Lawyering In The Age Of Artificial Intelligence, Jonathan H. Choi, Amy B. Monahan, Daniel Schwarcz

Minnesota Law Review Vols. 106:2 onward (2021-present)

We conducted the first randomized controlled trial to study the effect of AI assistance on human legal analysis. We randomly assigned law school students to complete realistic legal tasks either with or without the assistance of GPT-4, tracking how long the students took on each task and blind-grading the results.

We found that access to GPT-4 only slightly and inconsistently improved the quality of participants’ legal analysis but induced large and consistent increases in speed. AI assistance improved the quality of output unevenly—where it was useful at all, the lowest-skilled participants saw the largest improvements. On the other hand, AI …

Reconstruction, And The Unfulfilled Promise Of Antitrust, Bennett Capers Nov 2024

Reconstruction, And The Unfulfilled Promise Of Antitrust, Bennett Capers

Minnesota Law Review Vols. 106:2 onward (2021-present)

Wealth inequality remains as wide, and as troubling, as it was a half-century ago. While scholars have offered various explanations, there is a contributor that has escaped serious scrutiny: state monopoly power. It is not just that there is a long history of states and municipalities using their monopoly power to protect dominant interests, from enacting Black Codes to shuttering Chinese laundries to barring women, immigrants, and minorities from certain professions. It is also that states continue to use their monopoly power in ways that entrench inequality, from zoning restrictions to eminent domain to regulations that, in effect, bar Black …

From Biased Data Inputs To Your Discriminatory Diagnosis Outputs: A Review Of Legal Liability For Artificial Intelligence In Healthcare, Amber Bolden

Michigan Technology Law Review

While health disparities in America occur due to non-medical circumstances, certain protected classes experience healthcare disparities due to the biases of medical professionals. Biased diagnoses, both intentional or unintentional, have existed throughout the history of the medical profession. That those biases are becoming data for training algorithms raises concerns as the medical field increasingly incorporates and standardizes artificial and augmented intelligence in patient diagnosis and treatment. Currently unregulated but with lifedetermining potential, artificial intelligence (AI) when used in patient treatment leads to important questions: should the doctor, the provider, or the AI developers be liable, and for what? Section II …

Failing To See What's In Front Of Our Eyes: The Effect Of Cognitive Errors On Corporate Scandals, Nancy B. Rapoport

William & Mary Business Law Review

Why do we believe flim-flam artists so readily, especially in the business and commercial realm? This Article explores four reallife versions of “The Emperor’s New Clothes” fable—FTX, WeWork, Theranos, and a former bankruptcy judge’s hidden romance— and asks why people bought into the hype. Where were the warning signs, and how might we better spot those signs in the future?

Formalizing Fairness: Statistical Measures Of Parity For Recidivism Prediction Instruments, Joshua Song Nov 2024

Formalizing Fairness: Statistical Measures Of Parity For Recidivism Prediction Instruments, Joshua Song

Michigan Technology Law Review

Recidivism prediction instruments (RPI) are increasingly employed as an algorithmic arm of the criminal justice system to assist in bond, sentencing, and probation determinations. Due process and ethics guidelines require that RPIs, such as the Correctional Offender Management Profiling for Alternative Sanctions (COMPAS), apply a fair assessment in making recidivism predictions. To establish fair RPIs, we must first define standards of fairness and methods to measure bias in RPI outputs. However, defining algorithmic fairness can be cryptic and context-dependent. Scholars have proposed different criteria for what defines a fair RPI. Unfortunately, these criteria are conflicting and mutually exclusive; it is …

Ideal Enforcement: How Do We Achieve Optimal Enforcement Of Traffic Law As Ubiquitous Enforcement Becomes Technologically Conceivable?, Bryant Walker Smith, Jeffrey Michael, Johnathon Ehsani

Michigan Technology Law Review

Safety. Mobility. Technology. Data. Equity. Autonomy. Community. Justice. Power. Trust. These themes have resonated over the last few years across a wide range of specific issues—some that are new and others that have only recently received the broader attention that they demand. A coming age of “perfect enforcement,” in which both public and private actors use increasingly powerful, pervasive, and affordable technologies to automatically identify and penalize every deviation from public or private rules, captures all these issues: They meet—in the language of physics, they interfere, whether constructively or destructively—to affect both perception and reality. The potential role of technology …

