General Statement:

The Law School was established as a part of Richmond College in 1870. In 1890 the family of the late Mr. T. C. Williams, who had been a devoted and useful trustee, donated $25,000 as the nucleus of an endowment for the Law School. In recognition of this gift, the name of the School was changed to The T. C. Damages-Pain And Suffering-Use Of A Mathematical Formula, Thomas D. Heekin S .Ed. Mar 1962

Damages-Pain And Suffering-Use Of A Mathematical Formula, Thomas D. Heekin S .Ed.

Michigan Law Review

Measurement of damages for pain and suffering is, in a sense, an attempt to measure the unmeasurable; yet as long as our law recognizes a right to recover for pain and suffering, the jury or judge must arrive at some concrete figure. The traditional approach of simply instructing the jury that they should arrive at a reasonable amount provides little, if any, guidance. The question is whether this approach, nevertheless, remains the best of a bad lot of alternatives. If more guidance is desirable, what can be accomplished within the framework of our present system? The mathematical formula discussed in …

The Antidumping Act: Its Administration And Place In American Trade Policy, James A. Kohn Feb 1962

The Antidumping Act: Its Administration And Place In American Trade Policy, James A. Kohn

Michigan Law Review

It has now been forty years since the present Antidumping Act was passed. During that period certain administrative interpretations and procedures have developed. This discussion will not attempt a general exposition of the act, but rather will examine key terms which are not defined by the act itself, the administrative decisions interpreting these terms, and the soundness of these decisions when tested against the purposes of the act. In analyzing these decisions, not only the factors that influenced the original passage of the act must be considered, but also the events which have occurred since the passage of the act …

Contracts (1962), Frederick M. Hart Jan 1962

Contracts (1962), Frederick M. Hart

Faculty Scholarship

§4.1. Introduction. The 1961 Annual Suroey of American Law pointed to the Uniform Commercial Code as the most significant development in the law of contracts during recent years. This statute, with its many provisions affecting the rules of offer and acceptance, consideration, unconscionable agreements and other aspects of the contractual relationship, will undoubtedly have a substantial effect upon traditional contract concepts. At the very least, there has been a shift from the Willistonian rigidity to Llewellynian flexibility in contracts involving the sale of personal property. Furthermore, with the natural tendency of some courts to reason by analogy and apply the …

Legal By-Products Of Chemical Testing For Intoxication, M. C. Slough, Paul E. Wilson Jan 1962

Legal By-Products Of Chemical Testing For Intoxication, M. C. Slough, Paul E. Wilson

Cleveland State Law Review

One among many problems of national moment is the intoxicated motorist. Legislators have long fumbled for remedies to halt a wave of senseless killing and mutilation that has resulted from an unhappy combination of ethyl alcohol and mechanical power. Convictions in court have been too difficult to halt a wave of senseless killing and mutilation that has reconstructive and effective legal control. Jurors themselves, have often been hesitant to convict because the sum total of objective evidence produced has not convinced them that the subjects they were judging had actually been drunk or intoxicated.

Peace-Keeping Costs And Charter Obligations - Implications Of The International Court Of Justice Decision On Certain Expenses Of The United Nations, James F. Hogg

Faculty Scholarship

This article analyzes the important legal and political implications of the July 20, 1962 advisory opinion of the International Court of Justice. This opinion dealt with one of the most serious problems facing the United Nations Organization - how to finance and pay for its operations. By a majority of nine to five, the court advised the General Assembly that expenses occasioned by the United Nations operations in the Congo and in the Middle East constituted "expenses to the Organization" within the meaning of Article 17, paragraph 2 of the United Nations Charter. This opinion may prove to be one …
