Method of Instruction

The educational program of the law school is designed to equip its graduates to render the highest quality of legal services, while instilling a sense of professional responsibility. The case method of instruction is used in many courses. The beginning student is trained in the analysis and solution of legal problems by the application of logical reasoning. The course of study is not designed to teach legal rules, but rather to provide a foundation for the application and analysis of the law and the development of professional skills. Substantive courses, dealing with the content of the law, …

The Constitutional Validity Of The Modification Of Joint And Several Liability In The Washington Tort Reform Act Of 1986, Gregory C. Sisk Jan 1990

The Constitutional Validity Of The Modification Of Joint And Several Liability In The Washington Tort Reform Act Of 1986, Gregory C. Sisk

Seattle University Law Review

With the Washington Supreme Court having recently invalidated the statutory cap placed on awards of noneconomic damages to tort plaintiffs as a violation of the state constitutional right to a jury trial, we may expect an increasing onslaught upon other controversial provisions of the Washington Tort Reform Act of 1986. In particular, the modification of the common law doctrine of joint and several liability, which was also accomplished by the Tort Reform Act and is codified at section 4.22.070 of the Washington Revised Code, has already become a target of plaintiffs' attorneys in tort litigation and has also come under …

An Evaluation Of Noaa's Role In Ocean Dumping Policy Implementation, Kenneth W. Barton Jan 1990

An Evaluation Of Noaa's Role In Ocean Dumping Policy Implementation, Kenneth W. Barton

Marine Affairs Theses and Major Papers

Dumping of wastes into the ocean has gone on for years especially in the New York Bight. The National Oceanic and Atmospheric Administration (NOAA) is mandated by Title II of the Ocean Dumping Act of 1972 to investigate the effects of ocean dumping on the marine environment. However, there is a perception within Congress, the public and other agencies that NOAA is not meeting it's responsibilities with regard to ocean dumping research. The effectiveness of NOAA's ocean dumping policies and programs and the difficulties in implementation experienced by the agency are evaluated by applying George Edwards' theory of policy implementation. …

Environmental Implications Of Developing The Nonliving Resources Situated In The Exclusive Economic Zone Of The United States, John W. Kindt Jan 1990

Environmental Implications Of Developing The Nonliving Resources Situated In The Exclusive Economic Zone Of The United States, John W. Kindt

Vanderbilt Journal of Transnational Law

This Essay provides an overview of some of the environmental issues arising from mineral mining in the United States exclusive economic zone (EEZ). Professor Kindt points out that the United States establishment of a 200-mile EEZ, and the concomitant interest in mining the minerals found within it, prompted concerns over the environmental consequences of mining activities. Professor Kindt summarizes the guidelines for mining of hard minerals recently promulgated by the Department of the Interior (DOI) and examines the House of Representatives counterproposal, the National Seabed Hard Minerals Act of 1989 (NSHMA 1989). He notes that a prime difference between the …
