Remedying The Insular Cases: Providing Tribal Sovereignty To Unincorporated Territories To Ensure Constitutional Rights For All U.S. Nationals And Citizens, Allison Ripple
William & Mary Bill of Rights Journal
This Note will focus on the Supreme Court’s decisions in the Insular Cases to demonstrate the origins of denying jus soli citizenship to those born in unincorporated territories and to analyze its direct contradiction to the Fourteenth Amendment and other Supreme Court decisions. It will argue that the Court’s decisions in the Insular Cases were influenced by colonial rule and rooted in racism. Furthermore, this Note will argue that because of these influences, the continued application of the Insular Cases by Congress and the Supreme Court to deny constitutional rights for U.S. nationals and citizens born in unincorporated territories violates …

Residual Pulmonary Vascular Obstruction Following Mechanical Thrombectomy For Submassive Pulmonary Embolism: A Single-Center Analysis, Brian Stegman, Thom G. Dahle, Wade Schmidt, Jacob R. Dutcher, Tanya Glenz
Articles
Background:
Residual pulmonary vascular obstruction (RPVO) following pulmonary embolism (PE) is associated with residual dyspnea, recurrent venous thromboembolism, and chronic thromboembolic pulmonary hypertension. Historically, acute PE treated with anticoagulation alone results in high rates of significant RPVO. Contemporary treatment of submassive PE often involves catheter-based interventions, including mechanical thrombectomy (MT), although their relation to RPVO is not characterized. In this study, we aimed to evaluate the rate of greater than or equal to 10% RPVO in patients treated with MT.
Methods:
Twenty consecutive patients with submassive PE in a single center underwent MT and subsequent planar ventilation/perfusion scintigraphy scan at …

From The Pen Of The Secretary: Latter-Day Saint Women And Relief Society Minute Books, 1868–1889, Mckall Erin Ruell
All Graduate Theses and Dissertations, Fall 2023 to Present
In 1868, the Church of Jesus Christ of Latter-day Saints (also known as the Mormon church) re-organized their women's organization, the Relief Society. The secretaries of each local ward or congregation of the Relief Society in Utah kept a record of their meetings in their own minute books. These records have largely been neglected by scholars and much can be learned about nineteenth-century Latter-day Saint women through their pages. This thesis examines Relief Society minute books from Cedar City, Fillmore, Meadow, Holden, Spring Lake, Provo, Salt Lake City, and Millville, Utah, looking specifically at Latter-day Saint women's discourse, testimonies, and …

Specialized Recreation, Spatial Behavior, And Ecological Implications In The Nature Reserve Of Orange County, Ca, Jake Van Deursen
All Graduate Theses and Dissertations, Fall 2023 to Present
A widespread surge in park and protected area (PPA) visitation strikes managers with the imminent challenge of preserving ecological conditions and maintaining accessibility in the open spaces that are a fundamental component to the health and wellness needs of society. In the field of recreation resource management, recreation specialization, the selective channeling of interests and abilities into a specific recreational activity, has contributed to comprehensive understandings of recreation behavior, site preference, management perceptions and conservation support. Contributing to historical understandings of specialization can inform recreation planning on the diversity of uses occurring in urban-proximate PPAs. Survey data providing information on …
A Revisionist History Of Products Liability, Alexandra D. Lahav
A Revisionist History Of Products Liability, Alexandra D. Lahav
Michigan Law Review
Increasingly courts, including the Supreme Court, rely on ossified versions of the common law to decide cases. This Article demonstrates the risks of this use of the common law. The main contribution of the Article is to demonstrate that the traditional narrative about early products law—that manufacturers were not liable for injuries caused by their products because the doctrine of privity granted producers immunity from suit by the ultimate consumers of their goods—is incorrect. Instead, the doctrinal rule was negligence liability for producers of injurious goods across the United States in the nineteenth century. Courts routinely ignored or rejected privity …

Contra Radicalism Through The Interpreting Verse Of Jihad (Case Study On Nu Online Platform), Kholifah Rahmawati, Heriyanto Heriyanto
Journal of Terrorism Studies
This research attempts to map counter-radicalism in religious-based efforts carried out by a religious organization through digital platforms. With a virtual ethnographic model that focuses on text analysis, it is known that NU Online has carried out counter-radicalism through a religious interpretation approach. By targeting jihad verses, counter-radicalism is done in three ways, namely, deconstruction of the meaning of jihad, reconstruction of the meaning of jihad, and counter-narrative of jihad verses with peace verses. Apart from that, NU Online is also increasing its influence in the digital space by strengthening its narrative and identity as a moderate group with national …

Mixture priors provide an intuitive way to incorporate historical data while accounting for potential prior-data conflict by combining an informative prior with a noninformative prior. However, prespecifying the mixing weight for each component remains a crucial challenge. Ideally, the mixing weight should reflect the degree of prior-data conflict, which is often unknown beforehand, posing a significant obstacle to the application and acceptance of mixture priors. To address this challenge, we introduce self-adapting mixture (SAM) priors that determine the mixing weight using likelihood ratio test statistics or Bayes factors. SAM priors are data-driven and self-adapting, favoring the informative (noninformative) prior component …

