This Reply concludes the symposium hosted by the Texas A&M University Journal of Property Law on the author’s forthcoming book Natural Property Rights. The Reply shows how natural law and rights apply to a wide range of doctrinal examples raised in this symposium—including business associations, correlative oil rights, timber extraction, sinking coastlands, water law, nuisance law, property rights in subsurface minerals, and the issues about sovereignty and property disposition associated with Johnson v. The Permanent Court of International Justice's contributions often are overshadowed by the fact that it was the predecessor of the overwhelmingly important International Court of Justice. This article is the first to look at the Permanent Court's possible contribution to global history in its own right. While the case-study method adopted in this article does not allow for the determination of causal linkages between acts of the Permanent Court and consequences in global history, it nevertheless provides compelling support for liberal institutionalism and the notion that global history has been influenced by actors other than states, even though states remain …

Art changes culture while policy codifies it. Radical revolutionary movements are often accompanied by equally radical shifts in art and design. I cataloged, compared, and contrasted the semiotic power of three specific symbols and their most significant historical moments in the United States. From 1882 to 1968, the National Association for the Advancement of Colored People (NAACP) estimates that 4,743 lynching’s occurred in the U.S. While other organizations report a slightly different number, the harsh reality of terror and violence remains the same. These violent acts of murder were used as a mechanism by white mobs to promote terror and enforce control upon the black community. Despite the presence of terror and violence in our current society, little is taught about such history and the people who were murdered. Copyright law in the United States incentivizes creative activity for the public benefit by granting creators an exclusive right to control their original works. Many individuals and small businesses rely on this right and the protection of copyright law to build their reputations as artists, create a market for their work, and secure a livelihood for themselves and their families. When someone violates this right and infringes on these individuals’ and small businesses’ copyrights, the forum for seeking redress and preventing future infringement is a lawsuit in federal court. But bringing a copyright infringement claim in federal court is expensive. …

Reflecting back a decade later, what is the enduring significance of the Trayvon Martin case—a Black teenager whose life is violently cut short, and a legal system that accepted his death without consequence? Every other Western democracy now recognizes a right to counsel in at least some kinds of civil cases, typically those involving basic human rights. The World Justice Project’s 2021 Rule of Law Index ranked the United States 126th of 139 countries for “People Can Access and Afford Civil Justice.” Within its regional and income categories, the United States was dead last. Streetcars were the greatest American tortfeasors of the early twentieth century, injuring approximately one in 331 urban Americans in 1907. This empirical study presents never-before-assembled data concerning litigation involving streetcar companies in California during the early twentieth century.
This Article demonstrates the methodological folly of relying upon appellate cases to describe the world of trial court litigation. Few cases went to trial. Plaintiffs lost about half their lawsuits. When plaintiffs did win, they won very little money. Regarding the bite taken out of the street railway company, the Superior Court was a flea.

Toward Self-Determination In The U.S. Territories: The Restorative Justice Implications Of Rejecting The Insular Cases, Sarah M. Kelly

Conservatives and liberals alike are increasingly calling for condemnation of the Insular Cases—a series of U.S. Supreme Court cases from the early 1900s, in which the Court developed the doctrine of territorial incorporation to license the United States’ indefinite holding of overseas colonial possessions. In March 2021, members of the U.S. House of Representatives introduced House Resolution 279, which declares that the Insular Cases should be rejected as having no place in U.S. constitutional law. Moreover, in 2022, Justice Gorsuch called for the Supreme Court to squarely overrule the cases.
For many, rejecting the Insular Cases is a long-overdue reckoning …

