"A Nursing Home ... Not For My Folks!": Families Caring For Their Elderly At Home, Scott A. Bass, Richard Rowland

This booklet is the second in a series of reports about elderly issues. The first, entitled "The Elderly Have Spoken: Is Anybody Listening? The Impact of Fuel Costs on the Elderly," documented the impact of rising fuel costs on the elderly in Massachusetts. Each of the series reports seeks to capture the actual words, expressions, and feelings of elderly people and their loved ones. For the most part, the interviews were conducted by interviewers who are themselves 60 years old or older. We find that this age match provides greater insight and openness to the problems confronting the …

Advance Notice Of Plant Closings: Toward National Legislation, Joseph A. Cipparone

University of Michigan Journal of Law Reform

This article advocates the adoption of national legislation requiring advance notice for plants closed or relocated for ostensibly economic reasons. Part I discusses the magnitude of the plant closing problem, focusing upon the costs associated with such closings, the types of assistance available for terminated workers, and the inadequacies of current relief efforts. Parts II and III examine the arguments for and against requiring advance notice of plant closings, and conclude that such a requirement represents sound public policy. Part IV proposes a complete model advance notice statute. The model statute establishes minimum requirements for a viable advance notice system, …

Punitive Damages Under The Age Discrimination In Employment Act, George J. Wardwell

UC Law Journal

Although the Age Discrimination in Employment Act (ADEA) clearly authorizes an award of compensatory damages for pain and suffering resulting from age discrimination, it is less clear that an award of punitive damages is contemplated by the statute. This Comment reviews the judicial development of punitive damages under the ADEA. The Comment next examines whether the language of the Act, its similarity to other statutes, the availability of liquidated damages under the ADEA, or public policy requires that the courts be permitted to make awards of punitive damages. The Comment concludes that an award of punitive damages is appropriate under …

The Elderly Have Spoken: Is Anybody Listening? The Impact Of Fuel Costs On The Elderly, Scott A. Bass, Richard Rowland

This report contains the findings of a study carried out by the Gerontology Program at the University of Massachusetts Boston concerning the effects of the escalating fuel costs on the lives of the elderly who must pay for their own heat. Through the use of an interview format known as "modified critical incident" technique, a team of mostly elderly students spent several weeks during the winter of 1980 eliciting responses from more than 100 elderly individuals from throughout the greater Boston area. This article examines Michigan's new nursing home reform law, which has been hailed as "landmark legislation" and as a model for the entire country. Part I examines the past failures of nursing home regulation and the need for reform. Part II analyzes the law's key provisions. Part III examines the weaknesses of certain enforcement measures. The article proposes the following improvements: (1) extension of the law's protection to residents of homes for the aged; (2) greater access to patients by approved organizations; (3) adoption of nurse-patient ratios; (4) improvement of inspection procedures; and (5) allowance for patients or their representatives …

The main purpose of the present Article is to suggest a somewhat different theoretical and practical approach to structuring the living probate procedure. I shall characterize the procedure called for in the North Dakota act and in similar proposals as the Contest Model of living probate, in distinction to a Conservatorship Model that I shall advocate to be the better way.
