Avoiding Farm Foreclosure Through Mediation Of Agricultural Loan Disputes: An Overview Of State And Federal Legislation, Donna L. Malter
Journal of Dispute Resolution
The use of credit played a major role in the growth of agricultural productivity in the United States.' In recent years, however, the financial distress faced by farmers resulted in a record number of farm foreclosures and bank closures in agricultural states. 2 Farm losses are concentrated in the mid-size farms, indicating that the owner-operated farm has been hit the hardest.3 The attendant social and economic turmoil faced by families and communities dependant on agriculture focused attention on the responsibility of federal and state government in preventing further losses within the families and communities that comprise the agricultural sector.

Cruzan And The Right To Die: A Perspective On Privacy Interests, Désirée E. Watson

On June 25, 1990, the United States Supreme Court decided that Nancy Beth Cruzan does not have a constitutional right to die. In Cruzan v. Director, Missouri Department of Health, a five-four majority held that a state may require clear and convincing evidence of a now-incompetent person's wishes when a guardian seeks to discontinue life support, including artificial nutrition and hydration, for a person diagnosed as being in a persistent vegetative state.

Dignified Death And The Law Of Torts, Willard H. Pedrick

These remarks were delivered on March 30, 1990 as the Nathanial Nathanson Memorial Lecture for 1990 at the University of San Diego School of Law. Professor Pedrick discusses and explains his thesis that familiar principles of tort law can be enlisted to better assure that unwanted life support measures either will not be used, or will be withdrawn when that is the wish of the patient or the patient's agent. He suggests that in nearly all states, health care givers are duty-bound under the common law of torts to follow instructions regarding use or nonuse of life support systems from …

Of Gametes And Guardians: The Impropriety Of Appointing Guardians Ad Litem For Fetuses And Embryos, Susan Goldberg
Washington Law Review
Recent advances in medical technology have caused some commentators and courts to perceive fetuses and embryos as separate entities, with rights independent of the women who carry them. Conduct of pregnant women that has been perceived to conflict with the interests of the fetuses they carry has been called into question. In some cases, courts have been forced to determine the juridical status of fetuses and embryos; in others, courts have appointed guardians ad litem to represent the "best interests" of these entities.
