Put Down The Phone! The Standard For Witness Interviews Is In-Person, Face-To-Face, One-On-One, Sean D. O'Brien, Quinn C. O'Brien, Dana Cook
Hofstra Law Review
The article focuses on professional standards for investigative interviews, the social science supporting the in-person, face-to-face interview standard. It mentions standards that apply to capital mitigation work, the problems created by remote witness interviews are not unique to death penalty work. It also mentions police officers, social workers, parole officers, and defense investigators knock on doors and mental health experts investigated prevailing standards of performance.

Liberty And Justice For Y’All: Allowing Legal Paraprofessionals To Practice Law To Reduce The Effects Of Legal Deserts In Rural Georgia, Amanda Claxton
Mercer Law Review
The lack of attorneys in rural America is not merely a social or cultural problem—it is a legal problem that officers of the courts cannot continue to ignore. Legal deserts are geographical areas where legal services are widely unavailable. Particularly in rural Georgia, legal deserts are a substantial issue. Attorneys and nonprofit organizations have attempted to ease the detrimental effects of legal deserts in a variety of ways; for various reasons, those efforts have been insufficient, and rural counties struggle to attract lawyers. Still, there is one method of resolving legal deserts that Georgia has yet to attempt: creating an …

Columbia Center on Sustainable Investment
The zero-carbon energy transition is the solution to the 2022 energy crisis and a fundamental part of the solution to the global climate crisis. Yet, there are relatively low levels of investment in renewable energy in developing countries, hindering their achievement of the Sustainable Development Goals (SDGs) and contribution to the Paris Agreement goals.
In 2021, the Asia–Pacific region (excluding China) accounted for less than 8% of investments in energy transition technologies, Latin America and the Caribbean for less than 4%, and Africa and the Middle East for less than 2%. Annual investment in zero-carbon energy in developing economies other …

Conflicts Between Ghg Accounting Methodologies In The Steel Industry, John Biberman, Perrine Toledano, Baihui Lei, Max Lulavy, Rohini Ram Mohan
Columbia Center on Sustainable Investment
Accurate, verifiable, and comparable greenhouse gas (GHG) emissions data throughout supply chains in the materials sector are necessary to drive decarbonization. This is particularly the case for the steel supply chain, a major source of GHG emissions with untapped potential for reduction. However, emissions accounting methods used by the steel industry suffer from gaps and misalignment, resulting in significant differences in reported GHG emissions. The result is a patchwork reporting landscape vulnerable to manipulation and miscommunication, generating little actionable data for policymakers, producers, customers, and investors. These shortcomings highlight the need for a harmonized carbon accounting framework for the steel …

In this short note, we describe part of a case study about Singapore’s Personal Data Protection Act, which we first presented in-formally, then formally as interacting Timed Automata. From these, we derive desiderata on a language and verification framework for reasoning about compliance.
Federal Pleading Standards In State Court, Marcus Gadson
Federal Pleading Standards In State Court, Marcus Gadson
Michigan Law Review
Most state courts cannot follow both their state constitutions and federal pleading standards. Even if they could, policy considerations unique to states compel state courts to reject federal pleading standards. This is because federal courts have changed pleading standards to allow judges to make factual determinations on a motion to dismiss and to require more factual detail in complaints. While scholars have vigorously debated whether these changes are wise, just, and permissible under the federal rules and the Constitution, they have ignored the even more important questions of whether state courts can and should adopt those pleading standards. The oversight …
Algorithmic Elections, Sarah M.L. Bender
Algorithmic Elections, Sarah M.L. Bender
Michigan Law Review
Artificial intelligence (AI) has entered election administration. Across the country, election officials are beginning to use AI systems to purge voter records, verify mail-in ballots, and draw district lines. Already, these technologies are having a profound effect on voting rights and democratic processes. However, they have received relatively little attention from AI experts, advocates, and policymakers. Scholars have sounded the alarm on a variety of “algorithmic harms” resulting from AI’s use in the criminal justice system, employment, healthcare, and other civil rights domains. Many of these same algorithmic harms manifest in elections and voting but have been underexplored and remain …

