Mining The Deep Seabed Implications For International Law And American Foreign Policy, Steven H. Fitzgerald
Graduate Program in International Studies Theses & Dissertations
Whether or not the United States may someday face a mineral shortage, the need for a coherent, unified minerals policy is critical to national objectives and national security. Deep-sea mining may be the answer to American (and world) mineral needs in the twenty-first century. However, there are numerous problems which must be dealt with and resolved in the near future, in order to enable the U.S. (and the world community) to take advantage of vast undersea resources. Deep-sea mining requires the development of technology, tremendous capital investments, and years of labor before production can begin. U.S. policy makers must decide …

The Fcc's New Equation For Radio Programming: Consumer Wants - Public Interest, Jerry V. Haines
The Fcc's New Equation For Radio Programming: Consumer Wants - Public Interest, Jerry V. Haines
Duquesne Law Review
The recent Federal Communications Commission deregulation of many aspects of radio station programming raises the recurrent issue of how intensively the FCC should regulate the programming of its broadcast licensees. The author summarizes the historical development of the Commission's programming authority, the factors which have encouraged the Commission to change its stance regarding informational programming, and the probability of impediments to the deregulation. The landmark Red Lion case is the most formidable legal barrier, he concludes, but there also are pragmatic, statutory, and philosophical considerations that should be examined.

The Path Of Legal Education From Edward I To Langdell: A History Of Insular Reaction, Ralph Michael Stein
Elisabeth Haub School of Law Faculty Publications
This article presents an analytic overview of key aspects in the history of legal education in England and the United States from the time of Edward I to the end of the last century. The response of lawyers and legal educators to the perceived need to protect the profession from a variety of ills and plagues is explored. The development of a sense of professionalism by those engaged in the teaching of law, a sense of professionalism that was reactive to public perception about lawyers as well as to academic dismay at the roles played by lawyers, will be explored …

Archipelagos And Archipelagic States Under Unclos Iii: No Special Treatment For Hawaii, Nancy Barron
UC Law SF International Law Review
The "special status" provisions of the Law of the Sea Treaty are limited to "archipelagic states" and a broad interpretation of the provisions to include archipelagos may directly conflict with the interests of large maritime powers to maintain freedom of the High Seas. This Note uses Hawaii as a focal point and discusses the competing policy issues as well as analyzing pertinent provisions of the Treaty in reaching the conclusion that no special status will be accorded the State of Hawaii.
