A Clash Of Cases: Jury Death Qualification And The Fair Cross-Section Requirement, Joel Stephen Sansone
A Clash Of Cases: Jury Death Qualification And The Fair Cross-Section Requirement, Joel Stephen Sansone
Duquesne Law Review
Witherspoon v. Illinois and Taylor v. Louisiana have delineated the impact of the death qualification process on jury selection in America. The author examines the dilemma that arises in trying to construe these two Supreme Court cases consistently, and reviews Grigsby v. Mabry, the only decision to directly confront the apparent inconsistency of Witherspoon and Taylor. The author concludes that the death qualification process adversely affects the impartiality of a jury otherwise drawn from a fair cross-section of the community.

An Assessment Of Affirmative Action In Law School Admissions After Fifteen Years: A Need For Recommitment, Leo M. Romero
An Assessment Of Affirmative Action In Law School Admissions After Fifteen Years: A Need For Recommitment, Leo M. Romero
Faculty Scholarship
Law schools have been admitting minority students through affirmative action programs since the late 1960s. The number of minority students matriculating in American law schools increased significantly as a result of affirmative action. Nearly three thousand or 4.3 percent of the 68,386 students enrolled in 1969-1970 were members of minority groups. By 1982-1983, the number and percentage of minority students had increased to 11,611 and 9 percent of the law school population of 127,915. The percentage of minority applicants enrolled in the first year of law school jumped from 4.2 percent in 1969-1970 to 10.5 percent in 1982-1983.

Disclosure By Issuers Of Municipal Securities: An Analysis Of Recent Proposals And A Suggested Approach, Robert D. Tuke
Vanderbilt Law Review
The following considerations impacting on the disclosure issue have been developed in this Note: the uniqueness of the municipal securities industry, owing to the diverse natures of the securities, the wide variety of issuers, and the particular means of marketing the securities; the special circumstances created for underwriters by the competitive bidding process; the varied roles of other participants in the distribution process--fiscal agents, bond counsel, governmental accountants; the existing state machinery for regulation and control; the practical limitations on the SEC--both in staff capacity and expertise; the need for uniformity in disclosure to prevent weakened marketability of municipal securities …
Fcc Broadcast Standards For Ascertaining Community Needs, Arthur P. Deluca
Fcc Broadcast Standards For Ascertaining Community Needs, Arthur P. Deluca
Fordham Urban Law Journal
This comment examines: (1) the history of the ascertainment procedures, including the function of the original Primer; (2) the effect of the Renewal Primer amendments on the ascertainment procedures; and (3) the significance of the Bamford cases in light of the treatment of badly-organized groups under prior ascertainment procedures, and in light of the issuance of the Renewal Primer. The comment argues that the Primer's purpose of increasing the responsiveness of a broadcast applicant to the needs of its proposed service area has improved the situation for the more organized significant groups, such as minority groups, but its effectiveness as …

The Abused Child And His Parents, Richard David Young
The Abused Child And His Parents, Richard David Young
IUSTITIA
Children in our society pass through a prolonged period of dependency during which they are taught the complex technological and social skills necessary for successful adult functioning. The child's experiences during this period can have profound effects on the development of his potential for meaningful interpersonal relationships, competency, and creativity. The child's dependence needs are the complement of the caretaker's nurturance. When nurturance fails or is inconsistent, societal loss merges with individual tragedy. Yet nurturance does occasionally fail. Some of those charged with the care of children abdicate their responsibilities, and do not provide the physical and/or emotional necessities for …

Vanderbilt Law Review
In the recent decision of Bradley v. School Board, a Virginia federal court ordered the consolidation of the predominantly black Richmond school district with the surrounding all-white suburban school districts of Henrico and Chesterfield Counties. This decision marks the first time that a court has consolidated two or more autonomous school districts for the purpose of achieving a racial balance in the schools that reflects the racial composition of the consolidated areas as a whole. While Judge Merhige in Bradley punctiliously followed the principles enunciated by the Supreme Court in Swann v. Charlotte-Mecklenburg Board of Education and its earlier desegregation …
