Some Problems In Modern Legal Education, Harold Shepherd
Washington Law Review
Those of you who enjoy Gilbert and Sullivan recall, no doubt, the Lord Chancellor's appraisal of the law in "Iolanthe," "The law is the true embodiment of everything that is excellent, it has no kind of fault or flaw, and I, my lords, embody the law." Those of you who enjoy Dickens may also recall that one of his characters, Mr. Bumble, summed it all up by the expression, "The law is an ass." I have always suspected that the truth lies somewhere between the two, and that perhaps, in a nut shell, the true task of modern legal education …
Aliens-Naturalization-The Promise To Bear Arms, John S. Tennant
Aliens-Naturalization-The Promise To Bear Arms, John S. Tennant
Michigan Law Review
In two recent cases, the Supreme Court has held that citizenship must be denied an applicant who is unwilling to promise unreservedly to bear arms in defense of the United States. One applicant, Douglas Clyde Macintosh, a Professor of Divinity in Yale University, who served for four years in France during the World War, stated that due to religious convictions he was unable to promise beforehand to fight unless, in his own opinion, the war was morally justifiable and in the best interests of humanity. The other, Marie Averil Bland, a minister's daughter who served as a nurse in the …

History Of The Notre Dame College Of Law, Thomas Frank Konop
Journal Articles
In the summer of 1868 the Board of Trustees of the University passed a resolution "for the opening of a course in law at Notre Dame." At that time there were very few law schools in the country and the profession was almost wholly recruited from the law-offices. As a matter of fact there was great doubt among the lawyers at that time as to the advisability and the possibility of acquiring training for the bar at a university. There were even prejudices at that time against the study of law at law schools. It was during such doubts and …

New Avenues To Freedom, Edwin D. Dickinson
New Avenues To Freedom, Edwin D. Dickinson
Michigan Law Review
Lay opinion regards the law of nations as a weak and ineffective system. It is the fashion to deplore the inefficacy: of its precepts and to regard it as a sort of benevolent code unsupported by any forces which can really compel observance. There is a good deal of loose talk about providing sanctions. The truth is, however, that few systems of law are so infested with tyrannies. It is not sanctions which are needed so much as opportunities for growth. It is not the buttressing of existing dogmas which is required so much as new avenues to freedom.
