The Ferment In Divorce Legislation, Harvey L. Zuckman, William Fox
The Ferment In Divorce Legislation, Harvey L. Zuckman, William Fox
Scholarly Articles
Marriage as we know it in America is undergoing rigorous re-examination and even hostile attack in the last third of the twentieth century in part because of the doubt expressed in some quarters that this venerable institution meets the psychological and sociological needs of the mass of men and women. And since, as one wag has put it, marriage is the "cause" of divorce, one can expect great ferment in the area of divorce law as well. Such is in fact the case. The legislatures, the prime source of divorce law, after a period of neglect sometimes going back to …
The Future Of Legal Services In Canada, Larry Taman, Frederick H. Zemans
The Future Of Legal Services In Canada, Larry Taman, Frederick H. Zemans
Articles & Book Chapters
Attempting to describe the future provision of legal services to the poor and working class, this brief article canvasses the evolution of such services and defines those techniques that will evolve further. Believing the changes will transcend mere technique, it also describes any spin-off changes that touch on other areas.

Hofstra Law Review
The Board of Editors, hoping to create some novelty in its first issue, has suggested to its contributors that they engage in some soothsaying on the future development of the law. Frankly, I have no clairvoyance; but this newborn Hofstra Law Review and its Staff entrance me, and I offer some calculated guesses on a purely novelty basis.
Let me first congratulate the Law School on conceiving and achieving this first issue. It has taken great courage, much maneuvering and lots of hard work. As it joins the array of law reviews I hope that Hofstra will bring a love …

Lay Divorce Firms And The Unauthorized Practice Of Law, Arthur R. Miller
Lay Divorce Firms And The Unauthorized Practice Of Law, Arthur R. Miller
University of Michigan Journal of Law Reform
Effective January 1, 1972, Michigan adopted a no-fault divorce law. Since that time, at least two firms in the Detroit area have gone into the business of providing assistance to people wishing to process their own divorces. These enterprises, which have been dubbed divorce firms or divorce kit firms, have come under heavy attack from the organized bar. The State Bar of Michigan has instituted court proceedings against one firm for the unauthorized practice of law, and a court on its own initiative has already issued an injunction against the other. These cases raise two important issues: whether the divorce …
Matter Of Ella B.
Hofstra Law Review
In Matter of Ella B. the New York Court of Appeals held that an indigent parent has a right to assigned counsel in all child neglect proceedings and must be advised of this right by the court. The case commenced when the Commissioner of Social Services of Westchester County filed a petition in the Family Court charging the respondentmother, Jeri B., with neglect of her three-year-old daughter. In the petition it was alleged that the parent had left her child alone at home, harnessed in a crib, from 1:00 A.M. until 4:00 A.M. During this period a friend of …

Even in areas where legal representation has become available to the poor through the efforts of Legal Services programs, there is still one group that is almost universally denied representation: those confined under the various forms of civil commitment and patients in mental health institutions. Almost by definition in need of legal counsel and predictably indigent, they are faced with interpersonal and institutional barriers that further reduce their chances to obtain representation. It is the position of the National Health Law Program that Legal Services programs throughout the country should focus some of their attention towards this portion of their …

The Proposed Amendments To The Federal Rules Of Evidence, Paul F. Rothstein
The Proposed Amendments To The Federal Rules Of Evidence, Paul F. Rothstein
Georgetown Law Faculty Publications and Other Works
The Supreme Court has approved a uniform code of evidence for all federal courts. Amendments to the Supreme Court's rules are now pending in the House of Representatives. From the point of view of a specialist in the law of evidence, Professor Rothstein analyzes the differences between the Supreme Court's proposals and the House amendments and suggests solutions to these conflicts.
Indigent Access To Civil Courts: The Tiger Is At The Gates, Wayne H. Scott
Indigent Access To Civil Courts: The Tiger Is At The Gates, Wayne H. Scott
Vanderbilt Law Review
The accusation that justice in America has become a luxury has been heard with increasing frequency in recent years. An often criticized aspect of this perceived discrimination is that the poor are systematically deprived of effective access, and frequently of any access at all, to the judicial process by the varied and burdensome expenses of civil litigation.' Although these financial barriers have been subjected to increasingly successful attacks in the courts, the extent to which they have been lowered remains unclear. Nevertheless, an examination of the steps already taken to alleviate the problem of the indigent civil litigant raises hopes …