In the history of new labor localism, city-level living wage ordinances emerging in the 1990s with Los Angeles leading the way have generally been understood as a second-best, limited antipoverty device designed to raise wage floors, with only indirect effects on organized labor. Drawing upon original archival materials, this Article offers an alternative reading of the history of the living wage in Los Angeles, showing how it was designed and operationalized as a proactive tool to rebuild union density and reshape city politics. The goal of the rule of law is to protect individuals from the arbitrary exercise of power. Democracy and human rights depend on the rule of law. But today the rule of law is under growing threat in the United States and around the world. Trends regarding rule-of-law protections are transnational in scope. The chapter provides a broad overview of occupational health and safety (OHS) regulation in advanced capitalist countries with a focus on the English-speaking world. It views OHS regulation through a political economy lens in which protective legislation is enacted and implemented against the imperative of a profit-driven system of production. The chapter provide examines the historical development of OHS regulation beginning with the rise of industrial capitalism leading up to modern OHS regimes that increasing embrace mandated partial self regulation. George Floyd's tragic death not only sparked numerous nationwide protests decrying the continued violence against Black people, but also resurrected conversations around the complicity of Asian Americans in Black oppression. Just as officer Tou Thao, a Hmong American, stood idly by while a white officer stepped on Floyd's neck, many Asian Americans have taken positions that run contrary to policies that foster inclusion, or what may be termed "integrative egalitarianism" -- the idea that "governmental programs . . . designed to overcome arbitrary inequalities stemming from accidents of birth are a worthwhile investment in society's future."

The Samuels-Buchanan Correspondence And The Lost Opportunity For A Positive Public Choice Scholarship, Luke Petach

This article revisits the debate between James Buchanan and Warren Samuels over Miller v. Schoene (1928). The initial court case—concerning the rights of government in the face of conflicting private interests—and subsequent debate between Buchanan and Samuels have important implications for the interrelations between legal and economic processes, the difference between a normative and positive theory of public choice, and the nature of public choice more generally. In published papers and private correspondence, the writings of Samuels reveal an alternative conception of public choice theory as a positive endeavor divorced from the free market normative implications of Buchanan’s work. เอกัตศึกษานี้มุ่งศึกษาปัญหาและความเหมาะสมในการกำหนดฐานความผิดอาญาสำหรับการหลอกลวงว่ามีวัตถุระเบิดอันอาจก่อให้เกิดความโกลาหล สืบเนื่องจากการกระทำในลักษณะหลอกลวงว่ามีระเบิดหรือขู่วางระเบิดตามกฎหมายไทยไม่ได้ถูกบัญญัติไว้เป็นการเฉพาะ แต่มีบทบัญญัติหลักที่ใช้บังคับคือ ประมวลกฎหมายอาญา มาตรา 384 ซึ่งอยู่ในภาคลหุโทษ มีระวางโทษจำคุกไม่เกินหนึ่งเดือน หรือปรับไม่เกินหนึ่งหมื่นบาท หรือทั้งจำทั้งปรับ การกำหนดโทษทางอาญาตามมาตราดังกล่าวจึงไม่สอดคล้องแก่ความร้ายแรงของการกระทำความผิดที่อาจก่อให้เกิดความโกลาหลแก่สังคมได้ จากการศึกษาพบว่า เมื่อเทียบกับความร้ายแรงของการหลอกลวงว่ามีระเบิดหรือขู่วางระเบิดซึ่งก่อให้เกิดความแตกตื่นตกใจแก่ประชาชนหรือถึงขั้นเกิดการบาดเจ็บหรือเสียชีวิต ประมวลกฎหมายอาญา มาตรา 384 ไม่สามารถป้องกันและยับยั้งการกระทำความผิดดังกล่าวได้ อีกทั้งจากการเปรียบเทียบกับกฎหมายของต่างประเทศ ได้แก่ ประเทศสหรัฐอเมริกา ประเทศอังกฤษ และประเทศฝรั่งเศส พบว่าทั้งสามประเทศมีบทบัญญัติความผิดอาญาที่เกี่ยวข้องกับการหลอกลวงว่ามีระเบิดไว้เป็นการเฉพาะและจัดเป็นอาชญากรรมที่มีความร้ายแรงจึงมีอัตราโทษที่ค่อนข้างสูง ดังนั้น เอกัตศึกษาฉบับนี้จึงเสนอให้กำหนดฐานความผิดอาญาสำหรับการหลอกลวงว่ามีวัตถุระเบิดอันอาจก่อให้เกิดความโกลาหลขึ้นมาใหม่ เพื่อแก้ไขปัญหาความแตกต่างของโทษทางอาญาสำหรับการกระทำความผิดอย่างเดียวกันในการหลอกลวงว่ามีระเบิดและปัญหาเรื่องสัดส่วนการลงโทษที่ไม่สอดคล้องกับความร้ายแรงของการกระทำความผิด