Cran V. Mtc Ltd And Others (Sa 822022) 2024 Nasc 6 (13 March 2024), Dunia P. Zongwe

SAIPAR Case Review

This piece focuses on the Namibian Supreme Court's decision concerning the Communications Regulatory Authority of Namibia's (CRAN) discretionary powers to levy regulatory fees. The judgment upholds the constitutionality of the amended Section 23 of the Communications Act of Namibia, which provides guidelines for setting these fees. The commentary commends the Court's sophisticated understanding of regulatory governance, balancing legislative oversight with administrative expertise. However, it also points out inefficiencies in the current fee-setting mechanism, particularly the lack of collaborative input from stakeholders and the risk for potential regulatory costs being pased on to consumers in an already oligopolistic market. Legislative reforms …

The Danger Of Silence: The Negative Effect Of Supreme Court Hesitance To Establish A Bright-Line Rule For Determining Patent Subject Matter Eligibility, Amber N. Roibu Nov 2024

The Danger Of Silence: The Negative Effect Of Supreme Court Hesitance To Establish A Bright-Line Rule For Determining Patent Subject Matter Eligibility, Amber N. Roibu

Touro Law Review

Ambiguity surrounding the interpretation of 35 U.S.C. § 101 and the ultimate application of the Alice/Mayo standard for determining patent subject matter eligibility has long plagued the courts, practitioners, and USPTO examiners alike. Maintaining a standard that leads to sheer confusion and, as a result, inconsistent rulings severely muddles the ultimate goal of patent law, to promote innovation. The Supreme Court has been presented with ample opportunities to address these issues, with the Solicitor General consistently recommending that it hear cases that deal with patent-eligibility debates. Nonetheless, the Supreme Court's continued hesitancy to grant certiorari on these cases only further …

Insurrection-Proofing The Courts: Judicial Tools To Protect The Legal System From Litigation Abuse In The Wake Of The 2024 Election, Raymond H. Brescia Nov 2024

Insurrection-Proofing The Courts: Judicial Tools To Protect The Legal System From Litigation Abuse In The Wake Of The 2024 Election, Raymond H. Brescia

SMU Law Review Forum

In the wake of the 2020 presidential election in the United States, lawyers sought to overturn the results of that election filing baseless and far-fetched claims. Courts sanctioned many of those lawyers and at least some of them have been disbarred or are in the last throes of disbarment proceedings. Yet such punishment has come nearly four years after the events that precipitated the need for such professional discipline. Are there things courts can do now, on the immediate eve of the next presidential contest, to “insurrection-proof” their courtrooms to make sure that the legal system is not used, once …

Addressing Governance Challenges Of Digitalisation And Sustainability: The Case Of Central Bank Digital Currency, Heng Wang Nov 2024

Addressing Governance Challenges Of Digitalisation And Sustainability: The Case Of Central Bank Digital Currency, Heng Wang

Research Collection Yong Pung How School Of Law

Digitalisation and environmental sustainability are widely discussed topics. However, their nexus remains underexplored and can pose significant challenges for governments and industries alike. The environmental implications of digitalisation are becoming increasingly pertinent with the advent of central bank digital currencies (CBDCs) and their inherent energy consumption and production of e-waste. On the other hand, digitalisation could potentially support sustainability efforts. This begs the question of how systems of governance, such as regulatory frameworks and internal organisational governance, should harmonise digitalisation and sustainability goals. Such harmonisation entails ensuring that digitalisation processes are environmentally responsible while exploring how the application and features …

Bridging Gaps. The Role Of School Leaders In Implementing The Mckinney-Vento Act For Homeless Student Success, Brian Jones

Electronic Theses and Dissertations

This qualitative narrative inquiry explores the role of school leaders in implementing the McKinney-Vento Homeless Assistance Act (MKVA) within a public school district in West Texas. The study addresses the challenges school leaders face in supporting homeless students and the strategies they employ to ensure academic success and socio-emotional well-being. Drawing on Bronfenbrenner’s ecological systems theory and Bertalanffy’s general systems theory, the research examines how school leaders' personal understandings and professional experiences influence MKVA provisions' implementation. The study employs semistructured interviews and reflective journals to gather participant data, followed by a member-checking process to enhance the accuracy and credibility of …

