Labor Law--Nonemployee Union Organizers Granted Access To Company Property For Solicitation Purposes--Solo Cup Company And United Papermakers And Paperworkers, Afl-Cio, Michigan Law Review Jan 1969

Labor Law--Nonemployee Union Organizers Granted Access To Company Property For Solicitation Purposes--Solo Cup Company And United Papermakers And Paperworkers, Afl-Cio, Michigan Law Review

Michigan Law Review

The principal case emphasizes the general conflict between an employee's right of self-organization under section 7 of the NLRA and the employer's right, as a property owner, to control access to his plant premises. Face-to-face contact between employees and trained union organizers at the workplace would undoubtedly be the most effective way for the union to impart organizational information to the employees. But this assumption overlooks the legitimate interests of the employer; to permit organizational activities in all parts of the plant at any time would be unduly destructive of both plant production and discipline and could result in the …

The Warren Court: An Editorial Preface, Michigan Law Review Dec 1968

The Warren Court: An Editorial Preface, Michigan Law Review

Michigan Law Review

This Symposium is designed to offer a series of perspectives on the degree to which the Supreme Court, under the leadership of Earl Warren, has succeeded in adapting the principles of fundamental law to the social upheavals and economic developments of the last decade and a half.

The Warren Court And The Press, John P. Mackenzie Dec 1968

The Warren Court And The Press, John P. Mackenzie

Michigan Law Review

The conventional wisdom about the relationship between the ·warren Court and the news media runs something like this: With a few exceptions, the press corps is populated by persons with only a superficial understanding of the Court, its processes, and the values with which it deals. The Court has poured out pages of legal learning, but its reasoning has been largely ignored by a result-oriented news industry interested only in the superficial aspects of the Court's work. The Court can trace much of its "bad press," its "poor image," to the often sloppy and inaccurate work of news gatherers operating …

The Warren Court And The Political Process, William M. Beaney Dec 1968

The Warren Court And The Political Process, William M. Beaney

Michigan Law Review

Our complex political system creates endless opportunity to debate the proper roles and powers of each of our principal political institutions. Students of the Supreme Court who quarrel over the proper role of the Court sometimes forget that the powers of the President and the proper place of Congress have also been subject to fierce controversy throughout our history, and that the political tension between the national government and the states has provided a persistent theme from the beginning of the Republic. It must never be forgotten that the system provided by the Framers was not designed to produce efficient …

Antitrust Proscription And The Mass Media, Arthur D. Austin Dec 1968

Antitrust Proscription And The Mass Media, Arthur D. Austin

Duke Law Journal

The shift in the business world's primary concern from one of greater industrial expansion to the present race in consumer motivation and concomitant marketing processes has elevated mass media to new importance in antitrust analytics. The author contends that the Supreme Court is moving far too slowly in accomodating the mass-media phenomenon to conventional antitrust wisdom. After examining the impact of mass media in the economic setting, and the Court's halting response, the author urges that only a radical change in antitrust perspective can hope to account for this institutional force in future decisions.

Consumer Class Actions Under The Uniform Deceptive Trade Practices Act, Richard F. Dole Jr. Dec 1968

Consumer Class Actions Under The Uniform Deceptive Trade Practices Act, Richard F. Dole Jr.

Duke Law Journal

The Uniform Deceptive Trade Practices Act, presently in force in eight states, makes a private injunctive remedy available to "persons likely to be damaged" by misleading advertising, false disparagement, trade symbol infringement and other deceptive trade practices. This article explores the utility of the Uniform Act to individual consumers, and to groups of consumers. The procedural prerequisites of class actions under both the new and old versions of Rule 23 are considered in detail, and it is concluded that consumer class actions under the Uniform Act can provide an effective remedy for widespread and systematic consumer protection.

Antitrust And The Newspapers -- A Comment On S. 1312, John J. Flynn Dec 1968

Antitrust And The Newspapers -- A Comment On S. 1312, John J. Flynn

Vanderbilt Law Review

The American newspaper industry, often called "The Fourth Estate," apparently believes it has fallen on hard times. The aristocrats of the Fourth Estate, the daily newspapers, came to the Ninetieth Congress seeking a boon: relaxation of the rigors of antitrust policy as applied to mergers and joint agency operations by otherwise competing newspapers. A bill has been introduced, S. 1312, which is sponsored by fifteen Senators of diverse political and economic views, all save one having one thing in common-the presence of newspaper joint agency operations in their home states.' The very fact that Senators of such conflicting viewpoints could …

"Street Encounters" And The Constitution: Terry, Sibron, Peters, And Beyond, Wayne R. Lafave Nov 1968

"Street Encounters" And The Constitution: Terry, Sibron, Peters, And Beyond, Wayne R. Lafave

Michigan Law Review

In light of the surfeit of law review commentary on the subject of stop and frisk, a word about what follows is in order. This Article is not intended to be a restatement or summary of the recent debate on stop and frisk. Terry and its companions have put some of the issues to rest and pushed others to the forefront, and with the resulting change in the battle lines the time is ripe for a reassessment. The concern here is with the approach taken by the Supreme Court in Terry, Sibron, and Peters, and the emphasis is …
