Death With Dignity: Proposed Amendments To The California Natural Death Act, Lance L. Shea

Most laws passed by the state legislature affect our lives, but at least this one, the California Natural Death Act, affects our death. For the most part today, gone is the ability to take that last breath before death in a warm, quiet bed at home surrounded by loved ones; that scene has been replaced by hospital rooms or long-term care facilities in which tubes, wires and electronic equipment of medical wizardry help prolong lives with icy indifference. In an attempt to lend more humanity and dignity to the dying process, this Comment advocates that the California legislature amend the …

Other articles in this Symposium have chronicled the real-world triumphs of legal scholarship. I have sadder tales to tell. I would like to discuss law review articles that have had an apparent influence on the course of legal development, but not in the manner that the author intended.

Many of the readers of this Symposium may have their favorite examples of this phenomenon. Such misfortunes can befall anyone; both of the instances I will describe involve a highly respected constitutional scholar, Professor Henry Paul Monaghan of Columbia Law School. This Comment looks at the difficult issues surrounding living wills, and how courts or legislatures will treat cases where no living will exists. The Comment focuses on a series of New Jersey cases, and concludes with a suggested comprehensive statute which would cover loopholes left open by the current Illinois statutory scheme. The Comment is followed by two appendices which set out the text of the original Illinois Living Will Act and the 1988 changes to the Illinois Living Will Act.

The main purpose of this article is to sound a pair of themes about the ways in which these great changes in the nature of wealth have become associated with changes of perhaps comparable magnitude in the timing and in the character of family wealth transmission. My first theme, developed in Part II, concerns human capital. Whereas of old, wealth transmission from parents to children tended to center upon major items of patrimony such as the family farm or the family firm, today for the broad middle classes, wealth transmission centers on a radically different kind of asset: the investment …

Free movement of goods is a fundamental principle of the European Community. Article 36 of the EEC Treaty, however, provides important exceptions to the principle of free movement of goods as embodied in Article 30. Recently, the Court of Justice of the European Community ("Court of Justice" or "Court") has begun to develop a significant body of case law on the protection of human health exception of Article 36. The purpose of this essay is to demonstrate the pressing need of the law to take decisive action in imposing tort liability for willful and malicious conduct by drug addicted women during their pregnancy. Liability should be imposed notwithstanding the warnings from civil libertarians that the enforcement of such a policy would most assuredly give rise to "prenatal police patrols.'

Continuing medical advancement in the area of prenatal care' raises the question of when, if ever, the state may intervene in the life of a pregnant woman to protect her unborn child from abuse and neglect. This issue, though troublesome, can no longer be ignored. Since the Supreme Court's decision in Roe v. Wade, giving the pregnant woman the constitutional right to decide whether or not to terminate her pregnancy, there has been abundant controversy over the allowance of state intervention to protect the human fetus.
