The Jury As A Source Of Reasonable Search And Seizure Law, Ronald J. Bacigal
The Jury As A Source Of Reasonable Search And Seizure Law, Ronald J. Bacigal
Law Faculty Publications
The definition of a reasonable search has bedeviled the United States Supreme Court for some ninety years. Formal logic or legal reasoning assists the Court in tracing premise to conclusion, but does not alone suggest the initial premise. The Court's difficulty in fourth amendment cases, in general, lies in identifying the premise-the fundamental value which is embodied in this constitutional guarantee. The Court has recognized that this fundamental value, whatever it is, has an origin outside the language of the amendment, and the Court has considered sources such as history, popular consensus, natural law, and utilitarian balancing to find this …

The Pacific Northwest Electric Power Planning And Conservation Act-Solution For A Regional Dilemma, Henry M. Jackson
The Pacific Northwest Electric Power Planning And Conservation Act-Solution For A Regional Dilemma, Henry M. Jackson
Seattle University Law Review
For the past four decades, the Bonneville Power Administration(BPA) has played a singular and powerful role in developing the Northwest regional electric power system, and indirectly in the regional economy that system supports. The federal government's decision during the first half of this century to develop multi-purpose water resource projects led to the construction of many dams, most of them in the Western United States, most built since the mid-1930s, and most including hydroelectric generation. As we enter the 1980s, fundamental changes have occurred. Historically, BPA has had sufficient resources to sell power to any utility or other customer in …

Human Rights And The Helsinki Conference On Security And Cooperation In Europe, Jacqueline P. Granier
Human Rights And The Helsinki Conference On Security And Cooperation In Europe, Jacqueline P. Granier
Vanderbilt Journal of Transnational Law
Preparatory talks for the Conference on Security and Cooperation in Europe began in November 1972, in Helsinki, Finland. This final product of seven months of discussions, known as the Blue Book, served as the procedural manual for the Conference when it officially opened in July 1973. It contains recommendations on various aspects of the Conference including organization, agenda, participation, rules of procedure and financial arrangements.
The organizational section provides that the Conference be divided into three working sessions designated Stages I, II, and III. Stage I was a ministerial level meeting designed to open the Conference and allow for the …

Race And Sentencing Equality In Kentucky, Robert L. Hurley
Race And Sentencing Equality In Kentucky, Robert L. Hurley
Masters Theses & Specialist Projects
Disparity in sentencing felons based on racial considerations has long has been considered a problem for civil libertarians and scholars alike. Examining data gathered in Kentucky, this thesis addresses this issue through the application of recently developed methodological techniques. Utilizing an index of sentencing equality, this study shows that while differences do exist in black and white offender offense characteristics, these differences do not account for the variations in sentences rendered in cases of white as opposed to black felons. This exploratory research reviews and critiques previous research and provides evidence which should prove useful in resolving the problem of …
The United States And China: From Noncommunication To Diplomatic Relations, Mary Jeanne Patrick
The United States And China: From Noncommunication To Diplomatic Relations, Mary Jeanne Patrick
Masters Theses
After more than two decades of fundamental differences due to lack of direct diplomatic relations, the People's Republic of China and the United States are developing a harmonious working relationship. Friendly relations between these two major nations began to improve in 1972 during President Richard Nixon's visit to China that had been arranged by Henry Kissinger, Assistant for National Security Affairs.
The purpose of this thesis is to show that nations can overcome their negative stereotyped images with one another when their leaders will enter into effective communication.
Chapter I considers the historical aspects of the Sino-American relationship.
Chapter II …

A Sense Of Proportion And A Sense Of Priorities: Reflections On The Report Of The Task Force On Canadian Unity, J. Stefan Dupré, Paul C. Weiler
Articles & Book Chapters
The elegantly written Report of the Task Force on Canadian Unity is the most recent product of our constitutional reform industry. In many respects it is the most impressive. It deserves attention if for no other reason than the make-up of the group which produced it. The Task Force was composed of both men and women, politicians and scholars, persons with experience in the business community and in the union movement, and representatives of each of our far-flung regions. Its co-chairmen, Jean-Luc Pepin and John Robarts, are two of the most experienced and respected public figures in Canada. The Commissioners …