Glutamine is a critical metabolite for rapidly proliferating cells as it is used for the synthesis of key metabolites necessary for cell growth and proliferation. Glutamine metabolism has been proposed as a therapeutic target in cancer and several chemical inhibitors are in development or in clinical trials. How cells subsist when glutamine is limiting is poorly understood. Here, using an unbiased screen, we identify ALDH18A1, which encodes P5CS, the rate-limiting enzyme in the proline biosynthetic pathway, as a gene that cells can downregulate in response to glutamine starvation. Notably, P5CS downregulation promotes de novo glutamine synthesis, highlighting a previously unrecognized …

Background and objective: Tumor treating fields (TTFields) therapy have emerged as a potentially effective treatment for various malignancies by delivering low-intensity, intermediate-frequency electrical fields that disrupt many processes inside cells, resulting in the interruption of cell division in cancer cells. Additionally, TTFields therapy has been found to be synergistic with existing therapeutic approaches. In this review, we provide an introduction and background to the primary mechanisms of TTFields and discuss the emerging preclinical and clinical outcomes of this novel cancer treatment technology.
Methods: We performed a literature search on PubMed, ClinicalTrials.Gov, and Google Scholar using the terms 'TTFields' and 'cancer'. …
The Social Determinants Of Health And Genocide: Towards A Public Health Integrated Framework Of Genocide And Mass Violence, Sian Persad, Cheng Xu
The Social Determinants Of Health And Genocide: Towards A Public Health Integrated Framework Of Genocide And Mass Violence, Sian Persad, Cheng Xu
Genocide Studies and Prevention: An International Journal
This paper makes a normative argument about transformations of public health as a necessary condition required in any transitional justice process. We seek to bridge the gap between the fields of genocide and public health to understand the recursive relationship between genocide and the social determinants of health. We show that structures and institutions established during genocide create enduring impacts on the public health outcomes of victim and survivor groups even after the ousting of the original perpetrators. Our comparative analysis of the Rwandan Genocide and the colonial genocide of Indigenous communities in Canada surveys the available public health literature …

Broadcast History Gaps When Archival Material Exists: Inserting Peg Lynch And Ethel And Albert Into Sitcom History, Lauren Bratslavsky
Journal of 20th Century Media History
Lucy and Desi. Burns and Allen. Ozzie and Harriet. Ethel and Albert? The first three television couples tend to be the familiar husband-wife pairs that typify American 1950s sitcoms. These characters and their namesake programs, along with the Andersons in Father Knows Best and the Cleavers in Leave it to Beaver, are credited as templates for the domestic sitcom genre, where the narrative logic oscillates between morality lessons and outlandish plots to escape domestic life. When we study or reminisce about 1950s television, Ethel and Albert and their namesake program do not readily come to mind. However, the popularity …

Collaborative Policing For Handling Communalconflicts (Case Study: Conflicts Betweenpapuans And Yogyakartans), Tagor Hutapea
International Review of Humanities Studies
In this study, there are 2 (two) groups of conflicting citizens, namely the Papuans living in Yogyakarta which consist of students and working residents, and Yogyakartans, that is several ethnic groups other than ethnic Papuan. This study uses a qualitative approach and the paradigm of constructivism. The root of the conflicts is the Papuans’ perception of their historical past as well as cultural elements such as poverty, lack of education, and lifestyle. The triggers of conflict is the Papuans’ negative lifestyles, namely frequently get drunk, eating without paying the bill, breaking traffic rules, and always shouting “merdeka” (meaning independence) when …
Interrogating Households In Anticipation Of Disasters: The Feminization Of Preparedness, Chika Watanabe, Celie Hanson
Interrogating Households In Anticipation Of Disasters: The Feminization Of Preparedness, Chika Watanabe, Celie Hanson
Critical Disaster Studies
It is now a maxim among scholars and policy-makers alike that disaster preparedness needs to involve community-based approaches in order to be effective. These include preparedness strategies in the household. But how do disaster preparedness policies and public discourses define “the household” in the first place? In this article, we explore how particular gendered notions of the household are reproduced in disaster preparedness policies and activities in Japan and the UK. Drawing on historical and cross-cultural analyses, we suggest that household preparedness efforts place the burden of labor on people coded as women—a phenomenon we call “the feminization of preparedness.” …

Emerging evidence indicates a previously unrecognized, clinically relevant spectrum of abnormal aldosterone secretion associated with hypertension severity. It is not known whether excess aldosterone secretion contributes to hypertension during pregnancy. We quantified aldosterone concentrations and angiotensin peptides in serum (using liquid chromatography with tandem mass spectrometry) in a cohort of 128 pregnant women recruited from a high-risk obstetrics clinic and followed prospectively for the development of gestational hypertension, pre-eclampsia, superimposed pre-eclampsia, chronic hypertension, or remaining normotensive. The cohort was grouped by quartile of aldosterone concentration in serum measured in the first trimester, and blood pressure, angiotensin peptides, and hypertension outcomes …

