The "God Gap" In International Affairs: Missing Cross-Cultural Conversations In International Humanitarian Law And Islamic Jurisprudence, Corri Zoli May 2022

The "God Gap" In International Affairs: Missing Cross-Cultural Conversations In International Humanitarian Law And Islamic Jurisprudence, Corri Zoli

Florida Journal of International Law

The main purpose of this Article is, thus, to set out a preliminary case for such a rapport, one that brings together interdisciplinary scholarship in international law and security studies, and demonstrates in the specific case of Islamic and International Humanitarian Law (IHL) the potential to identify shared conceptual tools and common assessments of cross-cutting international security challenges.

In the following parts, I first outline key barriers in social science and comparative research on Islamic law and its implications. I then turn to the second prong in the argument, the symmetry between the challenges that both international and Islamic legal …

Experimental Jurisprudence, Kevin Tobia May 2022

Experimental Jurisprudence, Kevin Tobia

University of Chicago Law Review

“Experimental jurisprudence” draws on empirical methods to inform questions typically associated with jurisprudence and legal theory. Scholars in this flourishing movement conduct empirical studies about a variety of legal language and concepts. Despite the movement’s growth, its justification is still opaque. Jurisprudence is the study of deep and longstanding theoretical questions about law’s nature, but “experimental jurisprudence,” it might seem, simply surveys laypeople. This Article elaborates on and defends experimental jurisprudence. Experimental jurisprudence, appropriately understood, is not only consistent with traditional jurisprudence; it is an essential branch of it.

As Seen On Screen: American Ambivalence Shown Through Death Penalty And Vigilante Films, Lisette Donewald May 2022

As Seen On Screen: American Ambivalence Shown Through Death Penalty And Vigilante Films, Lisette Donewald

Honors Scholar Theses

The United States is one of the last western nations still practicing capital punishment. A history of and commitment to vigilantism and its ideals offers an explanation of America’s retention of capital punishment. Employing scholarship on law and popular culture and vigilantism, this thesis finds that pro-death penalty frames are prevalent in vigilante films while anti-death penalty frames are prevalent in films that focus specifically upon capital punishment. Since the 1960’s however, there has been a gradual shift towards anti-death penalty frames and away from pro-death penalty frames as well as changes in the themes presented in the two genres …

Exploring The Workplace Climate At Police Agencies During Civil Unrest And The Factors Influencing Officers' Participation In Black Lives Matter Protesting, Joshua R. Ruffin May 2022

Exploring The Workplace Climate At Police Agencies During Civil Unrest And The Factors Influencing Officers' Participation In Black Lives Matter Protesting, Joshua R. Ruffin

Sociology & Criminal Justice Theses & Dissertations

Scholars have long documented the negative relationship between police and communities of color. While these findings are of great importance, research remains limited on how connected police officers are to social justice movements (e.g., Black Lives Matter, or BLM for short) and the purposes behind why they exist. Furthermore, many studies focusing on police officer experiences tend to examine officer experiences with protesters, with limited studies focusing on their experiences with other officers during civil unrest and on the factors that influence their participation in protest movements when off duty. To help fill this gap, this study utilized semi-structured interviews …

Neither Trumps Nor Interests: Rights, Pluralism, And The Recovery Of Constitutional Judgment, Paul Linden-Retek Apr 2022

Neither Trumps Nor Interests: Rights, Pluralism, And The Recovery Of Constitutional Judgment, Paul Linden-Retek

Cleveland State Law Review

This Article develops a novel framework for the adjudication of rights in an age of partisan and societal polarization. In so doing, it defends judicial review in a divided polity on new grounds. The Article makes two broad interventions.