History has lessons to teach, and lawyers can learn from and use history in ways other than by cherry-picking from it. This Article contends that, while American history may be vexed, progressive lawyers can fully embrace history and hold it up into the light for consideration, all in service of progressive ends.

اعطت الدراسات التاريخية في العصور الاسلامية وخاصة العصر العباسي (132-656هـ) دورا مهما للجوانب العلمية خاصة وان الرسالة الاسلامية وقع على عاتقها نشر الثقافة العربية الاسلامية وتعاليم الدين الاسلامي ضمن الاراضي التي فتحها السلمون ومن ضمنها المشرق الاسلامي وخاصة مدينة ساوة التي تقع بين الري وهمذان والتي سكنها العديد من علماء العرب والمسلمين ومنهم من مر بيها وجعل منها محطة للتنقل بين الري وهمذان ,وقد اشتهر العديد من العلماء وحملوا اسم مدينة ابهر ومنهم:الحارث بن عبيد الساوي الصوفي (ت186هـ)ومحمد بن امية بن ادم بن مسلم القرشي الساوي الراوي والمحدث(ت226هـ), ويوسف بن اسماعيل بن يوسف,ابو يعقوب الساوي الصوفي(ت346هـ) الذي كان ينتقل مابين …

أحتلتْ الفِلِبِّين موقعاً إستراتيجياً مهماً بالنسبة لليابان, وغدتْ الهيمنة عليها ضروري لمواصلة حركة التوسع الياباني عند نشوب الحرب العالية الثانية، إذ عكستْ خصوصيات الموقع الإستراتيجي والاقتصادي في جزر المحيط الهادئ وبلدان جنوب شرق آسيا، أهمية الأثر الذي تسعى اليابان لشغله، بهدف الاستحواذ على مقدرات تلك المنطقة. كما كشفتْ عن احد الأسباب الرئيسة لسعي الولايات المتحدة الأميركية لمنافسة اليابان من أجل الحصول على مصادر المواد الخام والأسواق الكبيرة ذات الكثافة السكانية والاستهلاكية العاليتين، وهو ما حول بلدان جنوب شرق أسيا عموماً؛ والفِلِبِّين على وجه الخصوص إلى منطقة صراع على النفوذ بين اليابان والولايات المتحدة الأميركية.

يتناول هذا البحث، دراسة تاريخية عن المدارس التي ذكرها صاحب كتاب المنتخب من السياق لتاريخ نيسابور للصريفيني (ت641هـ/1243م)، حيث شهدت مدينة نيسابور في العصور الإسلامية تطوراً علمياً وفكرياً، ومنها المدارس المختلفة والمتنوعة التي بناها وأسسها العلماء والأمراء وكبار رجال الدولة.
وكتاب المنتخب من السياق، هو عبارة عن كتاب تراجم لأبرز علماء نيسابور، ويحتوي على معلومات مختلفة ومقتضبة عن مدارسها وذلك من خلال تراجم أولئك العلماء.
وفضلاً عن ذلك فأن هذا الكتاب، يعد ثروة علمية تراثية كبيرة لما يحتويه من معلومات مهمة ومتنوعة عن الحركة العلمية والثقافية والفكرية لمدينة نيسابور، والمدن الإسلامية الأخرى.
