The Challenge Of Apportionment, Donald B. King
The Challenge Of Apportionment, Donald B. King
Washington Law Review
During the past half century, one of the most significant problems in the area of community property has been the apportionment of income or of an increase in value in situations involving the expenditure of community labor on separate property. Arising out of a conflict between fundamental community property concepts, this problem has served to perplex lawyers and judges alike. Confronted with the problem, courts have designed a number of systems of apportionment with wide-ranging consequences. Some of these systems, however, are inequitable, others are inflexible, and still others lack any definite criteria. Despite the efforts devoted toward solving this …
Policyholders' Interest Income From Life Insurance Under The Income Tax, Richard Goode
Policyholders' Interest Income From Life Insurance Under The Income Tax, Richard Goode
Vanderbilt Law Review
Life insurance policies usually combine pure insurance and saving features. This fact is recognized by the industry and by those who draw up national economic accounts but is not fully reflected in the income tax. None of the return on saving through life insurance is taxed to a policyholder prior to the maturity, redemption, or surrender of a policy. Part of the return, but apparently only a small fraction of the total, is taxed when policies mature for reasons other than the death of the insured or are redeemed or surrendered. Inasmuch as most forms of investment income are taxable, …
Taxation-Federal Income Tax-Enjoining Collection, D. Michael Kratchman S.Ed.
Taxation-Federal Income Tax-Enjoining Collection, D. Michael Kratchman S.Ed.
Michigan Law Review
Taxpayer sued to enjoin collection of federal insurance contributions and unemployment taxes with respect to certain fishermen who worked on boats operated by the corporate taxpayer. The Government contended that under the Internal Revenue Code an injunction could not be sustained on a showing of non-liability. The district court issued the injunction on the grounds that the tax was illegal because no employer-employee relationship in fact existed and that collection of the tax would ruin the corporation financially. The court of appeals affirmed, holding that a taxpayer may enjoin the collection of a federal tax when he shows its illegality …

Theoretical And Comparative Aspects Of Reapportionment And Redistricting: With Reference To Baker V. Carr, Charles P. Edwards
Theoretical And Comparative Aspects Of Reapportionment And Redistricting: With Reference To Baker V. Carr, Charles P. Edwards
Vanderbilt Law Review
Dr. Edwards in this article applies political theory to evaluate the impact of reapportionment and redistricting on representative government. In so doing he discusses the sources of this political theory and the goals of representative government. He also surveys comparative political practice in Great Britain and the United States. In suggesting various legislative, administrative, and judicial remedies to malapportionment and inequitable districting, Dr. Edwards concludes that the effect of the present litigation resulting from the Baker v. Carr decision will be to arouse public opinion and prompt legislators to meet the accumulated challenges of urbanization as well as other contemporary …
What's Wrong With Baker V. Carr?, Robert Lancaster
What's Wrong With Baker V. Carr?, Robert Lancaster
Vanderbilt Law Review
The decision of the majority of the Supreme Court in Baker v. Carr, the recently decided Tennessee Reapportionment Case, may well turn out to be one of the landmark decisions of American jurisprudence. If by reason of apathetic acquiescence such a judicial intrusion is permitted to go unchallenged and undebated, our federal system of limited and constitutional government may be further weakened. Although the balance of power as between the states and the national government has shifted and this shift has been reflected in and furthered by judicial interpretation of our Constitution, it seems questionable that such a far-reaching and …

New Trials For Failure Of Substantial Justice, Philip A. Trautman
New Trials For Failure Of Substantial Justice, Philip A. Trautman
Washington Law Review
Of the several grounds for a new trial in Washington, one in particular has created considerable difficulty for the supreme court, the superior court judges, and counsel. The ground in question is set forth in Rules of Pleading and Procedure 59.04W(9), "That substantial justice has not been done." This is followed by the provision that, "In all cases wherein the trial court grants a motion for a new trial, it shall, in the order granting the motion, give definite reasons of law and facts for so doing." The problem has been one of determining the degree of discretion resting with …

Racial Minority Housing In Washington, Arval A. Morris, Daniel B. Ritter
Washington Law Review
O'Meara v. Washington State Bd. Against Discrimination\ called upon the Washington Supreme Court to pass for the first time on the constitutionality of Washington's Anti-Discrimination Statute. The court invalidated the portion applicable to housing. This comment discusses the social and legal contexts in which the case was decided, the disposition of the case at the trial and appellate levels, and the merit of some alternative measures for preventing discrimination in housing.
