Disparaging The Product - Are The Remedies Reliable?, Edward L. Graf Jan 1970

Disparaging The Product - Are The Remedies Reliable?, Edward L. Graf

Duquesne Law Review

"Disparagement" is defined by the Restatement of the Law of Torts as "matter which is intended by its publisher to be understood to cast doubt upon the existence or extent of another's property in land, chattels or intangible things, or upon their quality .. ." The act has been similarly designated as "Injurious Falsehood" and "Trade Libel." Simply stated, it is "knocking the competitor," an act as old as competitive business and one which takes on new significance in this age of effective and far-reaching communications.

Criminal Procedure - Right To Counsel - Indentification Evidence, Marcia I. Lappas

Duquesne Law Review

The Court of Appeals for the Third Circuit, by extending the rule of United States v. Wade, has held that an accused who is in custody has a right to counsel at pre-trial photographic identifications; that evidence of such out-of-court identifications conducted in the absence of the accused's counsel is not admissible at trial; and that the eyewitnesses in question are not competent to make in-court identifications.

United States v. Zeiler, 427 F.2d 1305 (3d Cir. 1970).

Over a period of more than five years, the Pittsburgh area was the victim of a series of bank robberies, all …

The Politics Of God In The Maturation Of The Law, M. S. B. Jan 1970

The Politics Of God In The Maturation Of The Law, M. S. B.

Georgia Law Review

This Note is a beginning exploration of the relationship of the law and God. It is predicated upon two assumptions: First, the law is what counsellors, advocates, judges and legislators do. Second, God is "beyond in the midst of our life;"  his doing is what is really happening. These assumptions preclude the possibility that either the law or God is brooding omnipresence. But they do open the way to discovery of the relationship of law as activity to the activity of God under the rubric of politics. After this Note has investigated the maturation of culture and law and described …

''Here Comes Da Judge", Ernest Van Den Haag Jan 1970

''Here Comes Da Judge", Ernest Van Den Haag

Georgia Law Review

Had it not been written by an Associate Justice of the Supreme Court, this book would not be reviewed: obviously calculated to pander to prurient political interest, it seems utterly without redeeming social value, although it does not violate current community standards, such as they are. However, the author's status makes the book news, just as a bishop's coming out for burlesque would be news: being a bishop is not, nor is favoring burlesque, but being a bishop favoring burlesque is. Points of Rebellion might be described as an apt, if unintended, caricature of the sentiments and ideas found in …

The "Rebellion" Of William 0. Douglas, Morris D. Forkosch Jan 1970

The "Rebellion" Of William 0. Douglas, Morris D. Forkosch

Georgia Law Review

THE major problem in reviewing another's thoughts is to minimize, since it cannot be eliminated, the interacting and modifying effect of one's own views and personal interpretations. This problem arises in all human relations, especially where words, not deeds, are in issue. According to Holmes, "[a] word is not a crystal, transparent and unchanged; it is the skin of a living thought and may vary greatly in color and content according to the circumstances and the time in which it is used." With this and other admonitions in mind,  it becomes clear that one who reads into Points of Rebellion …

Governmental Regulation Of The Drug Industry, J. Mark Hiebert Jan 1970

Governmental Regulation Of The Drug Industry, J. Mark Hiebert

Cleveland State Law Review

In today's world of increased government participation in business, certain industries are frequently spotlighted for particular attention. The communications industry is one, the drug industry is another. In both cases the special attention is fitting, for the communications industry, like the drug industry, each in its own way, reaches the very fiber of American life. Each has the inherent capability of changing our political and social order. At any rate two points are basic: first, the drug industry directly affects the foundations of our society and therefore is a reasonable concern of government. Secondly, the drug industry has a legitimate …

An Introduction To Riot Legislation, Jerold H. Israel

Book Chapters

My speech will provide an introduction to criminal code legislation specifically pertaining to riots and a brief description of our recent experience with riots. Hopefully, this description, supplemented by the film on the Detroit riot, will provide an appropriate factual background for both the remainder of my own talk and the analyses of proper police procedures during riots (and other civil disorders) to be presented by Major Brown and Professor Martin.

Souped Up Affirmative Disclosure Orders Of The Federal Trade Commission, William F. Lemke Jr. Jan 1970

Souped Up Affirmative Disclosure Orders Of The Federal Trade Commission, William F. Lemke Jr.

University of Michigan Journal of Law Reform

Under section 5(b) of the Federal Trade Commission Act the Commission is given authority to conduct hearings, make findings and issue cease and desist orders requiring any person, partnership or corporation to cease and desist from use of unfair methods of competition or unfair or deceptive practices in commerce. The Commission also issues consent orders in cases which are concluded by agreement between the Commission and the allegedly offending party. Consent orders have the same force and binding effect as those issued after hearings and findings. Although it is well established that the Commission has very broad discretion and authority …
