Unleashing Cable T.V., Leashing The Fcc: Constitutional Limitations On Government Regulation Of Pay Television, Jo Ann Becker
Unleashing Cable T.V., Leashing The Fcc: Constitutional Limitations On Government Regulation Of Pay Television, Jo Ann Becker
Fordham Urban Law Journal
Article examines the Federal Communications Commission’s 1975 decision to prohibit cablecasters from showing certain types of programming, on the rationale that pay cablevision, through successful competitive bidding, would ‘siphon’ this programming away from broadcast television and deprive the general public of popular programming. Article discusses the history behind the decision, the court of appeals’ treatment of the FCC rules and the decision’s possible effect on future pay cable regulations

I.R.C. Section 119: Is Convenience Of The Employer A Valid Concept, Adrian A. Kragen, Klonda Speer
UC Law Journal
Present interpretations of the Convenience of the Employer Rule, Section 119 of the Internal Revenue Code, allows a special privilege tax advantage to some employees while denying an exclusion from income to others similarly situated. The authors urge elimination of Section 119 from the Code or, in the alternative, adoption of a new test designed to eliminate the current inequities.
Demanding Human Rights: A Change In The World Legal Order, Eric Lane
Demanding Human Rights: A Change In The World Legal Order, Eric Lane
Hofstra Law Review
President Carter's recognition of universal standards of human rights, and his formulation of a foreign policy at least partially based on such recognition, has been the object of both foreign and domestic criticism, which at first glance'appears inexplicably severe. In the context of the present world legal order, however, the administration's expressed intention to pursue a policy directed toward a worldwide guarantee of human rights represents a potentially radical departure from the legal tenets which have governed world political interaction for the last 300 years.

If We Don't Take Care Of Young Lawyers, Who Will?, Gary A. Munneke
If We Don't Take Care Of Young Lawyers, Who Will?, Gary A. Munneke
Elisabeth Haub School of Law Faculty Publications
There are now more than 450,000 lawyers in this country, almost double the number of 20 years ago. The American Association of Law Schools estimates that the number of law student graduates averages about 34,000 a year. And the Bureau of Labor Statistics of the Department of Labor projects that there will be 26,400 new legal jobs each year until 1985. If law school enrollments stay at their current level, that would mean about 8,000 graduates each year would not be able to find a law-related job.

Ohio Rule 8(C) And Related Rules: Some Notes On The Pleading Of Affirmative Defenses, J. Patrick Browne
Cleveland State Law Review
The adoption of the Ohio Rules of Civil Procedure on July 1, 1970, ushered in the age of "Pleader's Lib" for the plaintiff's attorney. In code days, a pleader had to allege facts which showed a cause of action. Under the rules, however, a statement of claim' need only state the bare operative facts which show that the claimant has a claim for relief, and the complaint cannot be dismissed for failure to state such a claim unless it appears beyond doubt from the face of the pleading that the claimant can prove no set of facts entitling him or …

In 1978, the Carter Administration, in its efforts to normalize diplomatic relations with the People’s Republic of China, was faced with a dilemma. The PRC demanded that the U.S. agree to three terms for normalization: 1) break diplomatic ties with the Republic of China (Taiwan); 2) abrogate the 1954 security treaty with Taiwan; and 3) withdraw military forces from the island. Although public opinion and expert opinion both favored normalization with the PRC, but also both favored – by larger margins – the continued support of Taiwan. This article looks at the status of public opinion at the time, and …
The Impact Of Pacifica Foundation On Two Traditions Of Freedom Of Expression, Stephen W. Gard, Jeffrey Endress
The Impact Of Pacifica Foundation On Two Traditions Of Freedom Of Expression, Stephen W. Gard, Jeffrey Endress
Cleveland State Law Review
The United States Supreme Court, in FCC v. Pacifica Foundation, had a magnificent opportunity to either begin the process of defining first amendment limitations on the scope of the authority of the FCC to regulate the content of broadcast expression, explicate a rational ground for the differential status of broadcasting, or perhaps both. The purpose of this article is not to debate the wisdom of the use of sensitive language on the electronic media or elsewhere. Nor is it our purpose to debate the substantive question of whether the Court reached the proper result in Pacifica, although we will necessarily …

Fairness And Unfairness In Television Product Advertising, Michigan Law Review
Michigan Law Review
The first section of this Note explores the impact of television product advertising on viewer attitudes. The next two sections set forth the statutory basis on which the Federal Communications Commission and the Federal Trade Commission could provide for the effective presentation of contrasting points of view on controversial issues implicitly or explicitly raised by television product advertising, could ensure that the implicit messages of such advertisements are delivered fairly and without deception, and could counter the adverse effects of such advertising. The purpose of these sections is not to predict actual regulatory behavior, for in fact the FCC and …