A Tokenized Future: Regulatory Lessons From Crowdfunding And Standard Form Contracts, Darian M. Ibrahim
UC Law Journal
This Article examines the world of risk investing in the cryptoeconomy. The broader crypto market is booming despite the latest downturn. People and institutions are buying in. The question is now how to regulate it.
This Article first tackles the question of whether coins, tokens, and other investable cryptoassets are securities. Second, for those cryptoassets that are not securities, this Article seeks to find a regulatory solution that balances promoting innovation with investor protection, just as the Securities and Exchange Commission (SEC) would do. To strike the right balance, this Article adopts a proposal by Ian Ayres and Alan Schwartz …
Forensic Linguistics: Science Or Fiction?, Abigail Shim
Forensic Linguistics: Science Or Fiction?, Abigail Shim
UC Law Journal
The history of linguistics is meager and splintered due to the subject’s interdisciplinary nature. In the postwar era, the discipline attempted to revive as a scientific one, spearheaded by Noam Chomsky and his theory of generative grammar. Linguistics consequently broke away from the predominant structuralist approach of the nineteenth century, returning to rationalist roots. But with the rise of computer technology, Chomsky’s critiques of empirical, applicational linguistic approaches have lost their force. As academic linguistics splinters off again, loses its scientific edge, and regroups with the humanities, linguistics applied in the forensic context may implicate more questions than it answers, …

Forks Over Knives: Predictive Inconsistency In Criminal Justice Algorithmic Risk Assessment Tools, Travis Greene, Galit Shmueli, Jan Fell, Ching-Fu Lin, Han-Wei Liu
Research Collection Yong Pung How School Of Law
Big data and algorithmic risk prediction tools promise to improve criminal justice systems by reducing human biases and inconsistencies in decision-making. Yet different, equally justifiable choices when developing, testing and deploying these socio-technical tools can lead to disparate predicted risk scores for the same individual. Synthesising diverse perspectives from machine learning, statistics, sociology, criminology, law, philosophy and economics, we conceptualise this phenomenon as predictive inconsistency. We describe sources of predictive inconsistency at different stages of algorithmic risk assessment tool development and deployment and consider how future technological developments may amplify predictive inconsistency. We argue, however, that in a diverse and …
Overqualified And Underrepresented: Gender Inequality In Pharmaceutical Patent Law, S. Sean Tu, Paul R. Gugliuzza, Amy Semet
Overqualified And Underrepresented: Gender Inequality In Pharmaceutical Patent Law, S. Sean Tu, Paul R. Gugliuzza, Amy Semet
BYU Law Review
Pharmaceutical patents represent some of the most valuable intellectual property assets in the world: they can be worth billions of dollars if courts uphold their validity and find them infringed. But, if invalidated, generic drug manufacturers can get to market earlier, generating billions of dollars of revenue for themselves and creating enormous savings for consumers. Accordingly, drug patents are the product of careful, high-cost prosecution and are associated with high-stakes, bet-the-company litigation.
But women lawyers are noticeably absent from pharmaceutical patent practice. This article reports an original empirical study finding that women comprise only one-third of the top pharmaceutical patent …
Contractual Complexity, Spencer Williams
Contractual Complexity, Spencer Williams
Faculty Scholarship
Lawyers, judges, scholars, and clients all agree on one thing about contracts: they are complex. But what does this actually mean? What is contractual complexity and where does it come from? Despite widespread agreement that contracts are complex, the literature on contracts has yet to effectively define contractual complexity. Furthermore, the literature lacks a general theory of complexity that connects it to the broader body of contracts scholarship. This Article aims to fill these gaps. Drawing on complexity theory, the Article argues that contractual complexity is the degree of interactivity between a contract’s terms. Building on this definition, the Article …
One Person, How Many Votes? Measuring Prison Malapportionment, Ian Bollag-Miller
One Person, How Many Votes? Measuring Prison Malapportionment, Ian Bollag-Miller
Fordham Law Voting Rights and Democracy Forum
“One-person, one-vote” is a fundamental principle of democracy. In practice, however, vote distribution among population groups is often less than equal. Even in established democracies, prison malapportionment—the distribution of legislative seats by counting incarcerated people in their prisons’ districts rather than their home districts—is one example of a practice that distorts voter representation. Prison malapportionment allows less populous districts that house prisons to maximize their voting power at the expense of more densely populated districts from which many incarcerated people previously lived. While there has been significant scholarship on the causes and effects of prison malapportionment, there is no standard …

