The Magellan penguin populations in the Patagonian province of Argentina were recently threatened by a proposed joint Japanese-Argentine venture to exploit them on a massive scale. The firm, Hinode Penguin Argentina, wished to begin slaughtering what it termed "excess" penguins, and to process the dead birds into skins for the world market; the carcasses were to be converted to a protein extract for local consumption.
Upon learning about this venture, Argentine conservation groups mobilized their forces quickly- formulating and implementing media campaigns, soliciting scientific opinions from local and worldwide experts, and concocting legal strategies. The legal tactics alone, although initially …

The United States Court of Appeals for the Third Circuit has held that disclosure of common ingredients and clinical substantiation of performance claims or disclosure that certain claims are open to substantial question in the medical community are reasonable requirements to counter the effects of extensive advertising found to violate the Federal Trade Commission Act.

Constitutional Challenges To Prison Overcrowding: The Scientific Evidence Of Harmful Effects, Terence P. Thornberry, Jack E. Call

In the past two decades American courts have decided numerous cases involving the constitutionality of prison and jail conditions. A number of prison cases have turned on the court's assessment of the constitutionality of narrow conditions, such as sanitation, fire safety, medical and mental health care, diet, exercise, or protection of inmates from assaults. This Article examines the harmful consequences of the more fundamental problem of prison overcrowding, working from the premise that consideration of the harmful effects of prison overcrowding and the constitutional implications of these effects is critical not just to inmates and courts, but also to prison …

A new wave of protectionism is upon us and its undertow, if not the wave itself, constitutes a serious threat to the Western alliance. This "neo-protectionism" differs from familiar past practices relying heavily on higher tariffs; it is more often charactierized by the use of more subtle ploys such as dumping, subsidization, and the erection of difficult marketing requirements for foreign traders.

How Empty Is The Idea Of Equality, Kent Greenawalt

The nature of equality and the relationship between equality and justice have long been puzzling to social and legal philosophers. One manifestation of these problems of understanding is uncertainty among lawyers and judges about the significance of legal norms formulated in the language of equality, most notably the equal protection clause of the Constitution. In an elaborately reasoned, imaginative, and richly referenced recent article, Peter Westen has urged the arresting conclusion that the idea of equality is empty, empty in the sense that any normative conclusion derived from the idea could be reached more directly by reliance on normative judgments …

It is self-interest and not justice that propels most people to act. If we intend to help the poor we will need to build coalitions with a range of others in society. When I came out of Mississippi, I thought that people were good if they were for everything I was for, and they were bad if they were not. I learned through the course of trying to protect Head Start that one could bring a whole range of groups together who had a self-interest in child care who would not speak to each other on welfare reform.
