Fraudulent Advertising: The Right Of A Public Attorney To Seek Restitution For Consumers, William R. Elliott Jr.
McGeorge Law Review
The power of a public attorney to seek relief for consumers has expanded rapidly in recent years. This comment examines the standing of a public attorney to seek restitution for defrauded private parties in conjunction with an action to enjoin fraudulent advertising. The standing issue is first analyzed in a discussion of recent judicial decisions. The author then examines the legislative intent behind A.B. 1763, a 1972 amendment to the California Business and Professions Code, which, the author concludes, gives the public attorney standing to seek restitution for victims of fraudulent advertising.

The Code Of Professional Responsibility In The Corporate World: An Abdication Of Professional Self-Regulation, Carl A. Pierce
University of Michigan Journal of Law Reform
The American Bar Association's Code of Professional Responsibility (Code or CPR) provides the foundation for the regulation of the legal profession by the members of the profession themselves. Although the drafters of the CPR have described it as a body of fundamental ethical principles applicable to all lawyers regardless of the nature of their professional activities, this article examines the vitality of the CPR and professional self-regulation in one particular area of lawyers' activities: corporate practice? The article suggests that the legal profession has abdicated its self-regulatory role, discusses the consequences of this abdication, and advances some alternatives to remedy …

Criminal Responsibility Of The Addict: Conviction By Force Of Habit, Michael R. Diamond
Fordham Urban Law Journal
This article addresses questions of criminal responsibility of drug addicts in light of Robinson v. California, holding criminal sanctions for a status of drug addiction to be unconstitutional under the eighth amendment. The article evaluates key court cases relating the insanity defense, and argues that in cases where addicts commit criminal acts as a result of drug addictions, the addict should not suffer criminal penalties but should instead be treated through rehabilitation facilities or other methods.
