It is important to distinguish the individual interests in domestic relations from the social interest in the family and marriage as social institutions. This social interest must play an important part in determining what individual interests in such relations are to be secured, how far they are to be secured and how they are to be secured. Preliminary stock subscription agreements are no longer in general use. In the early part of the last century they were a popular means of organizing corporations, but the more modern general statutes of incorporation which now exist in all of the states have made it less convenient to resort to such methods of organization. In some instances they are still necessary, however. Whenever the organization of a quasi-public or cooperative undertaking is contemplated, they are not only convenient, but almost indispensable. The Form of the Summons Under the Recent Michigan Judicature Act - It would be rather remarkable if in revising such a large portion of the statutes as was undertaken by the Commission on Revision and Consolidation of Statutes of the State of Michigan, appointed in 1913, which reported to the legislature the recently enacted Judicature Act (Public Acts of Michigan, 915, § 314), some ambiguity or uncertainty were not to appear in the revision. Legislative Power to Restrict Freedom of Labor Contracts -The struggle between the police power of the legislature and the nineteenth century idea of due process of law continues unremittingly. That increasing social necessities and a more comprehensive and perfect conception of justice have resulted in recent years in restricting the "due process" clauses in federal and state constitutions to their historically and logically more correct meaning and scope there can be no doubt. Due to the fact that the Supreme Court of Missouri has recently decided several cases involving questions as to the use of the extraordinary legal remedy of the writ of certiorari, and to the further fact that this ancient remedy is governed by common law principles, this study of the Missouri decisions pertaining to certiorari has been undertaken.
