Indirect Discrimination Under Title Vii: Expanding Male Standing To Sue For Injuries Received As A Result Of Employer Discrimination Against Females, N. Morrison Torrrey
Washington Law Review
Historically, both men and women have had the right to seek redress under Title VII of the Civil Rights Act of 1964 for injuries they have received as a result of sex discrimination. In recent years, the federal circuits have split on whether to give men standing in one particular category of such cases: employment discrimination cases where, although both men and women have been injured, the discrimination has been targeted only at women. The author analyzes the recent male standing cases in the context of basic standing principles and their past application to other types of Title VII plaintiffs. …

Setting Limits On Autonomy: Saving Money In An Aging Society, Robert L. Schwartz
Setting Limits On Autonomy: Saving Money In An Aging Society, Robert L. Schwartz
Faculty Scholarship
In Setting Limits Dr. Daniel Callahan poses a solution: the termination of some kinds of treatment for the very elderly. His solution undercuts autonomy of the individual. This Article describes the values served by autonomy and explains why autonomy is so basic to making health care decisions and why its importance is especially great in the United States. Of course, autonomy is not absolute. This Article will define those classes of cases in which autonomy can be trumped by other interests. The Article will next determine whether the class of cases defined by Dr. Callahan fits within that definition. Finally, …

The Legacy Of Griswold, Lackland H. Bloom Jr.
The Legacy Of Griswold, Lackland H. Bloom Jr.
Faculty Journal Articles and Book Chapters
The Griswold case, you cannot believe how much time we have spent on that nutty case, and how much mileage the opponents of Bork got out of it. This was the key. This must have been the one that kept them up late. This was the green eyeshade special here. The Griswold case. A goofy kind of thing.**
Now we go back to the general right of privacy, upon which Roe v. Wade is based coming out of Griswold, and you had two, one Justice Goldberg out of the ninth amendment and the other one from Justice Douglas, which is …
Saving Grace Or Saving Face: The Roman Catholic Church And Human Rights, John A. Onorato
Saving Grace Or Saving Face: The Roman Catholic Church And Human Rights, John A. Onorato
Penn State International Law Review (1982 - 2011)
The first part of this Comment examines the structure and organization of the Roman Catholic Church, the means of papal diplomacy, and the Vatican's participation in international organizations. Special attention is focused on the Code of Canon Law, the Lateran Agreements, and other important documents. The second part of this Comment examines the role the Church plays as a protector of human rights. This focuses on the Church's actions and recent history in two nations, Chile and Poland, and examines the effects of papal visits to these countries and the publication of papal encyclicals dealing with human rights.
Gatt And The Half-Life Of Uranium Industry Protection, James R. Wilch
Gatt And The Half-Life Of Uranium Industry Protection, James R. Wilch
Northwestern Journal of International Law & Business
The uranium market can never truly be "free," however. Because uranium has few metallurgical uses, and because there is a real danger of weapons-grade uranium falling into irresponsible hands, non-proliferation restraints and tight safety regulation are required on uranium trade. Nevertheless, this Comment will show that civilian uranium trade policy can be formulated to resolve the tension between GATT, and military security and nonproliferation interests.
Fetal Abuse: Culpable Behavior By Pregnant Women Or Parental Immunity, George P. Smith Ii
Fetal Abuse: Culpable Behavior By Pregnant Women Or Parental Immunity, George P. Smith Ii
Journal of Law and Health
The purpose of this essay is to demonstrate the pressing need of the law to take decisive action in imposing tort liability for willful and malicious conduct by drug addicted women during their pregnancy. Liability should be imposed notwithstanding the warnings from civil libertarians that the enforcement of such a policy would most assuredly give rise to "prenatal police patrols".
