Reason And Passion: The Constitutional Dialectic Of Free Speech And Obscenity, John M. Finnis
Reason And Passion: The Constitutional Dialectic Of Free Speech And Obscenity, John M. Finnis
Journal Articles
In recent obscenity cases, the Supreme Court has been attempting to define the constitutional meaning of "speech." This is not as banal a statement as it may seem, for there are critics, both on and off the Court, who think that the Court's task is to define "freedom."
Some advocate boundless freedom in this area. For them, obscenity raises no special problems of definition, and is simply an exercise of speech or press presenting dangers which are remote and disputable, rather than clear and present. From this point of view, the only relevant distinction is that between "speech" and "conduct." …

Prolonging Life, George P. Fletcher
Prolonging Life, George P. Fletcher
Faculty Scholarship
A physician decides not to prolong the life of a terminal patient. What are the legal consequences? Is it murder, akin to a gunman's pulling the trigger? Or is the law more sensitive? Professor Fletcher proposes that a decision to interrupt life-sustaining therapy, such as that to turn off a mechanical respirator, should be classified as an omission, not an act. He arrives at this conclusion by analyzing the common sense usages of "cause" and "permit." If the decision is an omission then the law must focus on the doctor-patient relationship to define legal consequences, allowing customary standards of the …

Vanderbilt Law Review
The problem discussed by Professor Stumpf in his book Morality and the Law can be summarized by these questions: Do we have two kinds of prescribed conduct, one prescribed by morality independent of the government, the other prescribed by government independent of morality? Or is prescription by government necessarily moral because government is necessarily moral by reason of being the government? If not, under what conditions, if any, does prescription by government become a moral prescription? Under what conditions, if any, is government, by law, a matter of expedience, not to be confused with morality?

The Effect Of Misunderstanding On Contract Formation And Reformation Under The Restatement Of Contracts Second, George E. Palmer
The Effect Of Misunderstanding On Contract Formation And Reformation Under The Restatement Of Contracts Second, George E. Palmer
Michigan Law Review
The presence of misunderstanding at the time of an apparent agreement creates difficult problems in the law of contract formation and equally difficult problems when the apparent agreement is in ·writing and reformation is sought. The rules formulated in the original Restatement of Contracts are unsatisfactory in both areas. The preparation of the Restatement Second, which is now under way for contracts, includes changes in the rules of contract formation but the changes emerging are no more satisfactory than the original rules. The current version of the Restatement Second, contained in Tentative Draft No. 1, accepts the …

The Procedure Before The Court Of Justice Of The European Communities, Peter E. Herzog
The Procedure Before The Court Of Justice Of The European Communities, Peter E. Herzog
Washington Law Review
The Court of Justice of the European Communities has inspired much legal writing, including many books and articles in English. Particular attention has been paid to its jurisdiction and general organization, much less to its procedure. But Professor Sereni has pointed out that differences in the domestic procedural laws of states appearing before an international court may cause difficulties in the work of the international tribunal itself. It therefore may be of interest to review briefly some aspects of the procedure of a court which is perhaps not an international tribunal in the strict sense of the word, but in …

The Place Of Sanctions In Professor H.L.A. Hart's Concept Of Law, Leo Kanowitz
The Place Of Sanctions In Professor H.L.A. Hart's Concept Of Law, Leo Kanowitz
Duquesne Law Review
In his 1958 Harvard Law Review exchange with Lon Fuller, Professor H.L.A. Hart of Oxford University wrote:
It is surely not arguable (without some desperate extension of the word "sanction" or artificial meaning of the word "law") that every law in a municipal system must have a sanction, yet it is at least plausible to argue that a legal system must, to be a legal system, provide sanctions for certain of its rules.
Three years later Professor Hart published his book, The Concept of Law. Widely acclaimed as a significant and important contribution to twentieth-century jurisprudential thought, the book …
The Role Of The Per Diem Argument In Personal Injury Suits, Thomas L. Cooper
The Role Of The Per Diem Argument In Personal Injury Suits, Thomas L. Cooper
Duquesne Law Review
With increasing frequency, appellate courts across the country are being forced to decide the propriety of counsel for the plaintiff utilizing a formula, or per diem approach, when discussing damages for pain and suffering in closing argument. Until a few years ago, this technique seems to have excited little attention, and to have generated few appeals. The steady rise in automobile accidents, the increasing amount of personal injury litigation, and the tendency of the courts to scrutinize carefully every procedure that might detract from a fair trial, have combined to bring this type of argument to the attention of the …