First, the Article cautions against recent calls to shift rights adjudication in the United States from Dworkinian categoricalism toward proportionality analysis. Such calls correctly identify how categoricalism, by embracing the absolute nature of rights as “trumps,” pits citizens harshly against one another. The problem, however, is that proportionality’s proponents fail to see how it imposes a rights absolutism of its own. …

Endorsing After Death, Andrew Gilden Apr 2022

Endorsing After Death, Andrew Gilden

William & Mary Law Review

An endorsement is an act of giving one’s public support to a person, product, service, or cause; accordingly, it might seem impossible for someone to make an endorsement after they have died. Nevertheless, posthumous endorsements have become commonplace in social media marketing and have been increasingly embraced by trademark and unfair competition laws. Entities representing Marilyn Monroe, for example, have successfully brought trademark claims for the unauthorized use of Monroe’s name, have successfully brought false endorsement claims under section 43(a) of the Lanham Act, and regularly have promoted products through the Instagram-verified “@marilynmonroe” page. Marilyn Monroe survives today as a …

Vedantic Basis And Praxis Of The Integral Advaita Of Sri Aurobindo, Debashish Banerji Mar 2022

Vedantic Basis And Praxis Of The Integral Advaita Of Sri Aurobindo, Debashish Banerji

Monsoon: South Asian Studies Association Journal

The integral nondualism of Sri Aurobindo can be traced to the great pronouncements (mahāvākya) of the Upanishads and later commentaries. This study examines teachings on the Supermind (vijñāna) and the other four kinds of consciousness that define human reality: Matter (annaṃ), Life (prāṇaḥ), Mind (manaḥ), and Bliss (ānanda). Through Yoga and Tantra, one learns and embodies the pathway to the divine.

Digital And Spatial Humanities Mapping: Eurasia-Pacific Early Trade And Belief Linkages, Igor Sitnikov, David Blundell

Monsoon: South Asian Studies Association Journal

The Eurasia-Pacific is a dynamic region of rapid economic growth, cultural awareness, natural resource exploration, and military buildup. The concept of the region is relatively new, featuring contested vast areas of geo-resource space of numerous cultures and languages. The current findings in anthropology and archaeology and even its more specific subfields such as folklore are important contribution to the understanding of periodic environmental changes and technical innovations were the main forces of transformations in social structures that have determined the mechanisms and levels of cross-cultural trade activity across the region. We have traced early trade and belief linkages across Eurasia-Pacific …

The question: What is in a name? started the ball of investigation rolling and along the way were added more supporting blocks such as history, iconography, function and purpose, notion of purity and impurity, and finally the hiti in popular culture to get a complete picture of the subject in question.

Ganges In Indian Sculpture And Literature: Mythology And Personification, Nalini Rao Mar 2022

Ganges In Indian Sculpture And Literature: Mythology And Personification, Nalini Rao

Monsoon: South Asian Studies Association Journal

The river Ganges is a symbol of wealth, purity and eternity, and its sacred waters have inspired sages, philosophers, and artists in India who have immortalized its divine imagery. However, it has rarely been understood from a historical point of view, as to how it became so sacred and to view it from a multi-dimensional and interdisciplinary perspective with an accumulation of layers of historical thought and practices, provides a rationale for the living practices around the river. The paper explores the evolution of the concept of sacredness and eternity of River Ganges through art- historical and archaeological evidence. It …

Shame And Justice: Partners Of Individuals On Sex Offender Registries Encourage Policy Reform, Kristan N. Russell, Katie M. Snider, William P. Evans, Shawn C. Marsh

Qualitative Criminology (QC)

Sex offense registration and notification (SORN) policies can contribute to stigma and negative consequences for partners of registered individuals. The present study utilized a self-report questionnaire to ask these partners what they would say to policymakers if given the opportunity. A thematic analysis of the responses revealed three themes which highlight the distinct issues related to registries, describe direct consequences experienced by the partners, and propose changes to existing policy. This study provides valuable insight into the experiences of a hard-to-reach population and can help generate critical discussion around the sweeping impacts SORN policies have on individuals they were not …

Saving Family Farms From Eliminated Step-Up In Basis, Sydney Burckart Mar 2022

Saving Family Farms From Eliminated Step-Up In Basis, Sydney Burckart

The Business, Entrepreneurship & Tax Law Review

To achieve tax equality, lawmakers have proposed eliminating the step-up in basis for assets passing through an estate at death. Closing the loophole would indeed tax the rich, but it would also impact middle-class Americans, including full-time farmers. Farmers would incur large tax liability, inhibiting their ability to earn a living exclusively on the farm. Eliminating step-up in basis is a volatile issue that lawmakers have considered implementing to achieve tax equality. This article will present the history of the step-up in basis debate and analyze past efforts to close the step-up in basis loophole. That history informs recent tax …