The purpose of this study is to highlight evidence the animations the primary source for younger children to acquire metaphors. They can make use of those cartoons to recognise and activate their conceptual maps. The study applied the Conceptual Metaphor Theory (CMT) by Lakoff, & Johnson (1980) to be the theoretical framework of this study. The data collection is one-on-one method interviews (or face to face) which is the major and commonest type of the data collection methods in research whose nature is qualitative, yet this research applies the mixed method that combines the prose of the quantitative and qualitative …

There are many studies that dealt with the topic of solar radiation in general, but rarely there is a study that dealt with the topic of calculating the transparency of the atmosphere in details , so we dealt with this topic in detail and with some capacity to obtain new and more realistic results that are used in many fields , through using many mathematical models and equations in which the permeability values of the atmosphere were calculated, namely the calculation of the permeability of oxygen gas and carbon dioxide. This research dealt with calculating the permeability values of the …

Big Data Affirmative Action, Peter N. Salib
Northwestern University Law Review
As a vast and ever-growing body of social-scientific research shows, discrimination remains pervasive in the United States. In education, work, consumer markets, healthcare, criminal justice, and more, Black people fare worse than whites, women worse than men, and so on. Moreover, the evidence now convincingly demonstrates that this inequality is driven by discrimination. Yet solutions are scarce. The best empirical studies find that popular interventions—like diversity seminars and antibias trainings—have little or no effect. And more muscular solutions—like hiring quotas or school busing—are now regularly struck down as illegal. Indeed, in the last thirty years, the Supreme Court has invalidated …

Machine learning applications promise to augment clinical capabilities and at least 64 models have already been approved by the US Food and Drug Administration. These tools are developed, shared, and used in an environment in which regulations and market forces remain immature. An important consideration when evaluating this environment is the introduction of open-source solutions in which innovations are freely shared; such solutions have long been a facet of digital culture. We discuss the feasibility and implications of open-source machine learning in a health care infrastructure built upon proprietary information. The decreased cost of development as compared to drugs and …

Deepfake Fight: Ai-Powered Disinformation And Perfidy Under The Geneva Conventions, David Nicholas Allen
Notre Dame Journal on Emerging Technologies
Deception and disinformation are as much a part of the battlefield as bullets and bombs. However, just like with bullets and bombs, if the law does not properly regulate a capability’s use the capability could degrade faith in the law. In this respect, this paper examines deepfake technology, a modern artificial intelligence-based capability that can generate superficially-perfect yet wholly invented media content. The paper looks ahead to its potential future applications in armed conflict, processes the ways in which current law contemplates such deception, and distills recommendations for improving governance where needed.

The use of artificial intelligence to help editors examine law review submissions may provide a way to improve an overburdened system. This Article is the first to explore the promise and pitfalls of using artificial intelligence in the law review submissions process. Technology-assisted review of submissions offers many possible benefits. It can simplify preemption checks, prevent plagiarism, detect failure to comply with formatting requirements, and identify missing citations. These efficiencies may allow editors to address serious flaws in the current selection process, including the use of heuristics that may result in discriminatory outcomes and dependence on lower-ranked journals to conduct …
Killing The Motivation Of The Minority Law Professor, Goldburn P. Maynard Jr.
Killing The Motivation Of The Minority Law Professor, Goldburn P. Maynard Jr.
Minnesota Law Review Vols. 106:2 onward (2021-present)
This Essay hypothesizes that a significant number of minority junior scholars with radical or non-normative ideas forego those projects or mute them to fit their work within the dominant paradigm of legal scholarship. Even those who move forward and publish their radical or non-normative proposals spend significant time attempting to overcome internal and external resistance, negotiating with mentors, and finding ways to make the radical seem palatable. This disproportionately harms the productivity of minority law professors, not only through inefficiency, but also through the long-term destruction of intrinsic motivation that is vital and overlaps with successful, fulfilling, and productive careers. …

What Is Quality? Advancing Value-Added Approaches To Assessing Law School Bar Exam Performance, Jason M. Scott, Josh Jackson
AccessLex Institute Research
U.S. News & World Report rankings and tier groupings are often used as proxy measures of law school quality. But many of the factors that contribute to both law school outcomes and U.S. News rankings (e.g., undergraduate GPAs [UGPA], LSAT scores, admission rates) do not reflect the impact law schools have on student outcomes, such as bar passage and employment. We propose a method for measuring institutional quality that is based on a school’s ability to improve its graduates’ likelihood of first-time bar passage while controlling for those students’ preadmission characteristics. Using a value-added modeling technique, we first isolate each …
