Retirement Communities: The Nature And Enforceability Of Residential Segregation By Age, Mary Doyle

Michigan Law Review

Although age segregation in retirement communities can be established in a variety of ways, the Article focuses primarily on age-restrictive zoning ordinances, the method most directly involving governmental action. The Article first considers those persons adversely affected by age-restrictive retirement communities and suggests that potential plaintiffs may be divided into three classes-neighboring property owners whose land values are affected by the establishment of a retirement community, those excluded from such a community solely by virtue of ·their age, and those excluded or potentially excluded because of the age of persons with whom they choose to live. Next, the constitutional arguments …

Economic, Medical And Legal Aspects Of The Age Discrimination Laws In Employment, Irving Kovarsky, Dr. Joel Kovarsky Oct 1974

Economic, Medical And Legal Aspects Of The Age Discrimination Laws In Employment, Irving Kovarsky, Dr. Joel Kovarsky

Vanderbilt Law Review

There is speculation that many colleges and universities will be hard hit in the near future by the EEOC because of sex discrimination. It can also be anticipated that the institutions of higher learning will soon be faced with many charges of age discrimination . Because of the limited funds available and the attitudes of some administrators, older employees who find it difficult to move to other jobs are given only small wage increases. This failure to match the cost of living of older employees while younger and more mobile members fare better proportionately may well be a sign of …

Will Interviews, Young Family Clients And The Psychology Of Testation, Thomas L. Shaffer Feb 1969

Will Interviews, Young Family Clients And The Psychology Of Testation, Thomas L. Shaffer

Journal Articles

The psychology of testation—the human content in will interviewing and consequent "estate planning"—is a mixture of attitudes toward death, attitudes toward property, and attitudes toward giving. This article is an attempt to examine this human content in five specific lawyer-client settings. The clients are young married couples with small children; they are people to whom death would seem remote, whose property is skimpy and largely devoted to dependent support, and whose attitudes toward giving are likely to be narrowly focused on members of their immediate families.

The "Estate Planning" Counselor And Values Destroyed By Death, Thomas L. Shaffer Jan 1969

The "Estate Planning" Counselor And Values Destroyed By Death, Thomas L. Shaffer

Journal Articles

Most lawyers would like to know more about how clients feel in law-office encounters with death, property, and giving. The immediate source of experience and information should be psychology-research psychology as well as therapeutic psychology. However, psychology has not concerned itself with the substance of the law; what is usually called "law and psychology" as an interdisciplinary area of study is confined to border areas-insanity as a criminal defense, testamentary capacity, civil commitment to mental institutions. The task of developing psychological models which reach the substance of law itself, and the dynamics of lawyer-client relationships, is one psychologists have not …
