When Self-Regulation, Market Forces, And Private Legal Actions Fail: Appropriate Government Regulation And Oversight Is Necessary To Ensure Minimum Standards Of Quality In Long-Term Health Care, Alexander D. Eremia

Annals of Health Law and Life Sciences

Mr. Eremia's paper discusses market forces, professional self-regulation, and private litigation individually and collectively as methods of maintaining and improving quality of care. He determines that whether separately or in conjunction, these three paradigms have not been successful agents in this regard. By analyzing the regulatory framework and oversight provided by the federal government in the long-term care industry, Mr. Eremia argues persuasively that despite its occasional inadequacies, regular and consistent oversight and regulation by the government is imperative in order to effect meaningful and systemic improvements in the provision of quality care.

As Secretary of Illinois' largest agency, the Department of Human Services, Secretary Baker provides a thorough overview of the role her agency plays in the ongoing health and welfare of the citizens of Illinois. Her contention that government should play a critical role in health care delivery is buttressed by the DHS' role as a funding agent, its contributions of staff and systems, and the direct role it plays in the pursuit of truly public health care. The Supreme Court of the United States held that Title III of the ADA protects access to professional golf tournaments by a qualified entrant with a disability, and that a disabled participant's use of a motorized golf cart during play would not fundamentally alter the nature of tournament play.

The genetic engineering of agriculture has spurred a lively worldwide discussion, and the technology has found both enthusiastic fans and formidable foes. Specifically, the United States has signed on as a proponent of the genetic modification of agriculture. In fact, the United States has become the largest producer of genetically modified organisms ("GMOs") and is consequently the leading exporter of genetically modified goods. On the other side of this debate lies the European Community ("EC"). This Article examines the right of doctors to object, because of conflicts with the doctor's own morals, to treatment requested or refused by patients. Focusing mainly on end-of-life care, the author compares court opinions allowing or prohibiting doctors to withhold or withdraw life-sustaining treatment at the request of patients or their surrogates.

In this stage (which will be discussed in Module 8 in more detail) the client has achieved abstinence for at least six months. As relapse of substance use and gambling disorders is common, one important goal is to help maintain an awareness that relapse is possible and to take steps to minimize the chan ces of relapse occurring. A second goal of this stage is to expand the client’s recovery to other areas of functioning such as social relationships and health. Comm on strategies include developi ng a relapse prevention plan, participating in self-help groups , and working on rehabilitation.

The co-occurring disorders treatment manual and its companion client workbook were created over a period of several months through the efforts of a working group comprised of substance abuse treatment practitioners and researchers affiliated with the Tampa PIC/Suncoast Practice and Research Collaborative project. The manual was field tested in several treatment agencies in the Tampa Bay area and was then refined through feedback received by practitioners and clients regarding the manual’s utility, ease of comprehension, and perceived relevance of the material to their needs.

Professor Fischer takes a comparative look at children's access to information and communications technologies (ICT) in six countries across five continents- the United States, the United Kingdom, France, Australia, Mongolia, and Tanzania. Children's levels of access to ICT is strongly linked to the "global development divide." The article explores the difference between access in highly developed countries and lesser developed countries. The article further explores the extent of the global developmental divide, including the potentially bleak future facing children born in less developed countries.