Traces And Criminal Trasology In Fighting Crime, Nuredin Lutfiu Oct 2024

Traces And Criminal Trasology In Fighting Crime, Nuredin Lutfiu

UBT International Conference

Criminalistic traceology is not only a part of criminalistic technique, but it is also incorporated in tactics and methods. For example, tactical, cognitive, evidential and processing problems of traceology are not the object of the study of criminalistic technique. It means the word is about the multidimensional approach to an issue. Traceology deals with the problems of the mechanisms of representation, classification, search, retrieval, fixation, preservation, search and evaluation of traces. Traceology enables the solution of identification and diagnostic tasks. Traceology is divided into the procedure of searching for traces, providing traces, fixing traces and using them for discovery and …

Algorithmic Reason-Giving, Arbitrary And Capricious Review, And The Need For A Clear Normative Baseline, Cameron Averill Oct 2024

Algorithmic Reason-Giving, Arbitrary And Capricious Review, And The Need For A Clear Normative Baseline, Cameron Averill

University of Cincinnati Law Review

Federal agencies have caught the artificial intelligence (AI) bug. A December 2023 report by the Government Accountability Office found that twenty of twenty-three federal agencies surveyed reported using some form of AI, with about two hundred current use cases for algorithms and about one thousand more in the planning phase. These agencies are using algorithms in all aspects of administration, including rulemaking, adjudication, and enforcement. The risks of AI are well-documented. Previous work has shown that algorithms can be, among other things, biased and prone to error. However, perhaps no problem poses a more serious threat to the use of …

Rural Renting: An Empirical Portrait Of Eviction, Cassie Chambers Armstrong, Christopher J. Ryan Jr. Oct 2024

Rural Renting: An Empirical Portrait Of Eviction, Cassie Chambers Armstrong, Christopher J. Ryan Jr.

University of Cincinnati Law Review

In this Study, we examine eviction from the renter’s perspective. Specifically, we seek to understand what factors influence the eviction process—and the likelihood it will result in a judgment against a renter—once a property owner initiates legal proceedings. To this end, we used records from 202,572 eviction cases filed by landlords in Kentucky state courts. We employed statistical modeling to determine what impacted whether each case ultimately ended in a judgment of eviction against the renter.

Many of our findings were novel, and they were staggering. We found that, holding all else equal, those living in rural areas were at …

Disparity And The Need For Sentencing Guidelines In Maine: A Proposal For Enhanced Appellate Review, Daniel E. Wathen Oct 2024

Disparity And The Need For Sentencing Guidelines In Maine: A Proposal For Enhanced Appellate Review, Daniel E. Wathen

Maine Law Review

Perhaps in no other field of judicial endeavor is diversity and variety more apparent than when a sentencing judge considers the circumstances presented by a defendant convicted of a criminal offense. In each case, the sentencing judge confronts an individual who has no exact counterpart in any defendant previously appearing before the court for sentencing. The sentence imposed is primarily a matter of judicial discretion and is based upon consideration of the nature of the offense, the circumstances surrounding the commission of the offense, and the circumstances of the defendant. The sentencing judge formulates a specific sentence within broad statutory …

"Arbitrary And Fortuitous"? The Revival Of Territorialism In American Choice Of Law, Lea Brilmayer, Fred Halbhuber Oct 2024

"Arbitrary And Fortuitous"? The Revival Of Territorialism In American Choice Of Law, Lea Brilmayer, Fred Halbhuber

San Diego Law Review

When the conflict of laws revolution swept away the First Restatement in the mid-twentieth century, it took with it many of the ideas associated with traditional choice of law theory. Territorialism was one such collateral casualty. The close association between territorialism and the disgraced First Restatement methodology made it an obvious target. However, the real problem was not territorialism but rather the First Restatement’s system of “vested rights,” its endorsement of a “general common law,” and its system of inflexible rules.

A more successful challenge to territorialism was the claim that territorialism produces “arbitrary and fortuitous” results. This assertion has …