A Double Take On Debt: Reparations Claims And Regimes Of Visibility In A Politics Of Refusal, Vasuki Nesiah Feb 2022

A Double Take On Debt: Reparations Claims And Regimes Of Visibility In A Politics Of Refusal, Vasuki Nesiah

Osgoode Hall Law Journal

This article proposes that the concept of “odious debt” provides an especially fruitful legal framework for the Haitian and Caribbean Community (CARICOM) demands for reparations and debt severance. The concept renders visible different dimensions of the background economic order that have been constitutive of postcolonial sovereignty, and the histories of trade and aid that have engendered debt. In analyzing the work of different regimes of visibility, I have found it useful to think with Abderrahmane Sissako’s 2006 film Bamako, and the world of Wakanda in Ryan Coogler’s Black Panther (2018)—two films that work through the stakes of visibility, recognition, and …

Control, Allegiance, And Shame In Male Qing Dynasty Hairstyles, Carolle Pinkerton Feb 2022

Control, Allegiance, And Shame In Male Qing Dynasty Hairstyles, Carolle Pinkerton

Dissertations, Theses, and Capstone Projects

This thesis is about the politicization of hairstyles in imperial China. They indicated conformity with social norms, or rebellion against them. This was especially true under the country’s last dynasty. The Manchu conquerors imposed their own hairstyle, the queue, on their Han Chinese subjects to make their rule palpable to China’s illiterate millions. “Hair martyrs” who refused to accept this “barbarous” hairstyle were ruthlessly eliminated. The Manchus had feared assimilation into the much larger Han population. But the introduction of one uniform male hair style for both Manchus and Han blurred the lines between the two groups. In this way …

The Privacy Paradox By Proxy: Considering Predictors Of Sharenting, Niamh Ní Bhroin, Thuy Dinh, Kira Thiel, Elisabeth Staksrud, Kjartan Ólafsson

Articles

Despite being worried that children may compromise their privacy by disclosing too much personal data online, many parents paradoxically share pictures and information about their children themselves, a practice called sharenting. In this article we utilise data from the EU Kids Online survey to investigate this paradox. We examine both how individual charac‐ teristics such as demographics and digital skills, and relational factors, including parental mediation styles, concerns about children’s privacy, and communication between parents and children influence sharenting practices. Counter‐intuitively, our findings show that parents with higher levels of digital skills are more likely to engage in sharenting. Furthermore, …

Culture And Fair Use, Michael P. Goodyear Jan 2022

Culture And Fair Use, Michael P. Goodyear

Fordham Intellectual Property, Media and Entertainment Law Journal

The intersections of race and copyright have been underexamined in legal scholarship, despite repeated calls for further scrutiny. The scholarship has so far focused primarily on identifying where copyright has fallen short in protecting the creative works of artists of color. This Article, instead, hopes to offer one viable solution for creating more inclusivity of different cultures in copyright: the approval of cultural adaptations under fair use.

Cultural adaptations—the transformation of preexisting works to reflect the cultural and social mores and norms of a different group—would appear at first glance to be prohibited as derivative works, which, under the Copyright …

Racial Capitalism In The Civil Courts, Tonya L. Brito, Kathryn A. Sabbeth, Jessica Steinberg, Lauren Sudeall Jan 2022

Racial Capitalism In The Civil Courts, Tonya L. Brito, Kathryn A. Sabbeth, Jessica Steinberg, Lauren Sudeall

GW Law Faculty Publications & Other Works

This Essay explores how civil courts function as sites of racial capitalism. The racial capitalism conceptual framework posits that capitalism requires racial inequality and relies on racialized systems of expropriation to produce capital. While often associated with traditional economic systems, racial capitalism applies equally to nonmarket settings, including civil courts.

The lens of racial capitalism enriches access to justice scholarship by explaining how and why state civil courts subordinate racialized groups and individuals. Civil cases are often framed as voluntary disputes among private parties, yet many racially and economically marginalized litigants enter the civil legal system involuntarily, and the state …

What Us?, Amanda Parris Jan 2022

What Us?, Amanda Parris

Journal of Interdisciplinary Perspectives and Scholarship

McGhee (2021) concludes the introduction to The Sum of Us by declaring that she is “fundamentally a hopeful person, because [she knows] that decisions made the world as it is and that better decisions can change it” (p. xxiii). In this brief response I want to take on two problematic aspects of McGhee’s declaration, her hope and her voluntarism. I use an Afropessimistic lens so that we might, as Frank B. Wilderson III (2020) urges, make some of McGhee’s book “more dangerous to the U.S. and the world” (p. 250).

