Equivocal Originalism, Gary S. Lawson

"Originalism" is a term shrouded in ambiguity and ripe for equivocation. A recent article by Stephen Sachs in the Harvard Law Review tries to clarify the discussion by distinguishing between originalism as a decision standard, or a set of criteria for ascertaining the truth conditions for propositions, and a decision procedure, or a mechanism for ascertaining whether those truth conditions are satisfied in any given context. That is a helpful distinction, but it still leaves much room for multiple and confusing uses of the term originalism. تسلط الدراسة الضوء على أحد كتّاب السير والمغازي الأوائل ممّن واكبوا بدء التدوين التاريخي العربي الإسلامي في النصف الثاني من القرن الثاني الهجري الثامن الميلادي ، وهو (وثيمة بن موسى بن الفرات الوشاء) المتوفى سنة (ر 237هـ/ 851م)الذي لم يحظ بمكانة في الدراسات التاريخية الحديثة والمعاصرة كالتي حصل عليها معاصروه أو الذين جاءوا من بعده على الرغم من أن نتاجه التاريخي في حقل السيرة والمغازي صار مرجعاً لعدد غير قليل من كتاب السيّر والمغازي والصحابة والتراجم وغيرهم .

This paper discusses the factors behind China's ambiguous stance on the issue of autonomous weapons and its relationship with China's rise. In 2016 at the United Nations on Certain Conventional Weapons (UN-CCW), China was the only Permanent Five (P5) country to call for the prohibition and importance of a binding protocol on autonomous weapons. Through its position paper, China stated that the characteristics of autonomous weapons are not in accordance with the principles of International Humanitarian Law (IHL), fears of an arms race, to the threat of war. Recently the literature on free expression has turned to the question, should the law of free expression be adjusted because of the availability of new information technologies (hereafter NIT), and if so, how? The only thing about NIT that distinguishes them from traditional media is that disseminating expression via NIT is much less expensive than doing so via traditional media. The tenor of recent scholarship on NIT and free expression is that the invention of NIT does support some modification of free expression law. This contribution to the Notre Dame Law Review’s annual Federal Courts Symposium on “The Nature of the Federal Equity Power” asks what the traditions of equity can tell us about Article III standing. I take as my point of departure the observation by Professors Sam Bray and Paul Miller, in their contribution to the Symposium, that equity does not have causes of action as such—or at least not in the same way as actions at law. Legislating Against Liberties: Congress And The Constitution In The Aftermath Of War, Harry Blain

How far can a democracy go to protect itself without jeopardizing the liberties upon which democracy depends? This dissertation examines why wartime restrictions on civil liberties outlive their original justifications. Through a comparative historical analysis of five major American wars, it illustrates the decisive role of the U.S. Congress in preserving these restrictions during peacetime. This argument challenges the prevailing consensus in the literature, which identifies wartime executive power as the main threat to postwar freedoms. It also reveals broader narratives of American constitutional development, including the rise and fall of intrusive congressional investigations, the decline of sedition legislation since …

Distilling lessons from the author’s book, The Media Offensive: How the Press and Public Opinion Shaped Allied Strategy during World War II, this article provides applicable suggestions for the US military today. As in World War II, the press is both a weapon and a possible vulnerability in modern warfare. Consequently, this article offers practical suggestions for how the press can be used by public affairs officers, commanders, and policymakers to achieve victory in coming conflicts.

Competition And Labour Law In Canada: The Contestable Margins Of Legal Toleration, Eric Tucker

In Canada, as elsewhere, the norms of capitalist legality include an aversion to permitting collective action by sellers of commodities to increase their price. Labour law, however, is built on the norm of freedom of association and the right of commodified workers to combine for the purpose of improving the terms of their labour contracts. This gives rise to a recurring regulatory dilemma. In Canada, this conflict has been resolved by granting workers a legal immunity from liability under competition law for engaging in approved collective action to improve or defend their terms and conditions of work. Despite this clear lack of consensus as to what constitutes ideal parenting, state actors have increasingly intervened in families when they feel that a particular parenting choice is wrong. These interventions increasingly occur through the use of criminal law and punishment.5 This criminalization extends beyond prosecutions for what would traditionally be considered abuse or neglect to a wide range of parenting choices that do not rise to this level. Although many scholars have critiqued this criminalization of parenting, the focus of these critiques has centered on the harm to the families that are actually criminalized and on how a disproportionate …

In this paper we discuss the Pacific and Regional Archive for Digital Sources in Endangered Cultures (PARADISEC), a research repository that explicitly aims to act as a conduit for research outputs to a range of audiences, both within and outside of academia. PARADISEC has been operating for 19 years, and has grown to hold over 390,000 files currently totaling 150 terabytes and representing 1,312 languages, many of them from Papua New Guinea and the Pacific. Our focus is on recordings and transcripts in the many small languages of the world, the songs and stories that are unique cultural expressions. While …

Under modern democratic theory, the font of sovereignty springs from the people; however, traces of its past as a power emanating from the Crown continue to haunt the domestic and international status of sub-sovereign legal entities such as U.S. Territories. Quiescent sovereignty describes that which is possessed by the people of the Territories; a sovereignty that is theirs, but that is wielded on their behalf by the federal government. Although fiduciary responsibilities attach to this arrangement, cycles of attention/neglect are the modus vivendi. The note argues that racial and gender disparities exist in federal white-collar crime sentencing, particularly affecting Black women, who often receive harsher sentences compared to their white counterparts. It highlights cases like Felicity Huffman and Kelley Williams-Bolar to illustrate these disparities and calls for reforms to address the lack of transparency and consistency in sentencing.

Court and litigation operations are opaque in the best of times, and the lack of explanatory Nineteenth Century legal records makes it even more difficult to learn how lawyers and judges went about their business. This may be one of the reasons there are so few accounts detailing the nuts and bolts of 1800s law practice. This Article illuminates the development of litigation and the law in the middle of the Nineteenth Century by examining archival court and Patent Office records. Most accounts of the time focus either on judicial opinions or the relationship of the parties, but few articles …
