The Model Of Principles, George C. Christie Aug 1968

The Model Of Principles, George C. Christie

Duke Law Journal

H. L. A. Hart's work has dominated much of current jurisprudential discussion. In a recent article evaluating Hart's conclusion that the law consists of sets of rules in the application of which judges often have a large measure of discretion, Professor Dworkin of Yale concluded that judges do not in fact possess any such discretion because the judicial application of legal rules is controlled by what he calls legal principles. The author takes exception with Dworkin's conclusions and attacks the analytical framework of rules and principles upon which it is based.

The Japanese Constitutional Style, John M. Maki Jun 1968

The Japanese Constitutional Style, John M. Maki

Washington Law Review

This examination of Japan's constitutional style is based on the manner in which the following factors have contributed to its development or have become elements of it: past constitutional history, the broad reaction against militarism and authoritarianism, basic constitutional principles, the renunciation of war, the electoral system, the structure of government, the relationship between the government and the people, education and the mass media, the intellectuals, changing social relations, popular controversy and the issue of revision. The conclusion will be that the 1947 Constitution has been firmly woven into the general institutional framework of Japanese society and will endure. Even …

The Public Welfare Standard And Freedom Of Expression In Japan, Lawrence W. Beer Jun 1968

The Public Welfare Standard And Freedom Of Expression In Japan, Lawrence W. Beer

Washington Law Review

This article analyzes the constitutional right of free expression, exercised by political demonstrations, in the political context of contemporary Japan, where consensus among political parties on the constitutional framework itself is lacking. The Japanese people possess an unusually strong sense of cultural unity, and strong emphasis is placed on harmony and consensus in social relations. On the other hand, the excesses and strident tone of many mass demonstrations strikingly illustrate the absence of consensus between groups and the pervasive tendency toward "groupism" which distinguish the Japanese from the American political setting. Although the sociopolitical tensions may have become great in …

A Rhetorical Analysis Of Political And Legal Speeches Of Robert B. Crosby, Gilbert Frank Nykodym Ii

Department of Communication Studies: Dissertations, Theses, and Student Research

I first saw Robert Crosby as a lawyer defending Duane Pope in November 1965. I was intensely interested in the Pope trial for a number of reasons. I was interested because, first, as a law student I found the legal points of interest, second, one of my law professors, Wallace Rudolph, was serving as an assistant defense counsel in the trial and, third, having a bachelors degree in speech I wanted to see what part speaking played in this trial.

As I began graduate work in speech I took a course entitled Rhetorical Criticism under Dr. Donald O. Olson. I …

Copyright Pre-Emption And Character Values: The Paladin Case As An Extension Of Sears And Compco, Michigan Law Review Mar 1968

Copyright Pre-Emption And Character Values: The Paladin Case As An Extension Of Sears And Compco, Michigan Law Review

Michigan Law Review

Much of the confusion over copyright pre-emption that has followed in the wake of Sears and Compco may be due to a fundamental difference between the present patent and copyright acts. Unlike the patent law that was at issue in Sears and Compco, the federal Copyright Act provides that the states may in limited circumstances protect literary property through the doctrine of common-law copyright. Under section 2 of the Act, a state may prevent copying of a work so long as it remains "unpublished." An alternative ground of decision in Paladin was that, regardless of preemption under Sears and …
