The Disposition Process Under The Juveniles Justice Standards Project, Stanley Z. Fisher
The Disposition Process Under The Juveniles Justice Standards Project, Stanley Z. Fisher
Faculty Scholarship
The Juvenile Justice Standards Project volumes were publicly discussed for months prior to their publication. Unavoidably, much of the discussion was based upon rumor regarding their contents. In that context, critics charged that the proposed Standards would "destroy the nation's juvenile court system and replace it with a 'junior criminal system' "1 and claimed that the Standards substitute the philosophy of "just deserts" for the traditional rehabilitative goals of juvenile justice.' The news media described the Standards on disposition of delinquents as designed to "fit the penalty to the crime, no matter what the age of the perpetrator. '3 I …

Virginia State Board of Pharmacy v. Citizens Consumer Council, Inc., 425 U.S. 748 (1976).
The first amendment of the Constitution provides that "Congress shall make no law … abridging the freedom of speech ... . This restriction on legislative power applies to the state legislature as well as the United States Congress due to the adoption of the fourteenth amendment and subsequent decisions of the Supreme Court of the United States interpreting the first and fourteenth amendments. Nevertheless, the Supreme Court, as the final interpreter of the Constitution, has been unwilling to give the force of law to the plain …

Young v. American Mini Theaters, Inc., 427 U.S. 50 (1976).
The plight of large metropolitan urban areas is the focus of much concern in the United States. Recently, the migration to the cities has reversed, and industry and commercial interests have abandoned metropolitan cores. Consequently, urban areas are suffering from neglect, epitomized by loss of an adequate tax base. Sociologists and urban planners have recognized that a major factor contributing to urban blight is the de facto concentration of socalled "adult" establishments in the inner city. Skid rows visibly evolve as commercial residents vacate the older areas of a city, …

Carter's Projected "Zero-Based" Review Of The Internal Revenue Code: Is Our Tax Code To Be "Born Again"?, L. Hart Wright
Michigan Law Review
The evolution of today's Internal Revenue Code, which began with the mere embryo that Congress created in 1913, has absorbed over the ensuing sixty-four years more creative energy on the part of more co-authors than any other law in history. Despite this unstinted expenditure of "blood, sweat, and tears," the resulting document--were it possessed of human senses--would recognize that, for a foreseeable period, its life will be anything but serene. The plight in which it would find itself could even be compared to that early morning scene observed one hundred years ago by General Custer, when hostile forces were massed …

Punitive Conditions Of Prison Confinement: An Analysis Of Pugh V. Locke And Federal Court Supervision Of State Penal Administration Under The Eighth Amendment, Ira Robbins
Scholarly Articles in Law Reviews & Journals
The 1960's marked a watershed for the criminal justice system. In such areas as search and seizure, right to counsel and the privilege against self-incrimination, the federal courts first defined substantive constitutional rights and then imposed them upon disinclined functionaries at the state level. At first, these innovations raised thorny questions of constitutional interpretation about the rights involved, but, as is especially visible in the search and seizure area, the debate more recently has focused on the remedy chosen by the Supreme Court for enforcing these rights against the states.' This pattern of escalating federal involvement in the criminal justice …