The Institutions Of Family Law, Clare Huntington Jan 2022

The Institutions Of Family Law, Clare Huntington

Faculty Scholarship

Family law scholarship is thriving, with scholars using varied methodologies to analyze intimate partner violence, cohabitation, child maltreatment, juvenile misconduct, and child custody, to name but a few areas of study. Despite the richness of this discourse, however, most family law scholars ignore a key tool deployed in virtually every other legal-academic domain: institutional analysis. This methodology, which plays a foundational role in legal scholarship, focuses on four basic questions. Scholars often begin empirically, identifying the specific legal, social, and economic institutions that shape an area of legal regulation. Beyond descriptive accounts, scholars analyze how authority is and should be …

Cross-Cultural Communication In A Crisis: The Universality Of Visual Narrative In The Covid-19 Pandemic, Michael D. Murray Jan 2022

Cross-Cultural Communication In A Crisis: The Universality Of Visual Narrative In The Covid-19 Pandemic, Michael D. Murray

Law Faculty Scholarly Articles

A primary goal of twenty-first century legal works is to communicate the law effectively to diverse audiences. Many of the most needful and most vulnerable audiences for legal information have members who lack basic literacy skills and suffer linguistic and cultural confusion from verbal textual media—namely, the printed word. Yet for centuries, legal rules and government restrictions have been communicated nearly exclusively through the printed word. Recent scholarship in visual legal rhetoric, visual literacy studies, and visual cultural studies is informed by cognitive psychology and neuroscience that all points to a solution: visual communication of the law. Visual communication is …

Honor Thyself, Alonzo O. Williams Jan 2022

Honor Thyself, Alonzo O. Williams

Dance (MFA) Theses

The black male experience and identity in America are filled with complexity. We struggle to know ourselves. We work to see the way of love and the peace of an unviolated free spirit. We want to engage with ourselves with the highest degree of freedom and comfort, not to continue to question our identity in a life-threatening white patriarchal masculinity ideal. Honoring oneself from the lenses of the Reconstruction era of the United States is essential. Reconceptualizing this history explores the significance of emphasizing Reconstruction in my life as a black male to go through a process of self-discovery and …

A New Methodology For The Analysis Of Visuals In Legal Works, Michael D. Murray Jan 2022

A New Methodology For The Analysis Of Visuals In Legal Works, Michael D. Murray

Law Faculty Scholarly Articles

The goal of this Article is to introduce a comprehensive methodology for the analysis of visuals used for communication in legal works, by which I mean transactional and litigation documents, legal instruments, primary and secondary sources of law, and legal informational materials. To date, the scholarship on visuals in legal communications has been heavily descriptive, with some forays into the ethical and practical considerations of the use of “visualized” legal works. No one has yet devised a comprehensive analytical methodology that draws upon the disciplines of visual literacy, visual cultural studies, visual rhetoric, and mise en scène analysis to evaluate …

How Culture Impacts Courtrooms: An Empirical Study Of Alienation And Detachment In The Cook County Court System, Maria Hawilo, Kat Albrecht, Meredith Martin Rountree, Thomas Geraghty Jan 2022

How Culture Impacts Courtrooms: An Empirical Study Of Alienation And Detachment In The Cook County Court System, Maria Hawilo, Kat Albrecht, Meredith Martin Rountree, Thomas Geraghty

Journal of Criminal Law and Criminology

Courtrooms operate as unique microcosms—inhabited by courtroom personnel, legal actors, defendants, witnesses, family members, and community residents who necessarily interact with each other to conduct the day-to-day functions of justice. This Article argues that these interactions create a nuanced and salient courtroom culture that separates courtroom insiders from courtroom outsiders. The authors use the Cook County courts, specifically the George N. Leighton Courthouse at 2650 S California Avenue in Chicago, Illinois, to investigate courtroom culture and construct a thematic portrait of one of the largest criminal court systems in the United States. Using this newly constructed data source of rich …
