Challenging Exclusionary Zoning: Contrasting Recent Federal And State Court Approaches, James C. Quinn
Challenging Exclusionary Zoning: Contrasting Recent Federal And State Court Approaches, James C. Quinn
Fordham Urban Law Journal
The zoning power, though based on the police power of the states, has traditionally been granted to local communities through various state enabling statutes. These enabling statutes permit local enactment of zoning ordinances only to the extent that they bear a substantial relation to the "health, safety, morals, or general welfare" of the community. With the migration of middle-class city dwellers to thc suburbs after World War II, zoning has become more than a means of maintaining the proper mix of land-use patterns in a community. Rather, in fear of overly rapid development and irreversible alteration of their community character, …

Land Use Law In Virginia
University of Richmond Law Review
In Virginia and throughout the United States, pressures have been building which are forcing the law of land use planning to a watershed in its development. In response, governments at all levels have been striving to find means of ensuring that the resulting change be in a direction that benefits the greatest number of their citizens. Likewise, the attorney practicing in this area of the law needs to recognize the possibility of fundamental changes, to understand the pressures precipitating an altered legal framework, and to appreciate the complex ramifications of his decisions involving questions of land use. Only through this …

Challenging Certification Of A Class Action: A Hypothetical, Robert G. Cutler, James P. Feeney
San Diego Law Review
This is intended to be an article for the lawyer whose client is suddenly confronted with one of these "Frankenstein monster(s) posing as a class action. Our objective is to set forth the arguments and methods available to counsel in seeking to prevent a class from being certified. In order to sharpen the analysis and arguments we will use a hypothetical class action as a model. Since most of the criticism and praise of the class action device has been focused on complaints filed under section (b)(3), observations will be directed primarily at that part of Rule 23. If, in …

Constitutional Allocation Of The War Powers Between The President And Congress: 1787-88, W. Taylor Reveley Iii
Constitutional Allocation Of The War Powers Between The President And Congress: 1787-88, W. Taylor Reveley Iii
Faculty Publications
For some time the international community has been keenly interested in the foreign uses to which America puts its military. The nature of these uses has traditionally been affected by the manner in which the Constitution divides the war powers between the President and Congress. This allocation of war-peace authority, in tum, is the product of a number of influences, among them the intentions of the Framers and Ratifiers for the text which they drafted and approved. Their war-power debates, as we shall see, have heavy international overtones. These debates have not been neglected, especially during America's recent involvement in Indochina. …

The Law Of The Sea: Alliances And Divisive Issues In International Ocean Negotiations, Judith Tegger Kildow
The Law Of The Sea: Alliances And Divisive Issues In International Ocean Negotiations, Judith Tegger Kildow
San Diego Law Review
Throughout history, the oceans have played a major role in geo-politics. nations states have depended on the seas for their economies, for political power and for military effectiveness. The critical importance of the oceans is once again reflected in national and international arenas. Freedom of the seas and resource management for the oceans have become two major issue areas, bringing some nations into conflict while creating new alliances between other states.
The Patrimonial Sea Or Economic Zone Concept, Andres Aguilar M.
The Patrimonial Sea Or Economic Zone Concept, Andres Aguilar M.
San Diego Law Review
On June 20th, 1974, the Third United Nations Conference on the Law of the Sea will open its second session at Caracas, Venezuela, for the purpose of dealing with the substantive work of the Conference, as stipulated in paragraph 4 of resolution 3067 (XXVIII), adopted by the General Assembly of the United Nations on November 16, 1973. It is worth recalling, briefly, that the decision to convene this Conference was adopted by the United Nations General Assembly on December 17, 1970, in resolution 2750 C (XXV), from which it is clearly apparent.
Developing Land-Locked States And The Resources Of The Seabed, Marin Ira Glassner
Developing Land-Locked States And The Resources Of The Seabed, Marin Ira Glassner
San Diego Law Review
This Article is an attempt to focus a beam of light on a relatively obscure facet of the seabed question, one which illustrates clearly the validity of Friedmann's thesis. In a comprehensive discussion of the transit trade of developing land-locked states, first written in the Fall of 1967, the present writer raised a question which could not be addressed at the time because it really constituted a separate study. It seems appropriate to pursue the quest for such a formula now.

Stranger In Our Midst: The Working Class Woman, Yvonne Van Der Klip Stam
Stranger In Our Midst: The Working Class Woman, Yvonne Van Der Klip Stam
IUSTITIA
Although some of the concrete goals of women's liberation such as adequate available day care for children are important to women of both the blue collar and middle classes, the philosophy expressed by the movement is not calculated to attract the working class woman. Two incomes may be increasingly necessary to the middle class family, and an increasing number of middle class women are now supporting their children alone, but the movement speaks of freeing women fiom child care to pursue a career, an idea which does not speak to a blue collar woman concerned with getting a job to …

How Federal Judicial Administration Came To Be The Way It Is, Robert A. Leflar
How Federal Judicial Administration Came To Be The Way It Is, Robert A. Leflar
Vanderbilt Law Review
Differences about how the business of federal circuit and district courts should be administered--as distinguished from how their cases should be decided--down through the years have presented a persistent conflict between an ideal of national uniformity and an effort to maintain local control over administrative details. In one sense this has been a contest between reformers who have sought increased efficiency in federal judicial administration and local judges whose rallying cry was judicial independence and whose personal interest was in continuing to run things as they were accustomed within their own little domains. Occasionally patronage was involved. This did not …
