Arbitration Under The Canada Labour Code: A Neglected Policy And An Incomplete Legislative Framework, James E. Dorsey
Arbitration Under The Canada Labour Code: A Neglected Policy And An Incomplete Legislative Framework, James E. Dorsey
Dalhousie Law Journal
Arbitration under the Canada Labour Code' is an elusive subject. There is not independent text on law in the federal jurisdiction, where grievance arbitration is a neglected policy operating within an imcomplete legislative framework. The lack of prominence of a federal body of arbitral law and practice is readily exemplified by the fact that the federal law influence is frequently ignored or overlooked. A pertinent example is a 1976 case involving British Columbia Telephone Company and the Federation of Telephone Workers of British Columbia in which an arbitration board of three prominent members of the bar proceeded pursuant to the …

Post World War Ii Multilateral Treaty-Making: The Task Of The Third United Nations Law Of The Sea Conference In Perspective, John King Gamble Jr.
Post World War Ii Multilateral Treaty-Making: The Task Of The Third United Nations Law Of The Sea Conference In Perspective, John King Gamble Jr.
San Diego Law Review
This Article examines the potential obstacles that must be overcome before the creation of a global law of the sea treaty. The author argues that, even if the Conference proceeds quickly to approve a text, the treaty may never enter into force, because it will be very difficult and time-consuming for the new treaty to be accepted by a majority of the States in the world. The author reviews the various problems likely to be encountered, including signatures not followed by required ratifications, crippling reservations, and States' reluctance to be party to treaties containing dispute settlement clauses. The author examines …

Police Use Of Cctv Surveillance: Constitutional Implications And Proposed Regulations, Gary C. Robb
Police Use Of Cctv Surveillance: Constitutional Implications And Proposed Regulations, Gary C. Robb
University of Michigan Journal of Law Reform
This article evaluates the constitutionality of CCTV "searches." Part I discusses the present uses being made of closed circuit technology and evaluates the merits of the CCTV surveillance system. The critical policy trade-off is the system's effectiveness in combatting crime against the resulting loss of privacy to individual citizens.
Part II considers the constitutional implications of CCTV use in terms of three major doctrines: the Fourth Amendment prohibition against "unreasonable searches and seizures"; the constitutional right of privacy; and the First Amendment guarantees of free speech and association. This part briefly summarizes the state of the law concerning these constitutional …

The Public Broadcasting Act: The Licensee Editorializing Ban And The First Amendment, John C. Grabow
University of Michigan Journal of Law Reform
This article contends that the public is deprived of an important source of information on public affairs issues as a result of the section 399(a) prohibition on editorializing. After an examination of the legislative history of Section 399(a), and the heritage of broadcast regulation in the United States, the article concludes that the prohibition on editorializing is an improper restriction on free expression in violation of the First Amendment.

Energy And The North American Community: Canada, Mexico, And The United States, Mark S. Adams, Barry Steiner
UC Law SF International Law Review
This paper presents a discussion of the need for and the possible forms of the North American Community. It begins with a discussion of the value of such an organization in terms of the existing relationship among the North American countries. The second section discusses the goals of the Community. The paper concludes with an analysis of two possible forms for the organization and rejects a common market for economic, political, and legal reasons. Instead, the paper offers the idea of cooperative organization, one which stresses equality and unanimity, as the most appropriate form for the North American Community.

In addressing the subject of "reverse discrimination," I want to caution at the outset against permitting the use of the word "discrimination" to prejudice consideration of the subject. "Discrimination" has, in recent years, become a bad word. It tends to be used as a shorthand for "unjustifiably unequal treatment." In its original and still proper meaning, however, the word is quite neutral. Discrimination merely means differentiation. It comes from a Latin word that means "to distinguish." Accordingly, when we discriminate-i.e., when we differentiate or distinguish-among people, the propriety of our action depends upon the reasons that we have acted as …

The French Legal Studies Curriculum: Its History And Relevance As A Model For Reform, Thomas E. Carbonneau
Faculty Scholarship
This article attempts to describe and analyze those events which fostered the historical metamorphosis of the French legal studies curriculum. The predominance of a broad academic approach to law and the concomitant absence of a narrow "trade school" mentality in the French law schools might be attributed to the general organization of higher education in France. One of the primary contentions of this article is that the fundamental character of French legal education, which emphasizes the educating of jurists as opposed to the training of lawyers, is the product of a set of factors which are deeply rooted in French …
State Taxation Of Unitary Businesses , Peter G. Chen
State Taxation Of Unitary Businesses , Peter G. Chen
Fordham Urban Law Journal
The income taxation of multistate businesses has created problems for tax administrators, primarily with regard to the question of how to divide the income taxation amongst the multiple states. To address this, the concepts of unitary business and formula apportionment have been created. However, the non-uniform state taxation practices create difficulties even with the existence of these concepts. Some states have adopted the Multistate Tax Compact, but for it to be completely effective there still must be a uniform view adopted on what constitutes a unitary business. This note examines the constitutional issues attendant to developing a standard definition of …
Warrantless Container Searches Under The Automobile And Search Incident Exceptions, Jody Cosgrove
Warrantless Container Searches Under The Automobile And Search Incident Exceptions, Jody Cosgrove
Fordham Urban Law Journal
Warrantless searches of containers had historically been sustained under the exceptions to the fourth amendment protections developed for cases where exigent circumstances require immediate action. The Supreme Court of the United States then limited warantless container searches in United States v. Chadwick and Arkansas v. Sanders but these limitations were subject to various interpretations by the lower courts. This Note examines the various interpretations of these conflicts and their areas of conflict. It then argues for a strict interpretation of the Supreme Court limitations which is more consistent with the traditional exceptions to the fourth amendment's protections against unreasonable searches …
