Environmental Justice Mapping In The U.S. Pacific Island Territory Of Guam, Ben Rocha Sep 2022

Environmental Justice Mapping In The U.S. Pacific Island Territory Of Guam, Ben Rocha

Master of Science in Environmental Sciences and Management Projects

Academics, regulators, and the public currently use geospatial analysis tools to identify locations that may be candidates for further environmental justice review in the continental United States (U.S.). However, current environmental justice geospatial analysis tools overlook a small but significant portion of the U.S. - the U.S. Pacific Islands. This study analyzes environmental justice within the U.S. Territory of Guam using existing geospatial analysis methods and publicly available environmental, climate, and socio-economic data to: (1) Spatially map relevant demographic and environmental data and (2) determine the correlation, if any, between the exposure to environmental hazards and the socio-economic status of …

Holmes V. Walton And Its Enduring Lessons For Originalism, Justin W. Aimonetti Sep 2022

Holmes V. Walton And Its Enduring Lessons For Originalism, Justin W. Aimonetti

Marquette Law Review

Originalism is nothing new. And the New Jersey Supreme Court’s 1780 decision in Holmes v. Walton shows it. In that case, the New Jersey Supreme Court disallowed a state law as repugnant to the state constitution because the law permitted a jury of only six to render a judgment. To reach that result, the court looked to the fixed, original meaning of the jury trial guarantee embedded in the state constitution, and it then constrained its interpretive latitude in conformity with that fixed meaning. Holmes thus cuts against the common misconception that originalism as an interpretive methodology is a modern …

Degrees Of Confidence As A Legal Tool To Assess Ai System Liability, Joshua Song Sep 2022

Degrees Of Confidence As A Legal Tool To Assess Ai System Liability, Joshua Song

Michigan Technology Law Review

AI systems have become increasingly integrated into our everyday lives, and harms caused by these systems have graduated from raising hypothetical ethical concerns to questions of actual legal liability. Civil liability schemes are generally designed to address harms caused by humans; thus, it may be tempting to analogize new types of harms caused by AI systems to familiar harms caused by humans in order to justify commandeering existing human-centered legal tools to assess AI liability. However, the analogy is inappropriate and misrepresents salient legal differences in how harms are committed by humans and AI systems. Thus, “as is often the …

An Investigation Of The Unintended Consequences Of Florida’S Stand Your Ground Law And Leadership’S Role In Both Implementing The Law And Revising It, Anthony Keel Sep 2022

An Investigation Of The Unintended Consequences Of Florida’S Stand Your Ground Law And Leadership’S Role In Both Implementing The Law And Revising It, Anthony Keel

Dissertations

The State of Florida has become a negative representation of the Stand Your Ground Law due to the three unintended consequences which developed since that law was passed in 2005. They are the disparity of African American incarceration rates when the law is applied, the increase in justifiable homicides, and the exponential increase in concealed carry permits. The intent of this qualitative research study was to inspire the leadership of the state of Florida to actively support and participate in reexamining, reassessing, and revising the Stand Your Ground Law. The literature review suggested that the law is ambiguous because it …

User Guided Abductive Proof Generation For Answer Set Programming Queries, Avishkar Mahajan, Martin Strecker, Meng Weng (Huang Mingrong) Wong Sep 2022

User Guided Abductive Proof Generation For Answer Set Programming Queries, Avishkar Mahajan, Martin Strecker, Meng Weng (Huang Mingrong) Wong

Research Collection Yong Pung How School Of Law

We present a method for generating possible proofs of a query with respect to a given Answer Set Programming (ASP) rule set using an abductive process where the space of abducibles is automatically constructed just from the input rules alone. Given a (possibly empty) set of user provided facts, our method infers any additional facts that may be needed for the entailment of a query and then outputs these extra facts, without the user needing to explicitly specify the space of all abducibles. We also present a method to generate a set of directed edges corresponding to the justification graph …

Everything I Know About The Bond Market I Learned From Litwin V.Allen An Essay (In Two Parts) For Ralph Winter, Richard A. Booth Sep 2022

Everything I Know About The Bond Market I Learned From Litwin V.Allen An Essay (In Two Parts) For Ralph Winter, Richard A. Booth

Faculty Publications

This essay focuses on the classic 1940 case Litwin v. Allen, 25 N.Y.S.2d 667 (N.Y. Sup. Ct. 1940), in which the court ruled that directors and officers of a bank were liable for losses suffered by the bank from a transaction in which the bank bought a bond at a discounted price subject to an option permitting the seller to buy it back at the same price (up to) six months later. The price of the bond fell dramatically during the option period, the seller declined to buy it back, and the bank was left with the loss. The court …

The Influence Of Landmark Judgments And Statutory Changes On The Family Litigation Explosion: A Citation Network Analysis, Joseph Hickey, Lyndsay Campbell, Jörn Davidsen Aug 2022

The Influence Of Landmark Judgments And Statutory Changes On The Family Litigation Explosion: A Citation Network Analysis, Joseph Hickey, Lyndsay Campbell, Jörn Davidsen

Canadian Journal of Family Law

Family law in many countries has changed radically since the 1960s. However, despite family law’s central importance, few detailed quantitative analyses of the relationship between legal developments (landmark judgments and statutory changes) and the amount and subject of family litigation have been made. We examine this relationship using a unique dataset of citations among Canadian family law judgments from all levels of the court hierarchy. The network analysis draws attention to significant changes in law and legal practice over time. Not only did litigation increase overall, but the number of judgments involving multiple legal issues grew dramatically in the mid-1990s, …

Law Society Regulation And The Lawyer-Academic, Andrew Flavelle Martin Aug 2022

Law Society Regulation And The Lawyer-Academic, Andrew Flavelle Martin

Dalhousie Law Journal

Can, and should, law societies regulate and discipline lawyers for their teaching and research? This article explores these largely overlooked but critically important questions in order to establish a foundation for further debate and discussion by lawyers, legislators, and law societies. It argues that professionalism precludes only low-value teaching and research—teaching and research with little pedagogical or epistemic value such that it is unlikely or unworthy to be protected by academic freedom—and that any chilling effect on lawyer-academics comes as much from uncertainty as from actual danger of regulatory consequences. The author concludes that law societies and other stakeholders should …
