Fordham International Law Journal
This Note analyzes current international regulations for the deliberate release of genetically modified organisms into the environment. Part I describes the benefits and risks associated with the introduction of GMOs into the environment and presents an overview of deliberate release regulations in various countries to show the range of standards in individual nations. Part II analyzes international multilateral efforts to regulate the deliberate release of GMOs. This article explores the potential and the dangers of this novel form of collaboration between academic medicine and the for-profit world. The author focuses on those arrangements--purchases and leasing agreements--by which investor-owned corporations operate, for a profit, hospitals that serve as major medical teaching and research sites. He begins by reviewing how the evolving needs of academic medical centers and for-profit hospital chains have generated mutual interest in such arrangements. The author then considers some frequently expressed ethical, economic, and other public policy objections to the provision of hospital services by for-profit firms. Opponents of the acquisition and leasing of …

The United States Policy On Hiv Infected Aliens: Is Exclusion An Effective Solution, Christine N. Cimini

As of the summer of 1991, though the World Health Organization (WHO) had only 366,455 documented cases of Acquired Immune Deficiency Syndrome (AIDS), the organization estimated that as many as 1.25 million people worldwide had actually contracted AIDS. That number was predicted to grow to twenty-five to thirty million cases of HIV worldwide by the year 2000. With hysteria and misinformation surrounding the transmission HIV/AIDS, Congress made changes to existing immigration laws to exclude entry to individuals with HIV. This comment critiques the early 1990s United States immigration policy that added HIV to the list of diseases for which a …
The Changing Landscape Of Human Experimentation: Nuremberg, Helsinki, And Beyond, George J. Annas
The Changing Landscape Of Human Experimentation: Nuremberg, Helsinki, And Beyond, George J. Annas
Faculty Scholarship
Since World War II there have been persistent efforts at both the national and international level to develop rules to protect the rights and welfare of subjects of human experimentation.' These efforts have focused primarily on codifying the rights of subjects, and protecting their welfare by prior peer review of research protocols. In recent years research regulations have been under attack by politicians, drug companies, researchers, and advocacy groups. In less than half a century, human experimentation has been transformed from a suspect activity into a presumptively beneficial activity. With this transformation, traditional distinctions between experimentation and therapy, subject and …

An analysis of the restrictive proposals provoked by the case of Kimberly Bergalis and four other patients apparently infected with HIV during the course of dental treatment reveals that they resulted from an inability to evaluate appropriately the infinitesimal risk of HIV transmission from practitioner to patient. The proposals also resulted from an effort to create risk prevention policy without appreciating the distinction between regulating things or procedures, which have no human rights, and regulating people, who have rights that should not be infringed without serious justification. This analysis demonstrates that the proposed restrictive policies are not justified because they …

Northern Illinois University Law Review
One type of response to the current AIDS crises has been to authorize mandatory testing of private individuals for HIV in certain circumstances that give rise to fear of transmission, such as a biting or spitting incident, even without reason to believe the attacker may be an AIDS carrier.

Leckelt V. Board Of Commissioners Of Hospital District No. 1: Fifth Circuit Affirms Hospital's Right To Require Testing Of Nurse Reasonably Suspected Of Exposure To Hiv, Philip Walden
Mercer Law Review
In Leckelt v. Board of Commissioners of Hospital District No. 1, the United States Court of Appeals for the Fifth Circuit affirmed a hospital's right to demand the results of a nurse's HIV test if a reasonable suspicion exists that the nurse has been exposed to HIV. The court also upheld the hospital's right to fire the nurse for withholding the test results Although the nurse, Kevin Leckelt, attacked the hospital's action on both constitutional and statutory grounds, this Casenote focuses on the court's determination that the Rehabilitation Act of 1973 (the "Act" or the "Rehabilitation Act") permits the …

Of Gametes And Guardians: The Impropriety Of Appointing Guardians Ad Litem For Fetuses And Embryos, Susan Goldberg
Washington Law Review
Recent advances in medical technology have caused some commentators and courts to perceive fetuses and embryos as separate entities, with rights independent of the women who carry them. Conduct of pregnant women that has been perceived to conflict with the interests of the fetuses they carry has been called into question. In some cases, courts have been forced to determine the juridical status of fetuses and embryos; in others, courts have appointed guardians ad litem to represent the "best interests" of these entities. This Article maintains that appointing guardians ad litem for fetuses and embryos is inappropriate. Fetuses and embryos …
