The Arab Economic Boycott Of Israel: The International Law Perspective, Preston L. Greene, Jr.
The Arab Economic Boycott Of Israel: The International Law Perspective, Preston L. Greene, Jr.
Vanderbilt Journal of Transnational Law
Most of the discussion about the Arab economic boycott of Israel has focused on its effect upon United States law. Even when the discussion centers on moral and ethical considerations, the focus remains on the United States. This limited perspective, however, merely reflects the vast global economic interests of the United States. Nonetheless, the extensive analysis of American law and practices has tended to obscure the importance of applicable international norms. This article examines the effects and implications of the Arab boycott upon existing and evolving norms of contemporary international law. To properly analyze the international legal norms, the operative …

Economic Competition And The Supreme Court: Decisions In The 1977 Term, Jeff Miles, John Russell
University of Richmond Law Review
Through the years, the Supreme Court has emphasized numerous times that "[t]he heart of our national economic policy long has been faith in the value of competition." Indeed, this principle was reiterated last Term. Crucial to economic competition are the anti-trust laws, especially the Sherman Act.

Professor McGee reviews THE ANTITRUST PARADOX: A POLICY AT WAR WITH ITSELF, by Robert H. Bork. Professor McGee argues that it would be easy to balance the allocative efficiency and the productive efficiency effects of various transactions if we could generate information for the economic models as easily as it is done in the model of perfect competition-simply by assuming it. Since information is costly in the real world, however, we must develop proxies or general rules, formed with the guidance of economic analysis, that seem likely to produce more good than harm as the law is applied to various …
The Development Of The Federal Law Of Gambling, G. Robert Blakey, Harold A. Kurland
The Development Of The Federal Law Of Gambling, G. Robert Blakey, Harold A. Kurland
Journal Articles
The Commission on the Review of the National Policy Toward Gambling, believing that the States should have the primary responsibility for determining what forms of gambling may legally take place within their borders, recently suggested that the federal government should prevent interference by one State with the gambling policies of another, and should act to protect identifiable national interests.
Although this broad recommendation reinforces the role the federal government has traditionally played in regulating gambling, the Commission also proposed specific amendments to the cur- rent federal gambling laws. Should Congress act upon the Commission's report or otherwise attempt a comprehensive …

Changing The Public Drunkenness Laws: The Impact Of Decriminalization, David Aaronson
Changing The Public Drunkenness Laws: The Impact Of Decriminalization, David Aaronson
Scholarly Articles in Law Reviews & Journals
Laws that decriminalize public drunkenness continue to use the police as the major intake agent for public inebriates under the "new" public health model of detoxification and treatment. Assuming that decriminalization introduces many disincentives to police intervention using legally sanctioned procedures, we hypothesize that it will be fol- lowed by a statistically significant decline in the number of public inebriates formally handled by the police in the manner designated by the "law in the books." Using an "interrupted time-series quasi- experiment" based on a "stratified multiple-group single-I design," we confirm this hypothesis for Washington, D.C., and Minneapolis, Minnesota. However, through …

Water That Is Not Water, A. Dan Tarlock, Owen Olpin
Articles by Maurer Faculty
The increased interest in the development of geothermal resources has given rise to the need for the formulation of a legal framework in which this development can be carried out. In this article, Mr. Olpin and Professor Tarlock analyze the proper relationship between western water law and geothermal resources development. They present an argument against the blanket application of western water law and propose a means of accommodating geothermal resources development with the protection of conventional water users.
Judicial Overload: The Reasons And The Remedies , Maria Marcus
Judicial Overload: The Reasons And The Remedies , Maria Marcus
Faculty Scholarship
Animosity towards lawyers, perennial in our social history long before Watergate, parallels a contradictory and equally persistent belief in judges as problem-solvers for a variety of personal, economic, educational and political ills. An increasing number of litigants are bringing to the courts not only the class of disputes that has been the traditional fare of judicial decision-making, but also an array of issues that were formerly resolved in private meetings, at hospitals, in schools, or at home. The causes of this explosion of lawsuits and the possible buffers to an eventual implosion in our judicial system will be discussed below

Legal Implications Of Population Control: A Practical Reevaluation Of Some Human Rights Considerations, Susan C. Eisenhauer
Legal Implications Of Population Control: A Practical Reevaluation Of Some Human Rights Considerations, Susan C. Eisenhauer
Fordham International Law Journal
In recent years, much attention has been devoted to the problems of overpopulation and attempts at slowing population growth. The number of people is expanding at an alarming rate, thereby threatening the physical environment as well as the quality of human life. The United Nations has not adequately dealt with the population problems. This paper outlines the existing problem and its ramifications, and discussses the UN position regarding human rights in the area of family planning. Questions are raised, as to what the rights consist of, if they are absolute, and if protection of the quality of life should limit …
