Constitutional Law-Due Process-Search And Seizure-Use In State Courts Of Evidence Obtained Illegally, Howard N. Thiele, Jr.

Michigan Law Review

Petitioner was convicted of bookmaking under the anti-gambling laws of California by the use of evidence obtained through unreasonable search and seizure and through disclosures petitioner made when purchasing a federal wagering tax stamp. While petitioner and his wife were away, police concealed a microphone in the hall of his home, later moving it to the bedroom and finally to a bedroom closet. The instrument was connected to a receiver in a neighboring garage where other officers monitored all conversations for more than a month. Petitioner exhausted all state remedies in his attempt to have the evidence so obtained declared …

Municipal Corporations-Zoning-Validity Of Ordinances Excluding Residences From Industrial Areas, Judson M. Werbelow S.Ed. Apr 1956

Municipal Corporations-Zoning-Validity Of Ordinances Excluding Residences From Industrial Areas, Judson M. Werbelow S.Ed.

Michigan Law Review

Plaintiff purchased undeveloped land located in defendant municipality, intending to construct dwelling houses thereon. At the time of plaintiff's purchase, the land was zoned for industrial use, but the applicable ordinance did permit use of the land for residential as well as industrial purposes. Defendant municipality, a town of about 9,000 persons, had experienced a minimum of industrial growth and the possibility of future industrial development was slight. Shortly after the plaintiff had made his purchase, defendant municipality amended the applicable zoning ordinance to prohibit the use of plaintiff's land for residential purposes. However, the ordinance did permit the presence …

Wolff-Bloch V. Jerusalem District Assessing Officer, Alfred Witkon, Yoel Sussman, Shneor Zalman Cheshin

Translated Opinions

The appellant, a dentist who had travelled to the U.S.A., and had spent 10 weeks there studying the latest developments in her profession, claimed the expenses so incurred by her as a deduction for purposes of income tax on the ground that they were incurred "in the production of income." The Assessing Officer refused to allow the deduction and this decision was upheld by the District Court.

Held, allowing an appeal (Cheshin D.P. dissenting), that the expenditure incurred by the appellant was incurred for the purpose of preserving "an existing asset" and could properly be deducted.

Proposed Procedure For Administering Heart Cases Under The Washington Industrial Insurance Act, Ivan C. Rutledge Mar 1956

Proposed Procedure For Administering Heart Cases Under The Washington Industrial Insurance Act, Ivan C. Rutledge

Washington Law Review

Recent and authoritative medical investigations have convinced qualified cardiologists that the great majority of cardiac patients can perform productive labor without physical harm to themselves. Despite the assurance of cardiologists, many industrial concerns are reluctant to employ workmen suffering from cardiac disorders due to fear of increased industrial insurance costs. The resultant nonemployment of these patients when otherwise employable not only creates needless despair for themselves and their families, but it deprives the industrial community of many skills developed over long years of training. It is the purpose of this article to review the Washington Industrial Insurance Act to determine …

Regulation Of Business - Fair Trade Acts - Availability Of Injunction Against Nonsigner's Inducing Breach Of Fair Trade Agreement, William R. Jentes S.Ed. Mar 1956

Regulation Of Business - Fair Trade Acts - Availability Of Injunction Against Nonsigner's Inducing Breach Of Fair Trade Agreement, William R. Jentes S.Ed.

Michigan Law Review

Plaintiff manufacturer had extensive agreements with its distributors under the Michigan Fair Trade Act. The circuit court enjoined the defendant, who was not a party to any of these contracts, from inducing the plaintiff's distributors to sell products to the defendant below the agreed fair trade price. On appeal, held, reversed, three justices dissenting. Defendant is privileged to induce the breach of a fair trade agreement which restricts his business opportunities and is contrary to the state's policy against the enforcement of the nonsigner provision of its fair trade law. Argus Cameras, Inc. v. Hall of Distributors, Inc., …
