Military Medical Malpractice: Remedies For The Overseas Dependent, Jane Louise Stratton
UC Law Journal
Military dependent victims of medical malpractice committed by armed forces personnel in the United States may sue the federal government for damages under the Federal Tort Claims Act. By statutory wording and judicial interpretations this remedy is denied dependents living abroad and recovery is limited to an administrative claim under the Military Claims Act. The author discusses the development of this legal inequity, considers its present application and offers suggestions for legislative correction.

Demanding Human Rights: A Change In The World Legal Order, Eric Lane

President Carter's recognition of universal standards of human rights, and his formulation of a foreign policy at least partially based on such recognition, has been the object of both foreign and domestic criticism, which at first glance'appears inexplicably severe. In the context of the present world legal order, however, the administration's expressed intention to pursue a policy directed toward a worldwide guarantee of human rights represents a potentially radical departure from the legal tenets which have governed world political interaction for the last 300 years.

The Right Reverend William Stubbs, D.D. (1825-1901), was the Anglican Bishop of Oxford, sometime Regius Professor of Modern History at Oxford, and a scholar of considerable repute. His Constitutional History of England was, until quite recently, the standard work in the field, and his editions of texts for the Rolls Series leave no doubt that he spent long hours ·with basic source material. Frederic William Maitland, M.A. (1850-1906), was an agnostic, the Downing Professor of the Laws of England at Cambridge, and a scholar whose reputation during his life was perhaps not so wide as Stubbs' but whose work commanded …

Reconstruction has variously been termed "repressive. . . uncivilized" and "a sordid time" as well as "a noble experiment." Reflected in those judgments of the era is the dispute over the effects of Reconstruction. To be more correct, one might say that there has been much conjecture in determining what, in fact, Reconstruction was. Questioned also has been the role of the black man during the period; much of what he did, or was responsible for, has, like Reconstruction itself, been subject to many and varied accounts and evaluations. On January 22, 1973, the United States Supreme Court ruled in Roe v. Wade' that the Texas criminal abortion statute, which proscribed all abortions except "for the purpose of saving the life of the mother,' 'violated the constitutional right of privacy. Justice Blackmun, delivering the opinion of the Court, declared that the concepts of personal liberty and restrictions on state action provided by the fourteenth amendment supported a right of privacy "broad enough to encompass a woman's decision whether or not to terminate her pregnancy."'
