In this Article I shall first consider the rules contained in the Revised Single Negotiating Text (RSNT) in relation to claims put forward at the UNCLOS and in the actual practice of States. Then I shall view the rules of the RSNT in the light of other sources of international law, in particular the 1974 judgments by the International Court of Justice (ICJ) concerning the fishery limits off Iceland and the trend established by unilateral extensions of several States through national legislation. Two judicial decisions in the early 1950s construing the FTC's section 13 (a) power produced a conflict that has not been resolved either by later courts or by the amendments to section 13 enacted in 1973. The dispute basically concerns the depth of the courts' inquiry into whether an advertisement violates- section 12 and the applicability of traditional equitable concepts in the context of the statutory injunction procedure. This Note contends that the legislative history of pertinent provisions of the Act suggests an appropriate resolution of the conflict through a two-step approach that would relax the scrutiny ordinarily accorded petitions …

Government Regulation Of Health-Care Drugs Of Questionable Efficacy, Robert J. Milis

Rutherford and similar cases present several interesting questions. The threshold inquiry in the federal court cases is whether a substance like laetrile falls within the scope of certain sections of the Food, Drug, and Cosmetic Act and is therefore subject to the safety and efficacy requirements of the Act. If the Act is applicable, and the substance is not approved for interstate shipment, it is necessary to determine whether an individual has a fundamental constitutional right to obtain and use drugs of questionable efficacy for personal health care. If that right were recognized, it would become necessary for the government …

Sometime ago, the New York Times reported that Erwin Griswold -former Dean of the Harvard Law School, former President of the American Bar Foundation, former Solicitor General of the United States, and one of my own mentors and friends -was asked whether all private lawyers should donate some of their time and talents to serving the poor. "Should carpenters build houses free?" he responded. The question was obviously intended as rhetorical, but in view of Mr. Griswold's stature in the legal profession his analogy deserves serious consideration, and his views deserve a serious response.
