Genetic Freedom Of The Seas In The Age Of Extractivism: Marine Genetic Resources In Areas Beyond National Jurisdiction, Irus Braverman
Genetic Freedom Of The Seas In The Age Of Extractivism: Marine Genetic Resources In Areas Beyond National Jurisdiction, Irus Braverman
Contributions to Books
Published as Chapter 4 in Laws of the Sea: Interdisciplinary Currents, Irus Braverman, ed.
Areas beyond national jurisdiction are the largest environment on earth and marine genetic resources are its new, and perhaps final, frontier. It is no wonder, then, that the scope and protection of marine genetic resources in this oceanic space have been hotly contested and that a new doctrine for ocean governance has been coined in this context: mare geneticum. This chapter examines different definitions of marine genetic resources debated in the ongoing treaty negotiations over areas beyond national jurisdiction (the BBNJ), the conflicting interests involved, and …
Amphibious Legal Geographies: Toward Land–Sea Regimes, Irus Braverman
Amphibious Legal Geographies: Toward Land–Sea Regimes, Irus Braverman
Contributions to Books
Published as ine introduction to Laws of the Sea: Interdisciplinary Currents, Irus Braverman, ed.
This introduction presents an overview of the key concepts discussed in the subsequent chapters of this book. The book discusses the juridical thinking that has enshrined the land/sea divide into contemporary governmental infrastructures, disciplinary traditions, and regulatory apparatuses, and charts the disastrous implications that such a legal fixation on the land/sea binary has wrought on human and other-than-human lifeworlds. As the collection proceeds, a second broad theme emerges, building on the first: when one rethinks the abstraction of law as played out on the ground, the …
Flattening The Curve While Protecting Our Right To Privacy: How The United States Can Implement The Digital Contract Tracing Efforts Used In East Asia, Evan Morris
Global Business Law Review
This paper looks at the digital contact tracing efforts implemented by other nations and assesses how similar measures could operate under enacted and proposed United States laws. Part I overviews the history of contact tracing and its effectiveness in prior disease outbreaks. Part II delves into the digital contact tracing efforts implemented by South Korea and Singapore. These summaries include: the digital contact tracing efforts taken, the laws that authorize these efforts, the public’s reception, and the overall effectiveness of the efforts. Part III overviews the digital contact tracing efforts in the United States, including proposed legislation aimed at user …
Zen And The Art Of Repair Manuals: Enabling A Participatory Right To Repair Through An Autonomous Concept Of Eu Copyright Law, Anthony D. Rosborough
Zen And The Art Of Repair Manuals: Enabling A Participatory Right To Repair Through An Autonomous Concept Of Eu Copyright Law, Anthony D. Rosborough
Articles, Book Chapters, & Popular Press
Repair manuals are an essential resource for repairing today’s modern and computerised devices. And though these manuals may contain purely utilitarian and uncopyrightable facts, they often receive copyright protection in their entirety as literary works. This protection can impede community-based efforts toward fostering a culture of participatory repair throughout the EU, including repair cafés and tool libraries. Participatory repair activities provide numerous environmental, social, and economic benefits. This article explores whether directive 2001/29/EC’s exception for “uses in connection with the repair or demonstration of equipment” at Article 5(3)(l) (the “Repair Exception”) may offer an avenue for enabling such non-profit participatory …

Consumer Law’S Equity Gap, Vijay Raghavan
Consumer Law’S Equity Gap, Vijay Raghavan
Utah Law Review
This Article is about the views that shape and constrain the development of consumer law. Consider the market for short-term, highcost loans. Policymakers tend to justify intervening in these markets on inefficiency grounds (consumers exhibit present bias) and rarely on equitable grounds (these loans cost too much). Why? One recent explanation suggests that policymakers may focus on inefficiency because they believe access to credit is essential for social and economic development. In this Article, I offer an alternative explanation. The lack of equity in consumer law is not just a function of narrow conceptions internal to consumer law but the …
Dark Systems: Reprogramming Artificial Intelligence Regulations To Promote Fairness And Employment Nondiscrimination, Wennagel, Robert
Dark Systems: Reprogramming Artificial Intelligence Regulations To Promote Fairness And Employment Nondiscrimination, Wennagel, Robert
Santa Clara High Technology Law Journal
Automated decision-making (“ADM”) systems, whether deploying artificial intelligence, machine learning, or other algorithmic processes, have become ubiquitous in modern life, but their use is often unnoticed or invisible to society at large. Currently no federal laws require notice or disclosure to individuals when an ADM is used to collect their data, evaluate them, or make determinations about their lives. This is particularly concerning for the employment relationship because notice and transparency are essential for personal privacy, and the surreptitious use of ADM systems deprives applicants and employees of the ability to understand employers’ decision-making processes and to seek redress under …

Automating Defeasible Reasoning In Law With Answer Set Programming, How Khang Lim, Avishkar Mahajar, Martin Strecker, Meng Weng Wong
Centre for Computational Law (2022-2025)
The paper studies defeasible reasoning in rule-based systems, in particular about legal norms and contracts. We identify rule modifiers that specify how rules interact and how they can be overridden. We then define rule transformations that eliminate these modifiers, leading in the end to a translation of rules to formulas. For reasoning with and about rules, we contrast two approaches, one in a classical logic with SMT solvers, which is only briefly sketched, and one using non-monotonic logic with Answer Set Programming solvers, described in more detail.
