Feminism And Disciplinarity: The Curl Of The Petals, Carol Sanger
Feminism And Disciplinarity: The Curl Of The Petals, Carol Sanger
Faculty Scholarship
In this Symposium, feminism has been invited to take a place alongside such well-established disciplines as history, philosophy, and economics in a consolidated exploration of interdisciplinary approaches to law. While sincerely extended – the feminist entry is not the only one that women are writing – and generously unbounded as to scope, ... the invitation raises what for many is a prior question: Is feminism a discipline at all?
As the feminist delegate to this interdisciplinary Symposium, I have therefore taken as my initial task consideration of the issue implicit in the invitation: feminism's credentials as a discipline. I explore …
Getting The Political Architecture Right, Richard Cullen, Peter Hanks
Getting The Political Architecture Right, Richard Cullen, Peter Hanks
Osgoode Hall Law Journal
As Australia approaches the twenty-first century, it finds itself, like a number of other Anglo-centred countries in the western world, including Canada, in the grip of continuing economic trauma. There has been a marked relative (and absolute) slip in general economic performance. This paper focuses on the linkages between this phenomenon and Australia's basic political architecture. It argues that, although renovation of Australian federalism is no panacea for these problems, there are linkages between Australia's aged, formal, political structure and its recent economic performance. Lack of attention to the task of serious, systematic renovation is allowing the present outdated political …

Bank Holding Company Act: Has It Lived Its Life, The , Carl Felsenfeld
Bank Holding Company Act: Has It Lived Its Life, The , Carl Felsenfeld
Faculty Scholarship
The Bank Holding Company Act of 1956 (BHCA) "regulates the acquisition of state and national banks by bank holding companies." The BHCA also regulates the nonbanking activities of bank holding companies and their nonbank subsidiaries. The BHCA was enacted and remains on the books for two fundamental reasons: 1) to prevent undue concentration in banking; and 2) to avoid the mixing of banking with other businesses unrelated to banking (generally called "commerce"). Both of these purposes have been or are being discredited, and it is time to ask whether the BHCA should be repealed. On several levels, banking is combined …

Maritime Jurisdiction And The Secession Of States: The Case Of Quebec, Jonathan L. Charney
Maritime Jurisdiction And The Secession Of States: The Case Of Quebec, Jonathan L. Charney
Vanderbilt Journal of Transnational Law
In this Article, Professor Charney discusses the maritime boundary delimitation issues that result from the creation of a new state through secession. While the author uses Quebec's maritime boundary concerns as an exemplar, the issues discussed are not unique to Quebec. The author notes that one cannot predict the ultimate resolution of maritime boundary disputes precisely, but certain factors will often affect the outcome. These factors include the geographical configuration of the disputed area, the viability of pre-secession boundaries, historic water claims, the doctrine of uti possidetis, and basic equity. The author concludes that maritime boundaries are so vital to …
Sex Selection: Regulating Technology Enabling The Predetermination Of A Child's Gender, Owen D. Jones
Sex Selection: Regulating Technology Enabling The Predetermination Of A Child's Gender, Owen D. Jones
Vanderbilt Law School Faculty Publications
The debate over the prohibition of sex (or gender) selection (also known as "preselection" or "predetermination"), has focused almost exclusively on the context of aborting a "wrong-sex" fetus after a fetal gender-identification procedure. Despite the fact that sex selection abortions represent only a small subset of sex selection procedures, attitudes toward the former are driving general policy approaches to the latter. However, the issues are analytically distinct, and only during the former infancy of the pre-conceptive (and non-abortive post-conceptive) technology for sex selection were members on both sides of the debate afforded the economy of using one logic to support …

Investment Policy And The Environment: The Role For European Community Law, Maurice Sheridan
Investment Policy And The Environment: The Role For European Community Law, Maurice Sheridan
Connecticut Journal of International Law
The past three years have witnessed an extraordinary degree of change in the countries of Central and Eastern Europe. The extent and pace of change have made it increasingly difficult to predict with any real assurance just which of the structures, institutions, laws or personnel, among other things, that are in place today will still be in place twelve months hence. Such uncertainty has meant that planning within these countries, and planning by those outside of but who wish to operate within, has either been executed in a perilously vacant lot, -or else has had to rely on rules and …

A Comparative Survey Of Culpa In Contrahendo, Focusing On Its Origins In Roman, German, And French Law As Well As Its Application In American Law, Steven A. Mirmina
Connecticut Journal of International Law
This paper will examine a theory of precontractual liability known as culpa in contrahendo, which can be translated as "fault in the negotiation process." The essence of the doctrine is as follows: When two parties bargain in order to enter a contract, and a contract is not consummated, one party may suffer damages due to the expenditures he made in preparation to enter the agreement. When one of the parties, through blameworthy conduct, prevented the contract from coming into force, he should be liable for the expenses of the other.
Such would be the case if a homeowner wanted to …

The Commodification Of "Nature's Metropolis": The Historical Context Of Illinois' Unique Zoning Standards, Fred P. Bosselman
The Commodification Of "Nature's Metropolis": The Historical Context Of Illinois' Unique Zoning Standards, Fred P. Bosselman
Northern Illinois University Law Review
Professor Bosselman takes an historical look at the early development of zoning in Chicago and concludes that the nineteenth century view of land as simply another form of capital that could be rendered standardized and fungible through commodification led to the adoption of the LaSalle factors. The author notes the influence of the human ecology theory of urban growth on the development of the LaSalle Bank standards and calls both for a reexamination of the theoretical foundations for the standards and for recognition that a theory based upon nineteenth century life may not accommodate the ecological realities of modern life.
