Federal Aid Highway Routing Procedures: A Voice For All Parties, Michael F. Williams
University of Michigan Journal of Law Reform
This article examines the legal barriers which have been confronted in the courts by those challenging administratively determined highway routes and, in so doing, it traces these legal barriers to their sources within the routing structure itself. Against this backdrop, the article analyzes the Policy and Procedure Memorandum, indicating some of the problems which it will resolve and offering suggestions for those it will not resolve.

Monopoly Newspapers: Troubles In Paradise, William C. Pate, Alan M. Winterhalter
San Diego Law Review
This note does not attempt to resolve the myriad constitutional, economic and social issues involved in the task of insuring a free press. It will, however, illuminate the main constitutional and economic problems involved in this process and demonstrate that the government has the power to formulate a substitute for the checks that were once provided by the competitive economic system. It the citizen’s right to a free press is to be more than just an historical oddity, the government must begin regulation of the newspaper industry to insure that no powerful interests have the power to suppress the free …

An Evaluation Of Changes In The Medical Standard Of Care, John K. Johnson, Jr.
An Evaluation Of Changes In The Medical Standard Of Care, John K. Johnson, Jr.
Vanderbilt Law Review
When a layman is charged with negligence, his conduct is compared with the conduct to be expected from that familiar fictional person-the reasonable and prudent man under the same or similar circumstances.' The defendant's special knowledge or skill is only one of the circumstances to be considered; another is the customary practice of those similarly situated. In the field of medical negligence, however, the conduct of other physicians becomes extremely important. The standard of care to which doctors will be held is determined to a large extent by fellow practitioners.

Frederick Spiegel reviews Paul C. Reardon and Clifton Daniel’s 1968 report: Fair Trial and Free Press. Fair Trial and Free Press is a report on one in a series of National Debate Seminars sponsored by the American Enterprise Institute held at George Washington University, Washington, D. C. and the first in the series to be nationally televised. The debate dealt with the conflict of the two fundamental rights and centered around the controversial Reardon Report adopted at the ABA's House of Delegates in February, 1968. The participants in the debate were Justice Paul C. Reardon of the Supreme Judicial Court …
Federal Courts--Proposed Aircraft Crash Litigation Legislation, Kenneth W. Johnson
Federal Courts--Proposed Aircraft Crash Litigation Legislation, Kenneth W. Johnson
Missouri Law Review
The legal consequences of an air crash are infinitely more complex than other transportation disasters, and the litigation almost always presents special problems. A single crash often gives rise to multiple claims filed in diverse federal districts, each of which has proper jurisdiction and venue. Since liability may vary in accordance with the particular state law under which the case is tried, such duplication is arguably a necessary price for a federal system of law. State law, which ordinarily controls the resolution of substantive issues, may vary as to the use of certain defenses, the burden of proof, the availability …

A Model Bill On The Reporting Of Campaign Contributions And Expenditures, William H. Rodgers, Jr.
A Model Bill On The Reporting Of Campaign Contributions And Expenditures, William H. Rodgers, Jr.
Articles
Public demand for strict and effective accountability of public officials engaged in political election campaigns has increased dramatically in recent times. Development of concrete measures to implement the objective, however, has been less quick to materialize. In this article, Professor Rodgers proposes model state legislation to require reporting of campaign contributions and expenditures by most political candidates and committees. The controlling principle of the proposed legislation is total disclosure of all aspects of political campaign financing. The Model Bill contains an effective procedure for administration and enforcement of its provisions.

A Study Of Juvenile Waiver, A. Bruce Ferguson, Alan Charles Douglas
San Diego Law Review
In a footnote to its recent decision, In re Dennis M, the California Supreme Court recommended, that "juvenile officers and police be prepared to give their compulsory Miranda warning in terms that reflect the language and experience of today’s juveniles." This language stimulated our attempt to draft and test the efficacy of a simplified Miranda warning, potentially more understandable to juveniles, and consistent with juvenile law requirements. The purpose of this article is to relate the findings of an empirical study which sought to answer two questions: 1) should the Miranda warning be revised for the juvenile offender; and 2) …
