Efts: Consumer Protection Under The Ucc, Susan E. Jinnett
University of Michigan Journal of Law Reform
In view of the economic significance of the payments system, the laws governing it must be equitable and comprehensive. The development of the commercial law applicable to EFTS's, however, currently lags behind the growth of these systems. Threats to the integrity of EFTS's stem from lost, stolen, or forged access cards, illegal taps into communication lines, physical impairment of the equipment, or improper programming. The legal rights and liabilities of consumers where the integrity of an EFTS has been breached remains unclear, in part because the status of EFTS's under current law is uncertain. The rights of the parties involved …

Government Regulation Of Health-Care Drugs Of Questionable Efficacy, Robert J. Milis
Government Regulation Of Health-Care Drugs Of Questionable Efficacy, Robert J. Milis
San Diego Law Review
Rutherford and similar cases present several interesting questions. The threshold inquiry in the federal court cases is whether a substance like laetrile falls within the scope of certain sections of the Food, Drug, and Cosmetic Act and is therefore subject to the safety and efficacy requirements of the Act. If the Act is applicable, and the substance is not approved for interstate shipment, it is necessary to determine whether an individual has a fundamental constitutional right to obtain and use drugs of questionable efficacy for personal health care. If that right were recognized, it would become necessary for the government …

Speech In The Local Marketplace: Implications Of Virginia State Board Of Pharmacy V. Virginia Citizens Consumer Council, Inc. For Local Regulatory Power, Lawrence Alexander
San Diego Law Review
On May 24, 1976, the Supreme Court decided the case of Virginia State Board of Pharmacy v. Virginia Citizens Consumer Council, Inc., holding that the first and fourteenth amendments were violated by statutory bans on advertising prescription drug prices. In so doing the Court apparently eliminated the commercial speech exception to the first amendment protection which had its origin thirty-four years ago in Valentine v. Chrestensen. I say "apparently," because Virginia State Board left unclear its implications for most of the issues to which the commercial speech doctrine had been applied. This Article will deal primarily with those uncertain implications, …

Antitrust Consequences Of United States Corporate Payments To Foreign Officials, James F. Rill, Richard L. Frank
Vanderbilt Law Review
This Article examines the feasibility and desirability of marshalling section 2(c)' of the Clayton Act as amended by the Robinson-Patman Act and sections 1 and 2 of the Sherman Act against a practice having deep legal, political, and emotional significance in the United States and overseas. Difficult questions of jurisdiction and coverage are presented, as are major issues of public policy on what the role, if any, should be for these provisions.

This is an appeal from a judgment for the Respondents, the Plaintiffs in the lower court, in a civil action for defamation, based on an article published in the Defendant newspaper. During a period of national recession, the Plaintiff company, a public government corporation, purchased an expensive luxurious car for the use of its Director General, the second Plaintiff-Respondent, who was close to retirement. After considerable public criticism of the purchase, the Plaintiffs announced that the Director General would continue to use the old car he had previously used and that they would put the new car up for sale. …
