Political Parties Before The Bar: The Controversy Over Associational Rights, Gary L. Scott, Craig L. Carr Jan 1982

Political Parties Before The Bar: The Controversy Over Associational Rights, Gary L. Scott, Craig L. Carr

Seattle University Law Review

This article will discuss the scope and nature of constitutional protection to be afforded political party autonomy by the first and fourteenth amendments. The purpose of the present discussion is to review both legal and political sides of this question. Once this is done it will become clear that a party right to protected autonomy during the candidate selection process is not only founded upon solid constitutional ground but is also in keeping with sound political wisdom.

Refugee Resettlement In The United States: The Role Of The Voluntary Agencies, Norman L. Zucker Jan 1982

Refugee Resettlement In The United States: The Role Of The Voluntary Agencies, Norman L. Zucker

Michigan Journal of International Law

Statistics on refugee resettlement in the United States are obsolete as soon as they are published. What does remain current and constant, however, is that there is a global refugee crisis. The numbers of refugees in the world are not likely to diminish, and indeed, given the vagaries of international politics, the world's refugee population is likely to increase. As a major world power the United States has had to evolve a refugee policy. This policy operates on two levels: on the foreign level there has been an attempt to provide for the regional and international resettlement of refugees and …

A New Test For Trademark Dilution - Why North Carolina Should Adopt Section 12 Of The Model State Trademark Bill, Philip Summa Jan 1982

A New Test For Trademark Dilution - Why North Carolina Should Adopt Section 12 Of The Model State Trademark Bill, Philip Summa

Campbell Law Review

This comment will attempt to do three things: provide a useful definition of dilution; propose a clear test that can be applied to quickly determine whether, under Section 12 or the common law, a dilution case exists, and, if so, how it should be decided; and show why a state such as North Carolina should provide anti-dilution protection to its citizens.

Nordic Refugee Law And Policy, Göran Melander Jan 1982

Nordic Refugee Law And Policy, Göran Melander

Michigan Journal of International Law

Since the end of World War II, the Nordic states have shown an interest in refugee policy and have taken part in work on behalf of refugees through various international organizations. In the 1940s and the 1950s, when Western Europe was faced with a huge refugee problem, the Nordic states shared the burden with countries of first asylum in Central Europe by admitting refugees for permanent resettlement. In the 1960s and 1970s, when other continents were confronted with refugee problems, the Nordic states also generously contributed material assistance to refugees resettled in neighboring countries. In 1979, for instance, the Nordic …

Territorial Claims As A Limitation To The Right Of Self-Determination In The Context Of The Falkland Islands Dispute, Alejandro Schwed Jan 1982

Territorial Claims As A Limitation To The Right Of Self-Determination In The Context Of The Falkland Islands Dispute, Alejandro Schwed

Fordham International Law Journal

This Note will trace the development and present status of the right to self-determination under international law and its applicability to the decolonization of the Falkland Islands. No attempt will be made to determine whether Argentina's claim to sovereignty over the Islands is valid. The focus will be, rather, on whether the right of self-determination as set out by the United Nations can be limited and superseded by competing territorial claims.

Memorandum, Unidroit Study Group On Codification Of International Trade Law, Second Session, April 5-10, 1982, Peter Winship

Faculty Journal Articles and Book Chapters

The UNIDROIT study group on the progressive codification of international trade law held its second session in Rome from April 5-10, 1982. The 17 participants reviewed draft texts on the rules governing the substantive validity of international contracts (UNIDROIT Study L, Docs. 20 & 21). Although the session discussed in detail the substance of these drafts it did not have time to prepare final texts. At the end of the meeting it was understood that Michael Bonell of the UNIDROIT Secretariat, who had acted as secretary to the session, would prepare a summary of the discussions and the draftsmen of …

Contrary Jurisprudence: Tribal Interests In Navigable Waterways Before And After Montana V. United States, Russel Lawrence Barsh, James Youngblood Henderson

Washington Law Review

In 1974 the Crow Tribal Council enacted a resolution restricting reservation hunting and fishing to tribal members. No distinction was made between lands owned by the tribe or its members and the nearly thirty percent of the reservation area held in fee simple by non-members and the State of Montana. The resolution also purported to govern the Big Horn River, the bed of which the tribe claimed under its 1868 treaty with the United States. The State of Montana refused to recognize the tribe's jurisdiction to enact and enforce this restriction and continued to license non-member hunting and fishing within …

Union Representation In Construction: Who Makes The Choice?, Jan Stiglitz Jul 1981

Union Representation In Construction: Who Makes The Choice?, Jan Stiglitz

San Diego Law Review

This Article addresses the particular problems inherent in the construction industry that prevent employees from choosing whether to be represented by a union. The author examines three recent Supreme Court decisions that have given employers the freedom to choose whether or not their employees will be represented by a union. The author argues that, while it was motivated by a desire to prevent union domination of employees, the Court failed to perceive the unique role that unions play in the construction industry and the protection that unions provide for the worker. The author further argues that the goal of employee …

Notes On Preemption And Misc - 1981, Wendy J. Gordon Jun 1981

Notes On Preemption And Misc - 1981, Wendy J. Gordon

Scholarship Chronologically

As one of my students indirectly commented (the Herzog midterm?), section 301 PURPORTS to be exclusive. "Nothing in this title shall annul state rights etc." One student, Chris Binnig, indirectly suggested a way out of the exclusivity problem, other than the common sense of Abrams, namely that 301 talks about the general scope of copyright- something which may require some policy inquiry.