In an era where the erosion of cultural heritage is increasingly prevalent, there exists a critical imperative to explore and implement innovative methods for the preservation and revitalization of cultural identities, as exemplified by the urgent situation in Bujumbura, Burundi. Central to this study is the exploration of innovative digital methodologies for archiving a wide spectrum of cultural artifacts, including both notable and everyday heritage elements, in Bujumbura. Traditional approaches to biographical and historical profiling have predominantly focused on official records and significant events, often neglecting the richness of personal experiences and everyday interactions that substantially shape cultural identities. To …

Ex Post Facto Study Of The Effect Of Generational Cohort And Employment Tenure On Employee Satisfaction Of United States Federal Employees, Justin Lee Reed
Ex Post Facto Study Of The Effect Of Generational Cohort And Employment Tenure On Employee Satisfaction Of United States Federal Employees, Justin Lee Reed
Electronic Theses and Dissertations
Generational differences and the socialization process within the workplace are often seen as opposing theoretical approaches when attempting to explain or understand employee satisfaction. Generational cohort theory asserts that the perceptions and outlooks developed during an individual’s formative years are based on historical events and location, which become instrumental in how they see and interact with the world around them. Social identity theory asserts that exposure and inclusion into a group or organization creates acceptance for the individual and this assists in structuring their outlook. The purpose of this quantitative ex post facto study was to determine if and to …

The most elite and scarce of all U.S. legal credentials is serving as a Justice on the U.S. Supreme Court. A close second is clerking for a Justice. A Court clerkship is a prize as well as a ticket to future success. Rich accounts of the experience fill bookshelves and journal pages. Yet the public lacks a clear story about who wins this clerkship lottery. Original analysis of forty years of clerkships tells that story. New datasets detail clerks’ paths from college to the Court to careers. Research shows that Court clerkships favor educational pedigree and status over pure achievement. …

Exemplary Centre And "Terra Incognita"; Excursions, Diplomacy, And Appropriation Of Colonial Knowledge In Belu, Timor, Hans Hägerdal
Wacana, Journal of the Humanities of Indonesia
The article analyses early European knowledge about Belu, a historical region in Central Timor which, although “belonging” mostly to the Dutch colonial sphere, still had a position of cultural-ritual centrality on a Timor-wide level. Before the mid-nineteenth century, the region was, from a Dutch point of view, largely unknown in terms of political hierarchies, social structure, and economic opportunities. However, three officially commissioned authors, A.G. Brouwer, W.L. Rogge, and H.J. Grijzen, wrote extensive reports about Belu in 1849, 1865, and 1904, in which they attempted to understand local society and the opportunities they offered the colonial state. The article explores …
A Case Study In The Ethics Of Queer Oral History, Mackenzie Harrison
A Case Study In The Ethics Of Queer Oral History, Mackenzie Harrison
International Journal of Undergraduate Research and Creative Activities
During work on a queer archival project at a small liberal arts university, tension arose when an oral history participant unintentionally misnamed and misgendered a transgender individual. As this case study demonstrates, the project team had to balance the ethics of oral history, which discourage the editing of recordings, with queer ethics that view this type of misnaming as actively harmful. The team created their own solution, taking into account general guidance regarding third-party naming, trans-inclusivity in archives, and the overall goals of the project.
Traces Of An Imperial Japanese Imaginary: Positioning The Japanese & Okinawan Settlements Of Southern Alberta, Canada, 1910s-1930s, D Aoki
School of Law, Humanities and Social Sciences
This article develops a case study of two settlements of Japanese colonists—one ethnically Japanese, and one Okinawan—in the southern region of the Canadian province of Alberta between the 1910s and 1930s. It explores these communities’ aims and institutional structures to propose that these shaped membership in the trans-Pacific imperial Japanese imaginary, one that—in the navigation of dual Japanese and British Dominion imperial loyalties—sought to promote Japanese racial progress and cultivate the Japanese identity of future generations. It adds to scholarship on imperial Japan’s projection into North America through its diaspora. Highlighting southern Alberta’s Japanese communities, a distinctive opportunity is opened …

"Lifting As We Climb": A Rhetorical Analysis Of The Speeches Of Hallie Quinn Brown, Natonya Listach
Electronic Theses and Dissertations Archive
The accomplishments of Hallie Quinn Brown can be separated into segments of her teaching career, her experiences as a public speaker and elocutionist, and her work as an activist. She successfully educated various students, spoke before dignitaries, and moved her audiences to tears on multiple occasions. She fought for civil and women’s rights until her death at 100. Yet, while her membership and participation in specific organizations are not disputed, her importance, significance, and impact on African American rhetoric are relatively ignored. This dissertation analyzes Brown’s speeches and (re)introduces Brown to the study of rhetoric. By examining Brown’s speeches through …
