Economic And Legal Aspects Of Japanese Fisheries Regulation And Control, Salvatore Comitini Oct 1967

Economic And Legal Aspects Of Japanese Fisheries Regulation And Control, Salvatore Comitini

Washington Law Review

Japan is unique among the so-called free-market economies in that over 85 percent of all fishing operations is regulated and controlled by law. This distinguishing characteristic of Japanese fishing operations has led some observers to infer that it may be the most signficant factor in the seemingly "comparative advantage" which Japan enjoys over Western nations in high seas fishing. However, the regulations, as they have developed, are not as rigidly imposed and inflexible as those under a centrally planned economy such as that of the Soviet Union. Nor are the regulations quite as limited—in the economic sense of that term—as …

From Dust To Dust? A Legislator's View Of California's Coming Water Crisis, Thomas H. Kuchel Jun 1967

From Dust To Dust? A Legislator's View Of California's Coming Water Crisis, Thomas H. Kuchel

San Diego Law Review

Fortunately, there exists a spectrum of possibilities for supplying the projected requirements for additional water. The gravity of the situation dictates that all of these possibilities be examined in detail. We must learn to control and abate pollution where it has despoiled water sources. We must develop and improve our techniques of waste-water reclamation, since, although we have only a fixed amount of water, by reuse we might multiply the supply many fold. We must continue the development of techniques for desalination of sea water and brackish water. We must continue our research into weather modification in the hope that …

Constitutionality Of The Voting Provisions In The Seventeenth Amendment To The Washington Constitution, Anon Mar 1967

Constitutionality Of The Voting Provisions In The Seventeenth Amendment To The Washington Constitution, Anon

Washington Law Review

The seventeenth amendment to the state constitution provides Washington with one of the most restrictive property tax systems in the nation. Under its provisions the aggregate of tax levies upon real and personal property in any given taxing district may not exceed forty mills on the dollar of assessed valuation in any one year. Moreover, the forty mill limit may be exceeded only when three fifths of the electors voting authorize an excess levy. The amendment further provides that the election is not valid unless the number of persons voting constitutes not less than forty per cent of the total …

The Cold War And The Peaceful Settlement Of Disputes: The Relevance Of International Adjudication, Milton Katz

Duquesne Law Review

In the two decades since the end of World War II, American conduct, whether in the United Nations or the Organization of American States or outside them, alone or in alliance with others, has revealed a consistent pattern of behavior in regard to Soviet Russian or Communist Chinese expansionism. The United States has resisted attempts by the Soviet Union or Communist China to extend their dominion or sphere of control by force or threats of force, or by the support of force or threats on the part of others. If and when peacekeeping measures or measures of pacific settlement coincided …

Australian And American Water Allocation Systems Compared, Peter N. Davis Jan 1967

Australian And American Water Allocation Systems Compared, Peter N. Davis

Faculty Publications

Amid general plenty, local and regional shortages of water have appeared in the eastern United States.1 These shortages are largely the result of intense concentrations of water demand on the more important rivers-rivers which, for the most part, are heavily polluted This problem is heightened by the fact that the location of major population and industrial centers has only partially depended on availability of water supplies. In many areas, local surface and ground water supplies are inadequate and water must be imported to make up the deficit." Moreover, demands on water supplies for supplementary irrigation, for hydro-electric power, and for …

The Lawyer As A Negotiator: An Adventure In Understanding And Teaching The Art Of Negotiation, James J. White Jan 1967

The Lawyer As A Negotiator: An Adventure In Understanding And Teaching The Art Of Negotiation, James J. White

Articles

In the fall of 1965 we enlisted experience as a teacher in an experimental seminar called "The Lawyer as a Negotiator." We gave the students experience not by simulation but by making them negotiate with one another for their grades in the course. In this as in many other "experience" courses the teaching supplement consisted of readings and of classroom participation by the students and teachers. However the supplement differed from the standard trials and appeals or legal writing course in that a psychiatrist was a full partner in the teaching and in the discussion and analysis of the student …

Forward: A Symposium On Restitution, John P. Dawson

Vanderbilt Law Review

The editors of the Vanderbilt Law Review deserve praise for arranging this symposium on the neglected subject of Restitution, a great and growing area of our private law whose literature is extra-ordinarily meager. Partly because of this neglect by legal scholars, the practicing profession as a whole remains unaware of the range and variety of restitutionary remedies and the possibilities they offer for solving problems that are otherwise intractable. The volume of restitution cases reported in current advance sheets shows that courts and lawyers are learning to make use of restitution remedies, but the subject still inspires hesitation and diffidence, for …

Water And The National Welfare—Programs In Search Of A Policy, James A. Crutchfield Oct 1966

Water And The National Welfare—Programs In Search Of A Policy, James A. Crutchfield

Washington Law Review

It is no secret to residents of the western states that water is a matter of primary public concern. Land and water policies are deeply imbedded in the region, and the imprint of federal water projects on the economic geography of the West is plain to see. It is increasingly clear, however, that no coherent national policy, past or present, has emerged from the massive federal effort in the field. There is no lack of interest, planning, and expenditure on the supply and quality of water, and much progress has been made in definition and measurement of the factors that …

The Canada-United States Controversy Over The Columbia River, Ralph W. Johnson Aug 1966

The Canada-United States Controversy Over The Columbia River, Ralph W. Johnson

Washington Law Review

In a comprehensive study of the recent dispute between Canada and the United States over the Columbia River, Professor Johnson traces its history through the birth of the Harmon doctrine in 1898, the signing of the Boundary Waters Treaty in 1909, and the first Canadian claim to downstream benefits in the early 1950's. Against this background, he analyzes the negotiations and events—particularly the Canadian proposals to divert the Columbia into the Fraser, and to develop the Peace River instead of the Columbia—that culminated in the Columbia River Treaty in 1961. Before Canadian ratification of the Treaty, however, additional problems presented …
