-ditch effort to keep what happens in Vegas, in Vegas? This Comment argues that Nevada violates the Dormant Commerce Clause by requiring in-person registration for online sports betting. Part II introduces Nevada’s sports gaming regulations, history, regulatory scheme, and the potentially impacted industries. Part III discusses the relevant law on the Dormant Commerce Clause under a discrimination test. Part IV analyzes Nevada’s in-person registration requirement under the Dormant Commerce Clause and discusses legitimate local purposes for the regulation and reasonable alternatives, concluding that the regulation violates the Dormant Commerce Clause. Judges, as the main judicial actors in law enforcement, have an independent nature, both in terms of institutions and in terms of determining their decisions. However, in exercising their authority, judges are often faced with the risk of injury, both physical and psychological, by the public, who are not satisfied with the decisions made by the judges. With an empirical legal research method and using a conceptual approach, statute approach, and comparative approach, this study aims to find the best form in the design of an institutional model for judge and court security units. In this study, it was found …

As the world became increasingly interconnected, the significance of international law has been augmented exponentially. International law encompasses a vast array of legal systems, written norms, and customary principles that govern the interactions between states, still being the primal and main norm creators, as well as to some extent international organizations, and other non-state actors (NSA) gaining more and more influence, and finally us - individuals. In recent times, the utilization of law as a tool of warfare has gained prominence, with public and private entities leveraging legal arguments and international institutions to achieve their military and political objectives.
