Race And Place: Geographic And Transcendent Community In The Post-"Shaw" Era, Lisa A. Kelly

Vanderbilt Law Review

In the Preface to Colored People, Henry Louis Gates, Jr., describes and explains for his daughter, Liza, communities characterized by race. Throughout his memoir, Professor Gates re- creates communities local and communities transcendent. In one passage, he insists that he is "from and of a time and place-Piedmont, West Virginia... slathered along the ridge of 'Old Baldie' mountain like butter on the jagged side of a Parker House roll." The geography of place, even within the small town of Piedmont, is central. Italian neighborhoods in the west, Irish neighborhoods up on "Arch Hill," wealthy white neighborhoods defined by the block …

The Family Franchise: Elderly Parents And Adult Siblings, Margaret F. Brinig Jan 1996

The Family Franchise: Elderly Parents And Adult Siblings, Margaret F. Brinig

Journal Articles

In this paper, I am going to concentrate on one family transition where we have established substantial legal barriers-that of emancipation. However, I will briefly allude to other "broken families," such as the divorcing family and the family divided by adoption.

As students of the family, we are preoccupied with divorce. We write about families in crisis and use the fabric of their lives worn thin and stretched to the breaking point to develop our ideas about what families are and even what they ought to be. In a way, of course, law teaching and the Socratic method drive us …

Race And Place: Geographic And Transcendent Community In The Post-Shaw Era, Lisa A. Kelly Jan 1996

Race And Place: Geographic And Transcendent Community In The Post-Shaw Era, Lisa A. Kelly

Articles

Race and Place is a narrative article, both fictional and true, dedicated to exploring the dual realities of a geographic and transcendent community in the context of the Supreme Court's recent decisions in Shaw v. Reno and Miller v. Johnson. The Court has allowed and affirmed constitutional challenges to districts drawn to empower African-Americans "with nothing in common but the color of their skin." The Article draws upon history, literature, political science, and law to critique the Court's assumptions concerning the challenged districts and to demonstrate the existence of African-American communities of interest which are both geographically bounded by …

Mandatory Occupational Retirement Savings : Towards A Program Design Agenda For Hong Kong, John Dixon Jan 1995

Mandatory Occupational Retirement Savings : Towards A Program Design Agenda For Hong Kong, John Dixon

Centre for Public Policy Studies : CPPS Working Paper Series

The dual purpose of this paper is:

• to provide a context for the Patten administration's latest, and perhaps its last, aged income-support system reform prescription in terms of possible policy goals, the broad spectrum of income support strategies available, and the internationally-recognised minimum standards for social security programs; and

• to set out a specific program design agenda related to program coverage, withdrawal contingencies, program financing and program administration that the Patten administration needs to address when developing its latest proposed aged income-support program.

Suicide, Life Course, And Life Story, Mike Jenuwine, Bertram J. Cohler Jan 1995

Suicide, Life Course, And Life Story, Mike Jenuwine, Bertram J. Cohler

Journal Articles

This article explores how a life-course perspective and narrative methodology can be used to study risk factors for late-life suicide. A life-course approach to aging and suicide requires consideration of age as both social and personal construction. “On-” and “off-time” events and their impact on adjustment are used to illustrate these social and personal constructions. Cohort, period, and historical events have potentially profound effects on risk for suicide, yet the study of these effects is difficult because they are so often confounded in longitudinal study. Lifelong personality characteristics that are not life-threatening in earlier life may be of greater risk …

Accrediting And The Sherman Act, Clark C. Havighurst, Peter M. Brody Oct 1994

Accrediting And The Sherman Act, Clark C. Havighurst, Peter M. Brody

Law and Contemporary Problems

The shortcomings of the Sherman Act as it relates to private accrediting are examined in order to assist courts in minimizing the anticompetitive features of accreditation and maximizing its procompetitive benefits. A lack of clear legal principles to guide factual analysis and to facilitate the granting of summary judgment in appropriate cases has led to unfocused and protracted litigation.

Finite Horizons: The American Family, Margaret F. Brinig Jan 1994

Finite Horizons: The American Family, Margaret F. Brinig

Journal Articles

In the summer of 1992, while I was reading and thinking about Martha Minow's latest book, I was struck with my double role as a responsible adult. Vacationing in the north woods of Wisconsin with my mother, I suddenly needed to care for her as well as my own small children. Generational connections, important before, swelled hugely in crisis. As I caught my breath between hospital runs and kids' activities, I was thankful that I had received so much from my parents during my childhood. And I resolved to rethink the relationships between parents and children, adults and elderly.

Policy …
